  1. Hopefully someone could settle this for us.

    Once you have your green card, you can travel with that and your country of citizenship passport right?

    We were apporved pending name check at interview so the passport was never stamped. Our welcome letter has been sent so hopefully green card will arrive soon too.

    Do you need that stamp in your passport as well to travel or just green card and passport?

    My husband believes that he does need it and wants to make an infopass for it.

    So get stamp or not needed?

  3. i dont know the answer to your questions, obviously there does seem to be flaws in the logic of what they told you, but fact is they did tell you to wait until May 15, and I am sure they are not doing it just to make you wait longer! just be patient, you have a nugget of hope, and soon it will be over.

    Thanks for your reply. That explains things more then what we were told at the infopass appointment. I'd been looking for some timeline or something that showed how long after name check clearing did they send the greencard.

    The woman at the infopass just said that she couldn't send us up because it hadn't been six months since the interview, that was all.

    We're just going a little nuts we've started making travel and moving plans but none can be finalized till the card is in hand. It's messed up that someone can have so much control over your future.

  5. It's just that when I first posted about this many people also questioned why we weren't allowed to go "upstairs."

    Also like everyone on here I'm tired of waiting. We're told at our interview that we're apporved pending name check and 5 months later we found out that he's cleared name check but no status change on our case.

    My reasoning for going is we're out of processing time, we're out of name check, what's the new hold up?

    It's just I don't understand why we weren't allowed "upstairs"in the first place. You can't really agrue with them because they do somewhat hold your future in their hands.

    I guess what my real question is, Why if the one thing that was holding up our case is now done why do we have to wait till after 6 months after our interview date?

  6. Hello everyone!!

    Last week I had posted about my husband and I going to an infopass appointment and being told that his name check had cleared about a week earlier but we were not allowed to see an immigration officer till after May 15th (6 months after interview date). We haven't seen any changes in our status online, not a single touch since December 2, 2006.

    We're convinced that they won't do or send anything till we go there.

    Do you think that if we made another infopass appointment we'd be denied from seeing an officer again? Part of me thinks that the woman didn't let us go up because it was a religious holiday and they may have been short staffed, the waiting room area was completely empty and there were less then 10 people at the windows. Maybe it's me being hopeful.

    It's just why can't they just send us upstairs? The sooner they do this the sooner they get another case done.

    :help: What would you guys do? Would you make an Infopass now or wait till May 15? :help:

    as part of AOS as you all know, you are required to get married within 90 days, well we did of course, but this wasnt our 'big day' as im sure the same applies to allot of you, this was to get the paper work rolling.. now that we are legally married, we need to find someone to perform our traditional ceremony, our church wont do this as they say they cant marry us twice, so Id like to ask you guys if you had this same thing happen to you, and if you know any Pastors/ministers in the Dallas area that are willing to perform this type of ceremony that would also be great! just to explain a bit more on our situation, we didnt tell all our friends that we already married, as allot of them are coming from overseas we want them to think the day is in July, the day we getting married! We just felt some people wont understand and it will be to complicate d to explain why it is that government requires you to get married within a time limit.

    Hope im not the only one in this boat!

    I can just tell you our experience with this. We also did a civil ceremony so that we could start the AOS process and then did a big ceremony, which we consider our wedding day a couple of months later. We were married in a Catholic church and our priest wasn't too happy when we told him that we had done the civil ceremony first. But he then told us to go back and ask for a new marriage license and the issued us another one and called it a remarriage. The woman that issued the license said they've had to do that many times for cases like this where you've had the civil marriage and then want the religious one.

    Again this is my experience and it may not work the same with your state or religion.

  8. We actually are out of normal processing time. But at the interview we were given a letter that stated that we were approved pending name check. And the woman at the window said that she couldn't send us "upstairs" because it hadn't been six months since the interview date.

    I believe that's pointless, they could have gotten rid of us right then and there. But they probably have a checklist of requirements you have to meet before you're sent "upstairs."

    Another question, has anyone gone through something similar? Or do you know of someone else who's gotten a verbal that name check cleared? I'm just wondering how long between name check being cleared and greencard arriving?

    On Friday we had an Infopass appt. to find out what was going on with our case. Well after talking to one extremely rude woman we were given a number and asked to take a seat. The next person was much nicer and gave us some good news. She told us that my husband name had finally been cleared about a week ago. :dance: We got excited and were hoping she ask my husband for his passport and stamp it but she said because it hadn't been 6 months since our interview date she couldn't send us upstairs until May 15th. She said to be patient for just a little longer that the green card could show up in the mail before then. So we left there pretty happy. :star:

    But the thing is that there's been no change in our case online. Is that normal? How long do you guys think it will take to get the green card now if what the woman told us is true?

    Thanks so much for all the help you guys have provided. We're starting to see the light at the end of the long tunnel!

    I should have been clearer in my last post. The EAD renewal is not connected to my husband's case. I'm asking the question for a cousin. In my husband's case I'm clear as to how to file for renewal but my cousin's case is a little different. I don't know if anyone has any experience with his type of case. Here's a little info on his case.

    • He's a Cuban citizen
    • He can't file AOS till he's been here at least one year (he should be filing in about a week)

    I know that there are special rules/steps for Cuban citizens, I'm just not up to date with them. The rest of my family came for Cuba but that was ages ago, so I know the laws have changed. He's got a lawyer but he seems of no help.

    What does he need to do to renew his EAD since it expires soon and his AOS papers have not been filed???

    Everyone here has been helpful with my husband's case but his case is pretty average. I hope someone out can help!

    If you need me to provide more info to answer my question, just ask!

    I hadn't even thought about a mortgage. :( If we have no word this summer we will probably stay put in NJ and hopefully buy a house. I'm not mentioning the mortgage problems to my husband, he's upset enough about possibly having to give up on his dream job.

    We don't want to apply for an AP for the same reasons, well that and the fees.

    Does anyone think that the fact that he had a pilot's license in Chile could be what's causing the delay with the name check?

  12. :help: My husband and I went to our interview 11/15/06. We were told that we were approved pending the name check. I know I'm in no position to complain given that many have been waiting MUCH longer then we have, but this is still horrible. We have put our lives on hold waiting for this greencard. My husband wants to attend a flight school in Florida (he was a pilot in Chile), we are currently in NJ. The school won't let him apply or even talk to anyone there till he physically has the card. This means we're sitting here not knowing when we can move or if we'll ever get to move. And because he has a pilot's license in Chile, he has to travel back there to get a medical record. Again can't do anything till we get that greencard. It's really annoying. I want to know if there's anyone I could call or email to get more info.

    Also I485 was last "updated" 12/2/06 and it says that the case was sent to Missouri Service Center. Does anyone know how to check their processing times, I don't see Missouri listed as a service center in that drop-down thing on the website.

    Any kind of reply would be greatly appreciated, even mean ones, at least then I probably will stop worrying and being a baby about this!!! :blush:

  13. We sent in all our forms on June 26th, we received three NOA letters all dated July 3, one for AOS, EAD and my petition. He entered through a Visitor Visa many times on his last trip we met and he overstayed the visa to stay with me.

    I understand about the SSN not having anything to do with biometrics but I've noticed that many on their timeline have the SSN & EAD listed together. Do we receive a letter informing us of when to file for SSN?

  14. :help: My husband went to his biometric appointment back on July 28th and nothing has happened yet. How long does it "normally" take to receive the SSN and EAD after that? He's going nuts at home all alone not working and the extra income would really come in handy. Is there any other way to check your status besides that online thing, cause that never seems to change in our case.

  15. Hi I'm new here and I'm hoping someone here could help me.

    We filed all the paperwork for my husband's AOS, he done the biometrics and now we're just waiting.

    We had been told by friends and a travel agent that he may travel within the US with his foreign passport as his id. I was wondering if anyone had done this and how it went. We booked a flight for a family function because of the advice of the travel agent, but checking the airlines website they just say government-issued ID. I just want to make sure we get on that flight. Any response would be helpful. Thanks in advance for your help.
