just wanted to give an update here.

I did not do anything as asked by the NVC last time. They rechecked our stuff last week and although we have the 2012 salary and the 2011 tax (incl. the extension letter from my husband) they approved it.

I am glad I did not listen to some of the advise here because we "screwed it up". If I had sent any forms to the NVC again to try to get all the paperwork straight it just would have postponed everything further.

How do you think it makes sense to not overnight something to them to satisfy the checkilst, but instead wait 2 weeks to check your case file?

I repeated what the NVC told me. I assumed they know better?!

NVC told me yesterday that sending something does not make sense because I might not need to send anything else. It´s going to take another 20 days till they check it just in case I do send anything.

So why should I do it?

Hallo, nur mal verständnishalber: Was machst du denn? IR1/CR1? Im Post steht etwas von AOS, aber das ist das Adjustment of Status. Das muss man nicht machen, wenn man IR1/CR1 macht. Ansonsten schick' die fehlenden Unterlagen einfach noch mal hin. Manchmal gehen Dokumente beim NVC verloren (die sind leider nicht allzu kompetent - bei uns haben sie z.B. das Geburtsdatum meines Mannes falsch in ihr System eingetippt und wir hatten dadurch einige Probleme), und auch wenn das nicht deine Schuld ist, kannst du da nicht viel machen außer ruhig zu bleiben und ihnen das zu geben, was sie verlangen.

ja, das ist das cr-1. da macht man aos gleich mit. jedenfalls mussten wir dafür unterlagen einschicken, die vom nvc angefordert wurden.

habe gestern abend nochmal angerufen dort. mir wurde von einer supervisor(in) gesagt, dass ich bloß nichts schicken soll, weil das alles nur noch weiter verzögert und unsere sachen nochmal geprüft werden?! also haben sie ja doch alles? verstehe nicht, dass wir jetzt nochmal warten müssen, dass genau das gemacht wird, was schon mal gemacht wurde... oh mann... meine geduld ist fast am ende.

die SSN wird glaube ich beim IV package "bestellt". Jedenfalls wurde da gefragt, ob man schon eine hat oder ob man noch eine braucht.

We sent it about 4 weeks ago.

I did talk with a supervisor again last night. She said we do not have to send anything else again since it will just postpone the process further. She is going to check our case again in the next 2 weeks. I asked her about the "most recent tax year" and she agreed that we are correct and that it is more important that my husbands fights for their freedom than makes taxes in time and that this is what the extension is for...

For "Most Recent Year" You put 2011?

If so, you screwed up, not them.

For "My individual annual income is currently" you put for 2012?

no we did not screw up and even nvc thinks we did not screw up. yet we have to send a letter explaining why 2011 is the most recent year, although they already have that letter. It was sent in one envelope with our other documents.

They refuse to recheck, if they have my husbands letter that explains why we only have 2011 tax information and also 2011 tax menitoned on the form. We are not able to provide 2012 tax nor do we have to due to deployment rules of the US government.

They do have everything they need...yet we have to send something that they already have from us?!

They told me (although they already have all necessary information) that they are not going to open the file back up until I send them the stuff they requested. It will take about another 3 weeks for them to recheck your case!!!!

I was wondering why they do not open up the file immidiately to check and see that they have everything but they did not care.

Es fehlen die Tax Sachen von 2012, obwohl wir extra einen offiziellen Brief hatten, dass wir nur Tax 2011 haben, weil mein Mann in Afghanistan ist und erst bis 2014 die Steuererklärung von 2012 machen muss. Das hat die Frau am Telefon zwar akzeptiert, aber trotzdem gesagt ich soll den Brief nochmal schicken. Ich: ja aber er ist doch bei allen anderen Sachen dabei. Also haben sie doch alles. Sie: egal, bitte schicken, sie kriegen in 4 Wochen Bescheid?!?!

I undestand your sentiments but I practically suggest that you give what they are asking... since you have said you don't wanna waste anymore time with this... so you must act ASAP!

Anyways, since you have submitted it already before I am sure you can provide it again in no time!

You´re right and I already put it in the mail this morning but it still delays the case about 4 weeks and we absolutely do not have time for that.

wir haben gestern ein RFE zum AOS bekommen und haben gesagt gekriegt, dass was fehlt und wir das nachschicken sollen. Die haben aber alles schon, was wir nachschicken sollen und weigern sich den Fall wieder aufzumachen bis wir das "fehlende" Zeug schicken. Dann schauen sie alles nochmal an?! Macht doch überhaupt keinen SInn und verzögert alles nochmal um einen Monat.

Mein Mann kommt bald aus Afghanistan heim, meine Tochter sollte ab August in die Schule in den Staaten und ich bin einfach nur sauer. Wenn NVC einen Fehler macht, ist das ja nicht so schlimm, aber den nicht mal zugeben und uns dann das Leben schwer machen find ich nicht so gut. Hoffentlich sind wir wenigstens zum Hochzeitstag oder meinem Geburtstag zusammen, aber wenn sich das alles so lange verzögert, dann nicht.

NVC sent us an RFE and requested to send certain documents that we have already sent. The were in the same package as the other things which were ok for them.

I do not understand it. I asked them on the phone to recheck it but they still said to send the "missing" information and than they will review it again.

What can we do??

We have expedite processing for a reason and no time to waste on this...

3 weeks ago our AOS was received by the NVC.

Yesterday they reviewed it and said that we need to send the most recent tax return (2012) and that No. 19 on the i-864EZ is wrong (we noted tax amount 2011).

We sent my husbands most recent tax return (which is 2011) because he´s been deployed for quite some time and has an extension to make his 2012 taxes till 2014.

We sent the i864ez, his deployment orders and a letter from him saying that he has an extension that is offered to deployed soldiers by the US government. There is no official letter from the government that they get reg. the extension, it´s a "rule/law".

NVC first rejected the AOS and told us to send the 2012 stuff, which is not possible. So I called and they told me that he needs to send a letter stating that he has a extension. I told them they already have that letter over there and that it was sent with all other required AOS documents. They still refuse to open the case back up. They are going to open it back up, if I send the extension letter again that they already have and once the mail gets there it´s going to take another 2 to 3 weeks for them to check it again.

We do not have so much time!!

I do not understand why they don´t help us out here? The mistake was clearly on their side. We sent everything they needed.

We have expedite processing and still nobody cares as it seems.

Does anybody have an idea what else we could do?

The checklist says that all pages have to be staples together in the correct order. I have tax forms 1040, 8880, 8879, invoice and D-400. Is that the correct order?

other than that we have the cover sheet, i-864, tax forms, pay statements. Is there anything missing?

He only has VERY lmited access to printers and a post office.

I know we meet the first 2 requirements for the ez but not sure about the third because i do not know what form w2 is?

was confused because i864 says, if none of the 3 requirement are met of 864ez?

i read that page. I know exactly what to do when the AOS is paid...you send the i864 package.

then you pay the IV fee and send the DS260 package.

but we paid AOS 88$, got a AOS cover page and this email below and we can´t pay the IV fee online because there´s no checkbox that you can select:

i don´t know. i didn´t see it. my husband did that. i assume only the 88$ one.

he definitely only paid the AOS fee. so i don´t understand how we can get a AOS cover letter + a IV case receipt?

no we do not have two bills. that´s the thing!

we have one bill (AOS), paid it, got a cover letter for it. AND got a receipt for a bill we never got for a payment we never did.
