EastCoast, we must have had the same IO. He only requested to see my original and expired passport and driver's license. I offered my marriage, divorce and my wife's naturalization certificate and he said he didn't need them because he has them in my folder. I then noticed a large file folder on the desk so I ask him if that file folder was mine and he said, both of them as he pointed to another file. No kidding, each file was at least 4 inches tall. He stated it's all the files they have collected internally on me including the ones I sent over the years. I too went overboard and sent in a lot of supporting documents to avoid any delay or RFE (s)

Thank you for this! It is a bit scary and concerning that we get so many differing answers. I am not sure what I'd do next, but I THINK Infopass would be the next "step" -- just because you have a real person in front of you and it's at the field office, so they should know if they have your application or not -- that's my 2 cents.

No problem. I think I'm just going to wait another week or two and to see if I receive the letter or an update online and if not, I'll just schedule the INFOPASS.

Hey guys,

Last week I sent a secured message and received the response "Your application information has been entered into the system which schedules applicants for interviews at their local Field Office” I decided to call the NBC to find out if I’m in line but they the pretty much gave me the same response. I tried calling back last Friday to speak with an L2 but was told that there were very busy and wasn’t taking any calls until after 5pm.

I called back today around 2:30pm and had to request an automatic call back which I received at 5:31pm and the rep informed me that my case was still at the NBC. I informed her that this was not what I was told last week including the secured message response I received which she read while reviewing my account. She claimed that the background check may not have been completed but as soon as it’s done, the NBC generally send it off immediately to the local. At this point, I became a little irate about the delay so she then offered to send a request for the NBC to send it off to my local office. I am now confused because how can she say in one breath that the NBC generally send it off when they are finish but all of a sudden she can send a request to the NBC asking them to send my application packet to the local office with makes no sense. She claimed that they will respond within 2 weeks. I asked her about the 5-month timeline and she told me that they are working on May 2016 and that my application is within the 6-9 month timeline. She explained to me that the 5-month is calculated from the time the local office receive my file. She preceded to tell me that the reason why there is a delay is due to the election and a lot of people filed their N-400 around the same time I filed. I honestly don’t think she knew what she is talking about. She didn’t sound confident throughout the conversation and I also I had a difficulty understanding her when she talked due to her thick Hispanic accent.

I’m not sure what to make of this but do you think I should call back and speak with another L2 or just schedule an INFOPASS appointment. What are your thoughts?

I also had tabs and a cover letter, which they removed from the application before they sent it back to me. I did not add anything back in except a new credit card authorization form, which was missing from the returned package. I did not fill out a new application. I used the one they returned that was already signed and dated. I have had no problems, my application has been accepted, credit card charged and my online status says my biometrics notice is one the way.

To be safe, I think I'll just do it the same way especially since they put codes at the bottom of every page. They also request that I return the green rejection letter when I resubmit the application. Thanks NCPAL. I'll keep y'all posted.

What do they have printed?

There are a bunch of numbers and codes right across the bottom of every page. The only thing I recognized was the date and time stamp of 8/2 instead of 8/1 when they actually received the package.

Yes, they sent the entire application package back along with the rejection letter. It looked like it was already scanned in (all pages had a barcode/info on the bottom). I resubmitted the same package and they accepted that. The only form that was missing was the credit card authorization form, which the rejection letter states was destroyed so I sent in a new one. Good luck!

I just received back the entire application package and the rejection letter today which states that the application was rejected for not filing within the 90 days. Not sure if they had attempted to charge the card but since I cancelled and replaced it, I don't have to worry about then charging me twice. My only question is that when the returned the package, they removed my tabs and the table of contents letter. Should I just ship it back the same way I received it and not put back the table of contents and the tabs to separate and identify the documents also, should I reprint a new application, sign and date it today. They already have some things printed at the bottom of every page of the entire package.

Hey Skull,

My application was delivered 1 day before my eligibility day according to the early filing calculator. My application was rejected and sent back to me without charging the $680. The rejection notice was issued three days later (by that time I was eligible), but they go by the date the application was received. I just resubmitted the application and my card was charged $680. The same will probably happen to you, so hopefully you won't have to pay twice.

Thank you for responding and confirmed what I suspect would have happened to me. I didn't want to take the risk and wait to see if they would look at it and hopefully reject immediately without charging my card. Sometimes they don't catch it until after they accept and create the NOA and then you're out of luck so I just cancelled the card to make sure it doesn't go through which will automatically get rejected for no-payment. I'll get the replacement card in 2 days to reprocess the new application. Did they send back the original application packet with the denial letter?

KASH2011, thanks for your response but based on the date calculator, the earliest accepted date would be 8/03 and they received it on 8/01. I don't want to take the risk like other people in the past who got denied at the interview for applying two days early and then had to reapply and pay another $680 so, therefore, I definitely think I should just force a rejection by blocking my payment in which case they would send me back my application packet and all I have to do is to resend with the new payment. Just wondering how long they will take to send it back. I also have a duplicate copy of my packet except my passport photos.

KASH2011 or anyone who may know. Based on the early filing calculater, I think I filed 2 days earlier than I should have. For some reason when I used the

between date calculater online instead of this one, I misinterpreted the info of 92 days as within the time frame maybe because I was so eager to file. smh!!

I also didn't think they would have received the package until about Tues or Wed since I shipped it off Saturday. Anyway, do you think this will pose a

Hello, everyone! I received a letter in the mail yesterday informing me that my case was approved on 07/18/2016. Finally!!!

I also received an email and a text update today stating "On July 21, 2016, we ordered your new card for Receipt Number" I'm so happy!!!

I can't wait for the final step to apply for my citizenship which will be in less than two weeks. I hope it doesn't take as long as the ROC.

Thank you all very much for your help and guidance throughout this process. It's greatly appreciated!!!

You are using the number from your bio letter, right?

If so, it might just be that they did not scan your papers correctly into their online system. It happens and does not mean that anything is wrong with your case. I had the same problem back when I did my AOS, which was in "Case Not Found" status until the day it got approved. I would check occasionally but not worry too much about it if it does not show up. You have your NOA1 and your bio letter, so you are in their system.

I'm using the number from the Bio letter. I will continue to check it occasionally. Thanks HK12

Hey guys! I have a question. I did my Bio on 8/31 and since then I've been trying to add my receipt # online but keep getting the error message "My Case Status does not recognize the receipt number entered" I know I entered

the correct number but keep getting the same error. Is this normal for the case #'s to take this long in

getting updated online or do I need to call them because there may be an issue with my case.

Hello everyone. It's been a while since I've replied with an update which I do apologize for taking so long. I was very naive to the whole process and spent a lot of time researching and speaking with a couple of attorneys regarding my case. During that interim, I've received additional information and instructions from one of the attorney's which turn out to be incorrect but I've pretty much got everything straighten out now and waiting for my interview at the end of the month.

Just to be clear, the earlier posts where I thought I've claimed to be a USC on a few forms was incorrect. I'm not sure why I thought I may have made any claim but I've confirmed that this was not the case. For e.g.. The documents that I used to obtain my DL was my SSN, State ID and international DL so there was no way for me to make such a claim. I was able to locate the original documents from the DMV which substantiate this. My I-9 form was the old version as was checked as US national and not USC which from my understanding doesn't go against you. Nothing either with my mortgage especially since I've recently done a refi and making sure it was not checked as a USC. I've also received a jury duty letter back in July which I opt out by stating that I'm not a USC so this shouldn't be an issue for me.

We prepared our AOS package ourselves to save some money and then had an attorney reviewed it during our consultation. He suggested a few changes which also included an omission that we didn't do due to incorrect information we gave him. We did decided to have the attorney accompany us to the interview just in case. I've heard crazy stories of what can happen when an attorney is not present. We've submitted our case back in June and so far everything has pretty much been smooth without any RFE's or delays. We are now just waiting for the interview at the end of the month (keeping fingers crossed) which I thought would have been adjudicated last month due to wrong information again. smh...

Anyway, I want to thank you all for your help with my case. Your contribution regardless of how big or small is greatly appreciated. I will give an update on the outcome. God bless!

The false claim to citizenship is a big problem - almost the biggest problem you can have in immigration - and you need not just an attorney but a *good* immigration attorney who is experienced in that particular issue. And you must stop doing it immediately, never ever claim to be a US citizen until you are one.

Thank you hmh33. As I stated earlier in my post, I made a lot of stupid mistakes from the beginning and just trying to clean things up.

I think all your questions have been answered, but I just wanted to check - have you ever claimed to be a USC? That is the only possible issue I see with your application. If not, follow the guide for AOS with both spouses in the US, and good luck!

In 1995, I've claimed myself as a USC when applying for my DL. I've also got called for Jury Duty which I've never served due to health issue. The most recent one was earlier this year which I was able to get excused permanently. For the most part, any document or application such as financial recored that that ask this question was notated as a USC. Will this be a problem and if so, how should I handle it?

A lot of my questions have been answered and I'm now more convinced that I will need to consult an attorney to represent me based on a lot of the information I've received from you guys.

Yes, your wife should file an I-130 for you. Since you are the immediate relative of a U.S. citizen, the I-130 and I-485 should be filed together, so there is no additional wait to filing this way.

So basically, I can't fast forward the process by using my already approved i-130 petition (2007) and just file my i-485 and the rest of my documents through my wife.

If she changed her name as part of the marriage, then that is her current legal name, and she should use that on all forms, but also include the marriage certificate as proof of the name change.

The marriage licensee didn't give us the option to change the name and thought that there was a different process for that however, we are trying to change her name on all her documnets (Driver License, SS card, passport and financial account before we file any paperwork

My SSN was not issued using any process via petition. Should i put it on any of the documents I file whenver it ask's if I have one?

Is good both live in one house or used one address for filing, because they can come to your house any time to check on you guys if they suspect anything.

We will end up living together soon but wanted to start the filing process now so think I should just use my address. We lived together at the same address 2 years ago

I think this little advice i can give you, you can get a lawyer to help you out and that will let you rest without thinking about anything
