  1. Thank you VJ member who commented and advised me so far ! I just want to thank you and give some review of my experience.

    I Arrived at the Embassy 7:30 but the interview began at 11:00 ( I am the last one )

    Consular Officer asked me below questions:

    How did u met each other ?

    How long u have been in relationship ?

    Do you love your fiancée ?

    What does your fiancée's name ? And nickname?

    What does he do ?

    Where does he live?

    When did you decide to have an engagement ?

    Did you have any engagement party ?

    How did you continue your relationship ? Cuz this is quite long ! (p.s we are in relationship for almost 8 years )

    Did you or your fiancée get marry before?

    Did you or your fiancée have any children ?

    Would you like to work in U.S if possible ?

    What is you plan if visa granted ?

    That's it ! And everything went very well within 7 mins only.

    And consular officer liked our invitation card alot ! He asked me where did I made it ? Can I take take a picture of it etc.. ? He said he want to make his own invitation card same as mine :)

    Then a consular officer wrote me the date and time to pick up my visa ! And he blessed us to have a happy & wonderful life in America together !

  2. That is not enough. When using assets (savings etc) you need x3 the income short fall, so you;d need close to $15'000.

    Well, My fiancee get $13.70 per hour x 40 hours per week x 52 weeks per year = $28,496.

    125% of poverty guideline ( household size 4 ) is $29,438 - $28,496 = $942 , we have saving bank and other value stated in I-134 form - ( number 7 ) around $7000, Is this sound enough for consular officer ? ** $942 should x3 or x5 ?

  3. First you need to know that every Embassy is different when it comes to accepting a Co-Sponsor for the purpose of K1 visa (fiancé) and CR1 (spousal). US Embassy in Laos, Vientiane, does not accept a Co-Sponsor for K1 but will accept Co-sponsor for CR1. (I know because I’ve asked personally by e-mail) So you can forget about a Co-Sponsor for the purpose of the I-134 Affidavit of Support.

    Don’t worry yet. You mentioned that for year 2013, 125% of poverty level for a household of 4 people is $29,438. That would be you, your fiancé, his father, and his brother per your previous posting. You mentioned that your husband makes $13.70 per hour x 40 hours per week x 52 weeks per year = $28,496. So if you do the math $29,438 - $28,496 = $942 the income your fiancé is short. You can show 5 times the amount in cash savings or asset for the amount you are short by income. So $942 x 5 = $4710. Your Fiance has $7K in savings. That should be sufficient to cover the income GAP.

    You mentioned that his 2012 tax return is $39K, the CO will want to see that tax return, no need for 2011 and 2010 tax return. However you will need a letter of employment showing your fiancé has full employment with salary and is in good standing and you will need paycheck stubs.

    Also, because your fiance’s father and brother are part of the household their income if any can also be counted in the affidavit of support as household income. One Petitioner that I know of was short on income and was able to use her mother and father’s social security income as household income. They had to prove that by home address. So your fiancé can use his father’s income and his brother’s income as well if they have income and there is a GAP in income.

    Based on what you've shared, it sounds like your fiance has plenty of income to show so I wouldn't worry about it.

    Thanks for your reply, I am appreciated, yes, you're right we have not meet the income requirement around 4710 USD, therefore in our I-134 form stated the amount of saving 7000 USD, so there is no problem right ? If this really can help ! I can smile now !

  4. You need $3000 (or however much is lacking) x 3 = $9000 in assets. The website below defines eligible assets as those that can be easily liquidated to cash without considerable hardship or financial loss to the owner/family members within one year can be used. I should think 401Ks could be eligible if your fiance is able to cash his out?

    Not sure the same could be said for life insurance though...might involve some considerable hardship to the insured person if this were to be liquidated. tongue.png

    Thanks for your comment ! Yes, My fiancee can withdraw the money from 401K ! but I did search and found some sites mentioned the asset amount must equal 5 times ? Do you have any idea about this ?

    I will have the interview next two weeks ! and now worrying about my financial support ! My fiancee (U.S petitioner) is a head of household ( 4 person included me ).

    125% of poverty guide line is 29,438$ and his hourly paid is 13.70$ , He has 401K as an asset 10.000$ , Bank statement + other value which stated in I-134 around 7000$ and his father's life insurance ( 100,000$ ) which he is beneficiary. I do understand that the U.S Embassy tend to see current income but in our case the income is not enough 3000$ . Do you know if all above can help?

    Can anyone who had experiences to calculate for me ? Thank you very much for your comments!

    I just got the interview appointment letter from U.S Embassy in Vientiane, and need some advise about I-134. I know some one posted before but I am not sure about this year, 2013. Here are some of my questions:


    1. As the Interview will happen this year 2013, So we need Form 1040 & W2 of year 2010, 2011 , 2012 right ? or 2013 need to submitted as well?


    2. My fiance is a head of household - Qualifying his father and brother. So What is the household size ? 4 person or 3 person ? if included me ! I am not sure how to count !


    3. In his 1040 forms show the total income of amount 27.000$+ in 2010 , 39.000$+ in 2011 & 2012. Is this will be fine for the visa issue?

  7. My case recently approved on 10 Jun. we called to check our assigned number on 16 June, and the tier informed us not yet receive and need to call again after 4 July. Until today they sent this email to me:

    " The NVC completed its processing

    of this visa petition, and forwarded it to the U.S. Embassy or Consulate

    in VIENTIANE LAOS.

    You must resubmit your inquiry or request, and all future correspondence

    to the U.S. Embassy or Consulate in VIENTIANE because this petition is

    no longer located at the NVC. Also, please be sure to notify the U.S.

    Embassy or Consulate of any change of address, e-mail address or

    personal situation that may affect the applicant's eligibility for an

    immigrant visa. "

    My fiancée didn't receive any letter or any email from them. No requirement to pay any fee. Not yet prepare the financial documentary. What this mean ?? Please advise about what should my fiancée should do?

    This is strange ! No inform letter but already forward to the embassy ! And I don't know what date !

    I am wondering about the Evidence support when we have the interview at the embassy !


    Will the consular officer ask about any documents or any procurement about the maintained relationship since 2005 ? It's our 8 years ! In this care, Should I prepare emails of each year for them ? or They don't even need it ?


    P.S I have official Engagement Certificate in English version.

  9. I didn't dislike the Laos Law ! I have to thank you the Laos Law instead because this can help me and my fiancée to get marry soon in US.. We are now counting to our 8 years of love !

    This post just wat to show 2 things , one my poor to her and second is about my wondering about law ! If the law can protect people in this kind of suituation, I am happy with them !

    I Just really pity her ! As she is young and not brave enough to face her friends and family and I also did not support her to marry another guy too ! My phrase is a bit interrupted and misspell - sorry for that to all commentator

A young Laotian woman cried, telling me that she was engaged in Laos to a US citizen who promised to love her forever, petitioned for her to come to the US as his fiancée, and promised to marry her as soon as she arrived in the US. They had a Laotian engagement ceremony in front of everyone in her village but could not get married because Laos law prohibits foreign men to marry Laotian women. A man was the first she ever loved, when she arrived in the US many months later, A man would not even take her call and told his friend to tell her that he had found someone else. So she has returned home immediately !!! and can not marry another man to obtain her stay by K1 Visa

    If this is the true purpose, why does the Laos law allow engagement? What did the drafters of the Laos law expect that the couple would do after becoming engaged?

    I know many countries allow to have wedding and apply for K3 Visa ! So this can not guarantee for K1 visa if THE LOVE IS NO LONGER FOREVER

My fiancee called the NVC this morning and hold up the call for 15 minutes, the NVC officer ( Lady ) was answer and ask for our WAC#******, We recently approved on 10 June. and she said NVC still dint get our case yet and any cases approved during June should call after 4th July ! or take longer than 15 - 20 business day ! That's a month !! mad.gif

    I am wondering if they use the turtle for shipment or what they are doing ?
