  1. Hi everyone--

    I am preparing the AOS for my husband who is here on a K-3. A lawyer told us that he doesn't need to send in any medical information (not even the list of vaccinations that they mention in the I-485 instructions). He exlained that he doesn't need any of this since he had a medical done in Peru for his interview for the K-3. Can someone tell me if this is right?? Or do we have to get a civil surgeon to vouch for his vaccinations???

  2. Just to make sure I understand correctly, since my husband and I live in Texas, we need to send his AOS application to Chicago NOT to our local office---

    And then we might (or might not) have to do an interview at our local office before having the GC approved?? I am unclear on this since it seems like a lot of people are getting their GC approved by the CA service center without having an interview....

    Also-- any thoughts on whether or not it is worth using a lawyer for all of this?? We didn't for our K-3, but should we now?

  3. My husband has his K-3 and will be entering the US soon. As part of the I-485 application, I see that he will need a medical exam. My question is 2-fold: A) does his med exam in his homecountry for the K-3 visa interview count? B) If the answer to A is yes, then how do we get a copy of the results since as far as I know they are in the sealed envelope he has to give at POE-- any chance they give any of those documents back??

  4. Ok-- more questions! My husband got his K-3 visa on March 14th but won't be coming here until August (before the 6 month expiration). Meanwhile our i-130 was approved in Feb and is in NVC. I went ahead and paid the fee for the AOS but now we are thinking that we want to adjust his status while he is here rather than waiting for things to get to the embassy in Lima in case it is after August. I know this will take longer but it makes sense in our case. Anyway, my question is what do I need to do now -- do I contact NVC and ask them to hold onto our info and then file the I485 ?? I am confused!

  5. Hi everyone! So I went to Peru 2 weeks ago to meet up with my husband for our interview and his K-3 was approved!!! Yea!!! Very exciting. And the interview wasn't as scary as we had anticipated although they did ask sveral questions about the 2 tourist visas he had applied for (and been denied). Now I have a few questions about what to do since my husband won't be able to come until August due to work and studies. We thought about doing the I-130 interview in Peru too but are worried that there might be too much of a delay since I am still gathering info for the I-864. So if we wait to adjust his status here in the US, these are my questions which might be kind of straight-forward but I would feel better if I have some answers from all of you experts!:

    1. Can we go ahead and apply for the Employment Authorization (EAD) now or does he have to be in the country for that??

    2. How long does the EAD usually take to get approved?

    3. How long is the AOS process here in the US taking??

    4. I paid the I-864 fee already-- does that count still if we do the AOS here instead of in Peru??

  6. Hi everyone-- My father is going to cosponsor my husband's K-3 since I am currently a graduate student with very little income! Can he just fill out the I-134 or does he als have to fill out the I-864-- I ask since the I-134 doesn't have an official "co-sponsor" part but in Peru that is the only form they require for K-3s. Also, aside from that, do I need my 2005 tax return even if our interview is in March??
