  1. I would recommend that you send them the whole AOS package, again. Why send them part of it and risk another check list because they could not match it with your previous package. Maybe this time you should also attach a letter on top (right underneath the bar-coded sheet) explaining that this is a resend. Attach the check list, too.

    Thanks. I managed to get a call in to them on Friday night before they closed and they send I need to resend everything. Like 100 pages. Such a waste of paper. Oh well.

  2. Question:

    I stupidly filed an old version of the I-184 AOS document. I have to resend it but I also have to resend the W2, Tax and Proof of Employment docs. I had also sent in a stack of forms for proving Domicile. Do I have to resend all those as well? It does not say anything about Domicile documents.

    The letter states the following:

    The sponsor or joint sponsor submitted an obsolete Affidavit of Support form. You can obtain an up-to-date version on U.S. Citizenship and Immigration Services website: http://uscis.gov/i-864

    If the sponsor or joint sponsor already submitted any of the following documents, he or she must resubmit them with the up-to-date Affidavit of Support form:

    * Form W-2, Wage and Tax Statement
    * Federal Income Tax Return or Transcript * Proof of Current or Self-Employment

  3. They accepted our NVC letter. We did not even offer it to them but just showed them what we had, and the clerk saw the NVC letter and said "This one is fine".

    We still have not seen the embassy letter, and from what i have read, half the time USEM never sends it out or sends it so late by the time you get it you are already in the US.

    Is it at USEM yet? Don't yet know.

    Which exact NVC letter are you referring to? The barcode sheet after payment of the AOS or IV or some other letter later in the process?

    And does the NVC center in the US understand that the HK police certificate gets sent to the HK consulate? do the hold up the process on their end or they send the package to the HK consulate knowing the PC will be there by the time of the interview?

  4. Question regarding Police certificate:

    My wife is from Hong Kong and they are real a-holes about the police certificate. They will not authorize one without a written letter explicitly from the US government stating that the police certificate is necessary along with my wife's name. On top of that they will not give us the certificate. They will only mail it to the consulate. (Maybe the NVC center in US but I am not sure on that.)

    All my research says the only thing I can do is send in the IV package without it and wait for the NVC to send me a letter stating it is missing. But of course this is going to delay my case by 6 weeks. I read other people's experience stating the NVC no longer offers letters to people prior. However sense the HK gov will not give it to me, how do I tell the NVC that it is going to show up at the consulate? Can I get them to arrange the interview without it the file so when the PC is sent to the HK consulate they know what to do with it?

    Anyone have this experience in HK or another gov with similar strict rules around the PC?

  5. Couple questions:

    Am I now required to submit 2013 taxes? While I have already filed and paid my taxes in March, I am not sure if the IRS has processed them yet. They said it could take 4-6 weeks because i had to do it by hand to get my wife a ITIN number. And technically because I filled with my wife, it extended my deadline to june. Asking because I already have my package ready to go. I was assigned my case number last week and the CEAC site says the termination thing meaning I should be able to pay soon and get the packages out the door.

    Second, I am confused after reading the guides, does the DS-261 (agent form) generate before or after the first bill.

  6. My wife's application was approved this morning out of the Nebraska center!!!!! We are filling from overseas.

    I called Monday, feb 11th and was told it had been assigned to an agent Friday, Feb 8th and would take around two weeks. If you call and need to get past the tier 1 agent who know nothing, tell them you want to have your case expedited. They will list a bunch of reasons. You have to give them one. The first one is the easiest, financial reasons. Does not matter if it is true or not. It is just a trick to get past the tier one agent. Then they will send you through to a tier two agent. The one I got was helpful and told me the case was assigned and would take around two weeks so no point in expedite.

  7. My case was updated from "transferred on the 12th of Dec" to the "was transferred" following sometime in the past 24 hours (I was an overseas filer from Hong Kong). Not sure it means anything but the very act of seeing things change is a nice change in itself. Odd thing is I asked for text and email updates and I am not getting them. Not sure if I should call and ask for that again or if they do not send messages for the below type of messages:

    The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

  8. Another June Filer here. Filing from abroad.

    I am living with my wife in HK. After reading through this site I expected to have my NOA2 by July because was filing from abroad. And here it is the beginning of Sept. I started to panic that I had screwed something up or that that Snowden thing was causing problems with HK filers, it caused Washington to delay allowing landing visas for HK citizens, but I get on here and read this thread and it seems to be just bad luck, bureaucracy at its finest.

    My application is at the Overland Park office if the address on the NOA1 is to be believed so hopefully I hear something this month.

    The worst part is telling my wife not to check the website everyday. No point.

  9. I have a rather specific case and wanted to see if anyone had any experience with this.

    I have been living in Hong Kong for the past four years on tourist visas. I have not once overstayed my tourist visa so I am in good standing with HK. I rented a room from a friend for 3.5 years and six months ago I personally rented an apartment for myself and now wife.

    The entire time I have never given up my residence in Florida where I lived for 4 yours before coming to HK. Upon leaving I changed my address to my parents address who are also in Florida. I have paid my taxes, maintained my bank accounts and credit cards in the USA, paid my student loans, have kept my salary based, internet job in the USA and have a current Florida drivers license. I simple live here cause my job allows me the freedom.

    From my understanding this is no different then me having a second home. My domicile is my Florida address, while my current address is in HK. So on form I-130 I was going to list our current address in HK. On the G-325a form where it asks applicants residence I was going to list my domicile in Florida. Does this make sense?

    Also it asks for intended address in USA. I do not know what it is yet. We will move to Seattle together when we return after she receives her visa. Should I simple list my Florida address and change it after we get to the USA?

Your correct that it is hard or non-existent to find, but we just got stopped at the interview for doing exactly what you propose to do (In Naples, Italy) we live abroad and filed in the US (when I was there for a few months) and then moved abroad to go through the process together. I was told by the consular office that I had to prove domicile in the US, or as she said "live and work in the US".

    What this amounted to was her saying that we needed to be seperated for the duration of our process, over 1 year. By her account, this didn't matter, and people do it all the time.

    I would take care in going about it in this way -- but as I've learned, there are exceptions, exceptions execptions everywhere. No one has exactly the same experience.

    But like you I also can't find where it says that the petitioner has to be in the US. If anyone can or knows where to find this, please let us know!

    I think I might be ok because my residence is still officially in Florida. I will be in Hong Kong as a tourist unless I decide to apply for residency in HK after the wedding. But maybe that is not a good idea.

  11. My girlfriend (a citizen of HKSAR) and I (US Citizen) are currently in Hong Kong. We have decided to marry and want to settle down in the USA and are planning to marry in the next month and start the CR-1 process. During the process I prefer to stay with her in HK until she gets approved then we move over to the USA together.

    We are currently both living in Hong Kong, her home country. I have been living in HK on tourist visas for approximately four years. I am still a legal resident of Florida as I have been using my parents address as my USA address and I also work for our family business (and internet based business) that is located and limited to the USA, I am paid in US dollars to my US bank account. Basically my work allows me to live where I wish as long as I have a good internet connection.

    My confusion is around where I need to be during the application of the CR-1. I keep reading stories of US Citizens that is sponsoring the CR-1 visa is in the USA. They imply that it is required that the US citizen needs to be in the USA during the process. Yet I can not see a single reason why nor can I find any evidence on the government information pages or other sites that explicitly states I must be in the USA for the process. I can send the application to the Chicago Dropbox. She does the interview here at the consulate.

    Am missing something?
