  1. Why are you guys paying? getting a U.S. phone number is free and it only takes a few minutes to get one. My wife have a U.S. phone number on her cellphone in the Philippines. We call each other unlimited 24/7. She can call/received from/to any U.S. number for free/unlimited,

We still use vonage because you can have two cellphones with vonage, one is linked to her phone in the Philippines, she don't ever need to buy a load to call anyone in the world.

  2. Hmm, yes I am sure that is totally correct, interpretation here is a whole different story. Let me guess you are legally trained and are now bringing your sweetie over, Abogado and Mizzy? Have you tried to expedite or were you out of the influence of the never ending disasters that hit the RP.

    Too late to translate...

We are at NVC stage still waiting for a case number. No expedite it would be nice though, but the ones that are affected by the calamity deserve it. I'll be seeing her in a couple of weeks though, for our 1st wedding anniversary.

Yup too late to translate but we are on a public forum just trying to help others. Remember these when doing a prenup:

    - Getting married outside the US.

    - Using different lawyers (one for prenup then another one for divorce).

    - Marrying someone that have English as second language, - she might understand you, she might understand what shes reading but she does not know anything about US law.

    - Lawyer from another country - just like a driver's license, they are only good on countries that allows them.

    - Prenup is good for both divorce and death. Even if you have a will, you can not use it to overide a prenup.

Take care of your love ones, you can't take your money in heaven.

  3. Prenup does not need to be translated and is in the actual agreement since she understands English and agreed, her laywer made sure she understood everything in English and native language.

Like you said CYA, make sure you comletely cover the hole. Her lawyer will not be her lawyer when she moves to the US. Her lawyer (that will not be around if divorce happens) and you assume the she understands English.

This has been used in the past:

The agreement was coerced, signed under duress or signed without mental capacity.

She claimed that language barriers prevented her from understanding the full weight and importance of the agreement.

Again CYA. A properly translated prenup can help.

  4. It is all stated in the Pre-nup. The affadavit of support is for the first three years or until she departs the USA, that is non negotiable.

I would advise all who get married to have a pre-nup drawn up by an attorney and that when your spouse enters the country to have an appraisal of any properties you hold. Any appreciation of property in most states I assume is split 50-50. CYA

Affidavit of support - Usually lasts until the family member or other individual either becomes a U.S. citizen, or can be credited with 40 quarters of work (usually 10 years).

Both appraisal and prenup needs to be done before marriage.

  5. Something else to consider is under Philippine law for those that marry in the Philippines (as I understand it) that all properties and assets are from that day forward a 50-50 deal, in case of separation or anullment. Say you bring your spouse to the USA after marrying then decide to move back to the Philippines, see a potential issue here? Most of us guys I think already are protected in the states as in pensions, SS or other pre-earned assets. Any Capital gains or appreciation is fair game and should be split 50-50 with your spouse.

Yes married in the Philippines is 50-50 split. What about lawyer does she have her own? Is the prenup translated to her native language?

  6. My wife is setup on xoom.com for 2x a month transfer. She also have one of my BOA atm/debit/visa card. And a mastercard with $2500 limit that have her name because she's an authorized user.

Most US credit card company will let you add name without SSN as long as you tell them that she have the same address as you.

She can also access my online account so she can move money around, she's actually the one who pays all our bill via billpay.

  7. Where did you get this update? You called them or received an email? On the approval notice it says "we have sent the original visa petition to the Department of State National Visa Center (NVC)."

    Does yours say that too?

    The approval say that.

But I got the update by asking for a referral. They will give you a referral id with this format "WKD0123456789TSC". And since the case is already approved ask them to expedite, they will either email or send you a letter to let you know what exactly is going on with the case.

  8. We received RFE hard copy.

They ask for translations of mine birth certificate and marriage certificate.

Initially we gave them international certificates provided from Macedonian Ministry of Internal Affairs.

My husband already send them e-mail how to understand them, and now he's preparing the translation to send them by post mail.

It's ok, we will gave them, maybe it's confusing because on the certificates, there is a sentence about some convention and the same sentence it's written on 10 languages.

I think someone from march fillers had it same think with translations.

Who is doing the translation for you? Can you request an english copy from your country?

  9. Our lawyer called and he got the mail of our RFE, maybe my husband will get it later bec he isn't home yet. He said that they are requesting for my divorce decree but i gave it to them already. Meaning they ddn't translated it (bec it is in Thai). Anyways our lawyer said it would take 2 days for it to be translated. Wish we can get our approval. Do you think would be better if he also add my husband's travel itenerary to Bangkok? He has traveled 5 times already in one year. Thanks for your reply. Have a great day/evening. smile.png

You have a lawyer, did he not know that everything needs to be in english? I thought the reason for a lawyer is to make sure that it's done right the first time.

  10. We got married on the 1st of the month, I left the country on the 3rd. We have never seen each other since. We have tons of pictures from the wedding though (over 800) and a really expensive church/hotel beach resort wedding. We got approved

As far ad evidence. Facebook chat logs, skype log, vonage call log, phone bills, remittnce receipt, wedding and reception bills, pictures different dates
