  1. Hey how is it going guys? I usually dont post I just lurk and read. I wanted to make a post because I noticed something and wanted to see if anyone could respond or help, I sent my I-212 in Jan 19, 2016. I have yet to hear anything back, the thing is also that I have been using the Case Tracker app and I was able to find a few other people from Jan who have yet to be sent a response. A total of 11(that I found) cases that are from JAN as well and they have not been touched, yet the USCIS site says NEBRASKA are now working on cases from FEB 3, 2016. I was just wondering if anyone from here was from JAN 2016 and had recieved any kind of response? Thanks!

  2. Very well then my wifes case is very complex and unfortunately she had a very difficult time understanding with the consular officer she was interviewed by, also she was deported at port of entry when she was only 16 years old but she was told by the immigration officer to sign as if she was 18 years old. She was born in 1984 and her first deportation took place in 2000. This is why I have filed a FOIA to get that information and also the information on the supposed fraud charges. I know it is very complex but I am trying to to anything I can to bring my family to the U.S. as soon as possible and if I have something to work with then I am going to try my hardest to fight or dispute anything that can be disputed. Thanks to everyone for the info, and thanks for taking your time to read my post and responding.

  3. Hey how is it going guys, well let me explain my case a bit. I am a USC and I applied for my wife and step daughter. My step daughters visa was accepted and my wifes was unfortunately denied. She was marked for a 9A2 a 9C2 and a 6c1. So they say she committed fraud, she was removed from the us at port of entry and she was EWI after being deported. So I know she has a permanent bar and I have to wait till she has been 10 years outside of the U.S. I have one question though what triggers the permanent bar? Was she permanently banned for committing fraud ? So for example if she did not get checked for the 6c1 she would just have a ten year ban, in which she would be eligible to file a waiver?

The reason I am asking these questions is because at the interview my wife says she had been interviewed by a new officer that she could barely understand and that he kept going to other consulars for information. The consular had asked her if she had a fake ID to which my wife said yes but she had never used it with a immigration officer or anything like that. Now I don't know if it is possible to dispute the officers outcome but what I want to do is file a FOIA and see if indeed she has ever been marked down for committing fraud. I previously had her deportation document and it never stated anything about fraud it just said she had a 10 year ban, unfortunately I gave that paper to a lawyer and she moved from town and I have no way to contact her. That is why I want to file a FOIA and see what it states, So please if someone can answer my question and help please.

  4. Hello all, my step daughters visa recently has been approved and it arrived today. I am going to pay the 165 fee tomorrow. Unfortunately my wifes visa was denied due to her 10 year ban, so I wanted to know what do I have to bring with me to enter the U.S. With my step daughter? We have a notarized paper signed by her biological father allowing her to live in the U.S. But it only states my wifes name and not mine. Is that an issue and what else do I need?

  5. Sorry if I misspell, am writing from a iPad. That is unfortunate, before her interview she had the ten year ban, I had the paper but when I filed the I-130 the paper was lost. She had been deported once and then deported again, the second time is when they banned her for the 10 years. She was deported in 2006. Like I said my step daughters case was accepted and we also have a 2 year old daughter that is also a USC. So we can't submit anything ?

  6. Hey how is it going guys? My name is Daniel I am a USC. I petitioned my wife and step daughter, they had tehir interview a few hoursago here in Ciudad Juarez, unfortunately my wife was denied her visa, she has a 10 year ban sine apr of 2006. She was marked for 6C1, 9A2, and 9C2. It also states she can present her I-601 and I-212 after April of 2016.

My question is can I apply for a waiver beforehand proving a form of extreme hardship? What would the process be and would she have to go to another interview? Thanks for the help!

  7. thanks for the info the thing is I am looking at the requirements at CDJ, the consulate I will have the interview at. One requirement is to have the petitioners original long form birth certificate (not abstract) and applicants birth certificate. Applicants with non-English or non-Spanish birth certificates must submit a notarized translation with the original. This is where I get confused.

  8. Hey how is it going guys? I just found out a few days ago my wifes and daughters case had been sent to CDJ the expedite process was approved and they where mailed out on july 11th. I called CDJ but they said I needed to wait for a letter to schedule an interview, does anyone know how long the letter takes to arrive, the operator told me two weeks. I also had one more question, in the CDJ website it states I need a long form birth certificate.now I have a birth certificate but I do mot know if it is the long form one it has my info where I was born and my parents info it also states the abstract form in small words at the bottom. I dont know if this is the long form can someone help please? thanks!

  9. Hey how is it going guys, I recieved my checklist today for my step daughter, I am confused on some things. For example my checklist says for example select an option in part 1 this is actually on both mine and my sisters checklist she is the join sponsor. We are sure we only checked one, also for ky checklist it says check in part 4 item 12 if I am in the military, I am sure I cheked no. So I am wondering if it is a system error.

Now where I do need a bit of help is with my taxes. I am currently unemployed, The last time I filed my taxes was in May of 2013 for the tax year of 2012. I worked up till June of 2013 and have not filed taxes since then, I am still unemployed. In the checklist it asks me to send my 2013 w2 and 2013 tax transcrips and 2013 IRS tax schedules. I am stumped here I did not send my letter stating why I did not file for taxes in 2013 is this the reason why they ask for the letter and these additional items? What should I do? Thanks a lot for the help!

  10. Hey how´s it going guys? I have been having some issues filing the AOS form due to my joint sponsors. I was going to put my brother in law but realized he did not make enough to sponsor us. So I decided to ask my sister who is a nurse, the only thing is that she recently started working about a year ago, now she files married joint, she was studiying the past two years and did not work but her husband did work but did not make as much money, on their taxes they have under 15k for 2011 and 2012. For 2013 the year my sister started working they filed for around 60k. Now she is married and has one daughter, she will be sponsoring my step daughter and my wife, now I was thinking of attaching a letter stating she had been studiying in 2011 and 2012 and adding copies of her checks for this year and also a copy of her bank statement where she has around 12k saved, also adding the w-2 form showing she is the one that made the 60k since her husband is currently unemployed. Would this be alright or would I have an issue due to low income earned in 2011 and 2012?

    Thank you for your help!

  11. Hey how is it going guys, I have a question I am currently filing the AOS, I am confused. My brother in law that will be the joint sponsor owns his business, now I ordered his tax account and where it says adjusted gross income it has a number around 14k now he says he has an accountant that files his taxes and does not know how he filed it, he does have 3 houses and around 20k in his bank account. So what do I do, is the 14k gross what I put in the gross income, I dont think it will be enough or will it be ok with the houses and the money in the bank, he is sponsoring my wife and step daughter.

  12. Hey guys hows it going? I just recieved my daughters case number from nvc, so I am getting ready to have her forms ready. I had a simple question, I am filing with a joint sponsor, now I filed my taxes last year in may 2013 but I have not worked since then. So do I file my taxes again for this year even though I had 0 income or send my tax transcript from last year? Thanks for the help!

  13. Hey howis it going guys? My PD is may 20 2013 I filed for my wife and step daughter, thankfully both cases where recently approved. I am currently waiting for the case numbers to continue forwards. I am a bit worried because i currently do not have a job I am currently in Mexico with my wife, I worked here in Mexico for six months and then went back to the U.S. About 3 weeks ago my wife became a bit ill she has diabetes so I returned when I returned I recieved the approvals for both my step daughters case and my wifes case I also recieved my daughters passport through report of birth abroad.

So I have been reading a bit about the upcoming forms and am a bit worried, I have a joint sponsor who earns very well, he is my wifes brother. The thing I am worried about is what to put myself, I have not worked in the states since last may almost a year ago, I know once I bring my family with me to the states I will be able to be stable and get a job, but when I try to work and we are apart it is a bit difficult for me, I just want to make sure this is not an issue, thanks!
