  1. probably I'm the only one haven't got approved on the spot ...

    the officer is a nice and young lady, she asked regular questions such as when and where did we meet and my visa status changes (B2->F1->L1), no chanlleging questions at all. Everything looked ok and she said from her point of view, the document looked fine. But in the end, she gave us a further review notice and asked us to wait for about 30 days...

    Hope I can get the approval soon :-)

    The interview letter says in case of emergency or medical conditions, you can call to reschedule the interview. I personally think your case could justify postponing it but always safer to consult a lawyer or someone who has done it.

    Btw, thank you guys for your advice to me.. I'm loving it here.. you guys feel like family in this very special time throughout this somewhat unique process.. it's amazing how people originating from all different home countries can feel so close..

    good luck on your interview! Per my attorney's suggestion, we'd better provide joint rental lease/property/car, utility bills with names of both party, pictures of wedding ceremony with families and friends etc. I'm a bit worried on the supporting document as well, because we don't have all the materials attorney mentioned. We don't have a formal wedding (we even paid 10 bucks in the chapel for a witness, lol), and we used my hubby's SSN to sign up all the utils and auto loan since I didn't have one at the time and felt unnecessary to change the name later on. I'm still positive on the interview although we don't have these "official/best" evidence. IOs are human, they should be able to determine if a relationship is real or not

    no, but i'm a bit worried about affidavit of support because we only provided 2 years tax return, i don't know if this will be the problem, do we need to find a joint sponsor

    About the RFE, it means that all the documents that they looked at look good. However, I have heard people here at VJ say that you could get a RFE at any point of the process, even on your interview day! ohmy.png

  4. I am still waiting too. Hopefully they are working on it and just don't have the time to update the system. :-)

    We've been married for 4 years so it shouldn't be too tricky to adjudicate.

    thanks, we've married for about 2.5 years and my company attorney said uscis could waive the interview if they think the relationship is solid. Hopefully we could be lucky enough to skip to the end of process - card production. lol, finger crossed

  5. I understand your frustration, i've suffered from it too. But, it doesn't mean that grant EAD and AP to AOS ppl not your wife is unfair. They pay high tuition fee or work hard to get a sponsor job in order to stay close to their family, they deserve something compared to the ppl like your wife, just stay in their home country. Why can't she join you on a F1 visa or ask the company for a transfer to the US branch? Think the other way, if NO AOS available inside US, what's the difference to these ppl? The only thing i can think of is paying a flight ticket to go back to home country for an interview. During the waiting/processing time, they still hold their valid visa to stay with the family which you care the most, and also which you and your wife haven't worked hard to solve.

    Did people who came here on F1 and H1 come here with immigration intent or with temporary intent? Don't both H1 and F1 categories explicitly because they are temporary visas permit them to bring their spouses and children with them? You conveniently ignore these facts don't you.

    I have nothing personal against any group - I have family and friends who benefited from them - so why would I be against it. I'm just trying to make everyone's life better but you guys are hell bent on making others lives worse if not the same way it is and just calling them bitter won't do the trick i'm afraid.

  6. What's the point of splitting the two? It's a no pain no gain game. Anyone who can AOS inside US is either on a F1 student visa of H1/L1 working visa which means either way, they need to pay the expensive tuition fee or find a company that is willing to sponsor the visa. If you want to save your money staying at your home country or not be able to find a sponsor job, then it's your own choice and problem. It's absolutely fair for the hard work they have done inside US

    Did you contact USCIS after you got this mail? To let them know to get the case back.

    Or is the AOS package sufficient to make them understand?

    Important Notes:

    please contact the NVC before making any payments or taking further action.
    That's the original instruction in the pdf they sent to me. But i guess, it shouldn't matter too much if you already file the AOS, maybe it's worthwhile to shoot them a quick makeup email indicating that you already sent out the AOS, it wont hurt at all. Just my 2 cents
  8. I received the same email from NVC last month, in the doc they've attached, it said that please notify NVC if you are going to AOS in US. So I sent them all the required info to stop NVC processing and right before I sent out my AOS package, they replied me that they will keep my petition until USCIS notifies them. I've copied the email from NVC for your reference.

    We received notification of the principal applicant's intent to adjust
    to permanent resident status in the United States with the Department of
    Homeland Security's Office of U.S. Citizenship and Immigration Services
    (USCIS). We will hold the petition at the NVC until we are notified by
    USCIS to return the petition to them. Please contact USCIS at
    1-800-375-5283, or visit www.uscis.gov for further information.

    As the principal applicant will adjust to permanent resident status in
    the United States with the Department of Homeland Security's Office of
    U.S. Citizenship and Immigration Services (USCIS), all previous forms,
    documents, or fees requested by the NVC should be disregarded. Please
    do not proceed to pay any fees if you are in receipt of a fee bill from
    the NVC.

  9. Your husband's PD must be current before he can file an I-485 to adjust. He must also be in the US legally on the day he files.

    He must return to China if he cannot legally stay in the US until his PD becomes current.

    (PDs becomes current in the 1st of the month. It's not effective on the date released.)

    Hi aaron, do you know whether we can file i-485 when PD becomes current but case hasn't been approved? Given the beneficiary is holding the legal status in US when PD is current. Thanks

  10. hi, i'm on the same boat as your hubby that i'm currently working in the US and my PD is Nov 2011. Do you have your case approved? Mine hasn't, so I don't know if I'm eligible to adjust the status inside US by sending I-485. The VB says that the F2A might become current in the coming months, i'm worried that i might miss the huge leakage this time because of the incomplete case status. In your case, you(LPR) are always the primary fanaicial sponsor, and your hubby could be the secondary if he files the tax return with you jointly. That's what my understanding
