  1. Hello fellow visa hopefuls!

    Me and my son has different case number because my husband is planning to upgrade our case when he became a citizen. Sadly, welcome letter caught up with us, therefore we decided to continue with f2a process. PD Feb 2016 Philippines

     

    1. Do we need to combine our (me and my son) case number?

    2. What are the consequences if we don't?

    3. Im planning to have an early medical exam using my case number alone. Because I heard that having sputum exams are common in our country and will cause more delay. I am also planning to have my son's medical exam when we become current (because it will take 1 month for his pediatrics doctor,lab results and therapist to produce his medical documents). Any thoughts?

    My son (2 years old) and I are under f2A visa process. Our PD is  Feb 2016. County: Philippines CS: California. these are my concerns please help us who can:

    1. My son has learning disability (down syndrome), and I understand that we need to undergo Medical Screening. is there a possibility that we get denied for a visa? :( 

    2. What do we need to bring during our Medical screening and Interview to help us?

    3. Do we need a Immigration Atty to aid us?

  3. Good day! Im just wondering if our u.s. visa petition will get affected when we go for medical due to our baby has DS (Down Syndrome) ? What papers do we need to give for my baby's medical examination? And lastly, will the u.s. visa consular will reduce our chances for our approval as they found out our son has DS? Please help us for those who gone through this... the visa atty fee are kinda pricie huhu... thanks in advance!

    My husband is 20 years Greencard holder. He is planning to apply for Naturalization within this year. but we have several problems though. please help us out.

    1. My husband has a criminal record for attempted robbery when he was 18 years old (his 32 now) and he was imprisoned for 2 days; and his drivers license was suspended because of illegal racing during his younger years. Is he still allowed to be Naturalized Citizen?

    2. My husband left the US last June 2013 and returned on August 2013 ( 2.5 months) because we are getting married at July 2013. Is it true that he have to wait for 3 months prior to his return to the u.s. which will be Nov 2013 before starting to apply for Naturalization?

    If your husband cannot support you financially, you are correct in assuming that you will need a joint sponsor. You only need to show this at the time of the interview, though. When does he finish college?

    Me and my Husband just got married last July 2013. My husband a green card holder is an Auto Technician College student who is receiving Financial Support from the U.S. government. He quit his job so that he can go to College to have better education and better future for our family. Can he petition me as his wife to the U.S.? Can joint affidavit of Support can help us? is being a Financial Support Beneficiary can affect our approval rate?

  7. ohh i see.. wait i have to clarify this first: ahm... his non-american passport has no visa, he only use his permanent residency card to enter united states. is that a green card? or LPR card? is there any difference? sorry i know this is a stupid question from a newbie like us... please bear with me rose.gif

    Yes, permanent residents can petition spouses. The difference between him being a permanent resident vs a citizen is that for a spouse of a citizen, visa numbers are available immediately, whereas for spouse of a permanent resident, they are not. However, the wait is not that long currently.

    Being a college student is not relevant other than him not having income. If he does not have enough income, he will need to get a joint sponsor.

    Yup. For spouse of permanent residents, there is a wait for the visa number to become current. The wait is very short now. File soon before it gets longer.

    If he doesn't have enough current income, yes, he will need to find a joint sponsor.

    Absolutely false. If you're a citizen, you can leave the U.S. for however long you want and come back at any time.

    But you're still a long way away from being a citizen. As a permanent resident, you need to maintain residency in the U.S. There starts to be questions if you leave the U.S. for more than 6 months; and you need to have a re-entry permit if you want to leave for more than a year.

    It's up to you. If you wait until you're married for 2 years, or almost married for 2 years (so that by the time it gets approved, you'll have been married for 2 years), then you will skip the whole Removal of Conditions thing. But is it really worth being separated?

    Can my Husband (Filipino Born) a LPR for 20 years Immigrant ( not yet a citizen) can petition me his wife to the U.S. even though he is still in college studying? Does Joint Affidavit of Support from his sister or mother can help?

  11. Yes, you can have his mother be the joint sponsor, if she qualifies. File the petition about 9 months before you want to actually immigrate. Whether that's before or after he becomes a US Citizen, is of little consequence. BEFORE, means he'll be sending one extra letter once he has his Naturalization Certificate.
