  1. 1st hand experience:

    • I arrived in NY, USA in 2006 on a L1-B visa(intracompany transfer).
    • In 2008, my company decided to file for my PR. The company lawyers decided to change my L1-"B" category to L1-"A" in order to file under EB-2 category.
    • The PR was filed in sometime early 2008 and I got the PR in Oct 2008
    • Come August 2013, I applied for Citizenship based on 5 year rule and now I am a US citizen since Dec 2013.

    So I guess, it depends on the company if and when they agree to file for PR. Just to clarify, L1-"A" category applies to people in managerial positions. So "B" to "A" is not a default option.

  2. Interview experience - My wife and I went for the 2pm appointment for AOS interview on Sep 18th at Long Island City, NY USCIS office. Surprisingly the waiting room was sparsely populated however we had to wait for an hour before we were called in for the interview. Officer Bodi, a young lady, was our ISO. She was very amiable and friendly. We took the oath before sitting and she asked us to provide all the documentary evidence we have to justify our marriage. I had tonnes of documents, more than needed to prove the requirement however I was still unsure about the I-693. Surprsingly, neither I-693 or I-864 was asked for, at all! She asked to provide the latest tax returns, joint asset statements(bank a/c, investment a/c, phone bills, medical insurance cards, life insurance stmt), marriage certificate, birth certificates, my naturalization certificate, passports and ID's. Questions asked were:
    - Where did we first meet?
    - Who proposed?
    - Where did we get married?
    - How big was the wedding and number of people who attended?
    - What was our family's reaction when we asked their permission?(We had an Indian wedding, so its more or less necessary to have families involved to arrange the wedding)
    - What if your families were not ready for this marriage, what would you have done? (We said that our families are pretty open minded and were always in agreement of life choices we both will make, so it was fairly easy to talk to them)

    Then she asked for look at the photographs and kept 2 for records. She had some nice things to say about how colorful Indian weddings are, and boy are they!!
    The interview lasted for less than 15 mins and she asked us to keep all the spread out paper work back and very unassumingly she said - "So you will receive your green card in mail in the next 30 days". What a sigh of relief!
    There was a lot of small talk which happened disussing wedding traditions in India and my wife also commented on how beautiful her dress was. Couldn't have asked for a better ISO and a better day.
    Today the online status shows that the card is in production.

    Thankyou for your suggestions and messages. Takeway from the whole process - Be patient and it nevers hurts to over prepare in terms of documents. You just dont want to be missing that one document which is needed.

  3. Thanks Guys. Well I have gathered a lot of documents to validate our marriage! Just checked my account details and I see that the payment made to the doctor for medical services was on September 20th, 2013. So I guess, I can claim that the medical is still valid by 2 days. If this explanation doesn't work, I wont have any choice than to get a new medical report.

  4. Do you have his letter in your hand? Why are you so sure?

    OP: When did you submit your AOS? FYI, I-693 is valid only one year, if it is more than one year, sorry but you need to do another I-693. About I-864, which tax year did you provide with it? If it is not current 2013 then you need to redo an I-864 reflecting your most tax return income, which is 2013. If the supporting tax is current, just bring your copy of I-864 and your w2s, paychecks... Good luck.

    Thanks NancyNguyen. I understand the point about filling I 864 with new tax returns. However, I submitted the the AOS application on September 24, 2013. The medical report was issued a day or 2 before that. Since the interview is on September 18th, 2014, can I assume the the already submitted I693 hold good? Or, to be on a safer side, should I book an appointment with local civil surgeon? Not sure if they can get me a medical report within a day?

    My wife's AOS interview was initially scheduled for April 2014 and because of unavoidable circumstances, we had to reschedule which was done successfully. Now her new interview date is on September 18th, 2014. We received the new interview letter along with a checklist of documents required to be presented during interview. Along with the host of documents( which we have already collected), the checklist states to bring:

    1) Affidavit of Support(I864)

    2) Medical Examination (I693).

    I am a bit confused as these 2 documents were submitted with the original package. Do I need to prepare a new I864 and bring it with me? My salary is above with the published poverty guidelines. Also the sealed medical examination was also submitted.

    Please suggest if this is a standard template used by USCIS. FYI - The new interview letter does not state " ....if not already submitted"!

    Please help

  6. Hi,I received Green Card interview letter today and the date is March 9th 2014. However I have a preplanned trip to china during that period. I called USCIS and they gave me a service request number and said that within 30 days a decision will be made for rescheduling of interview. I went to local USCIS office just to have a peace of mind. The window where they issue the ticket the officer told me that If i do not appear for interview I will abandon my application as it clearly states on the interview letter that "Failure to appear for this interview and/or failure to bring the below listed items will result in denial" also at the bottom it says underline "You must appear for this interview". I asked the officer if I could talk to someone. He gave me a ticket number and I talked to a different agent. The agent told me to send a certified letter and not to worry. However he said that he cannot guarantee that my interview will be reschedule. I cannot change my itineary as i have paid for my whole family to visit china and If i cancel I will loose 7k. I am looking for advise on what needs to be done. Also in the letter what should i mention. Thanks

  7. Hi,

    I filed I-130, I-485 with AP+EAD for my spouse(who is living with me in the US) in September of 2013 while I was a LPR. This was the time with F2A category was current and concurrent filing was allowed. She received her EAD and AP in December. In the meantime, I became a US citizen in December and got my US passport. Now I want to understand how should I go about upgrading the petition from F2A category to IR. Tried calling the USCIS number, spoke to a representative who tried to do something over the phone, then transferred me to tier-2 officer. I was on hold for more than 2 hours with no answer. Points to note:

    I-130 is pending approval

    I-485 is in line for interview scheduling since December

    So in a nutshell, what am I supposed to do to upgrade the petition and hopefully move the case forward so that she gets her GC faster. We are planning to travel overseas in the month of April and even though she has an AP, which I assume, will be good enough to travel, the mental peace of travelling with GC is unparalleld.

  8. Finally done with oath ceremony. It was a tedious affair lasting more than 4 hours, but all's well that ends well! Around 190 people took the oath. No cell phones, cameras allowed at Cadman Plaza Brooklyn.

  9. Hi Fellow NewYorkers,

    My oath ceremony is scheduled on December 10th at Cadman Plaza Brooklyn at 8.30AM. Was wondering if it makes sense to ask my wife to tag along. I have heard that the total time spent may vary between 4 to 5 hours and friends/family may not even be able to watch the ceremony(sometimes they watch on TV in the cafeteria). Also, I understand, cell phones are taken away at security. Will both our cellphones be taken or only the applicant's(mine)? Also, if I take a SLR camera(want to take some good pictures), is it allowed?

  11. Hi All,

    Had my interview today at Long Island City, NY USCIS office and as per the interviewing officer, I did good smile.png Well passed the interview and got the oath letter at the same time. Oath is scheduled for December 10th. Here is my experience.

    Interview was scheduled for 1.50PM and the USCIS office is 2 blocks away from where I work, so an off day was not needed and I have a great boss, who was kind enough to allow me to take as much time as I wanted without taking a day off.

    • Reached USCIS office at around 1.20 and was straightaway asked to go into adjacent room to have my fingerprints and photo taken. It wasn't crowded. Around 20 to 25 people either waiting for fingerprinting or waiting for their names to be called to go to a different waiting room for interview
    • Completed the biometrics and around 2 was escorted to the main waiting room on 2nd floor which was flooded with people. Rough estimate around 80-90 people were waiting for interview. I was asked to wait for my name to be called.
    • This was the hard part, waiting......... for almost 50 minutes. At around 2.50, the IO. Mr. Johnson, called out my name and I was asked to follow him.
    • Once in his office, a nice big office, I was asked to raise my right hand and take the oath.
    • He went over the N400 application form, asked SSN, DOB, Address etc and the usual yes-no questions.
    • I had a ticket from years ago, which I had disclosed on the application. He asked if it indeed was a ticket and made a note on the form. To be on a safer side, I had a clearance certificate from MTA Transit Adjudication Bureau which I handed over
    • I was asked to read "What day is the flag Day" and write "Flag day is in June"
    • Now the civics/history test:
    • I can only recollect 5 questions - 1) Pledge of Allegiance 2) Who vetoes bill 3) Capital of NY 4) Supreme law of land 5) what is an amendment 6) ?. Got all 6 right.
    • He smiled for the 1st time and said I did good.
    • Was asked to wait in the room while he gets the oath letter printed.

    Was handed the oath letter at around 3.50 and the ceremony is on December 10th at 8.30 in the morning. Glad that this journey is over. Will definitely come back to share the ceremony.

  13. I sent a cover letter stating that we have applied concurrent for Preference classification F2A Spouse of LPR. Petitioner is an LPR. We attached copies of Green card, visa bulletin and receipt notices (i-130, 485, 131, 765).

    Thankyou so much. I read somewhere on VJ, that if you have selected Option "a" on i-485, send an amended 485 by selecting Option "h" with cover letter and documents. I also selected "a" however I will just send a cover letter with detailed explanation of the current scenario with documents. Can you also clarify if you used express mail to send the package? Not sure if we can use express mail since the address provided is a PO Box address.

However, someone was able to talk to an officer in INFOPASS and was told that the RFEs are happening because the USCIS folks are not aware of the current VISA bulletin and might be sending these RFEs because of that. Any other information on this issue ???

    If in case you see this post, can you help me understand how did you respond to the RFE? I too have received the same RFE for my spouse. Selected option "a" on i-485. Do i need to amend the i-485 by selecting "h" and resend with a cover letter with usual attachments, like visa bulletin showing PD current in the month of September, copy of my GC etc.?

    OR

    Just a cover letter informing USCIS about concurrent filing?

    Would really appreciate your help.

    I'm in a fix right now! I am a Green card holder and have concurrently filed i130,i485,i131 and i765 in September when F2A was current. The application has been accepted, checks cashed and NOA received. The status of USCIS website shows as Initial review as of September 26th. Now the issue is - my wife is on H1B right now, however her employers are giving her a hard time and she may be laid off by 25th Oct. I wanted to understand that since her AOS has been filed and application has been accepted, will she be out of status once she loses her job? As per rules, H1B folks cannot be without a job even for a day! So in a nutshell, my dilemma is - Will she be out of status if she loses her job on 25th Oct and H1B becomes invalid even though AOS is pending? We have applied for EAD as well.

  16. Send it in today.

    If the I-130 is received before the end of the month wile the F2a category is current, then your wife has a basis to adjust.

    If the I-130 is received after October 1, then her category would not be current. She would need to wait until her PD is current to be able to adjust. The good news is that she can wait in the US as long as she has legal status (h-1b).

    Thanks aaron2020 - I am still waiting for the immunization records which will be received on Monday. I will use UPS next day delivery to ensure the package is delivered by Tuesday.
