  1. Hi all,

    Question:

    I am going to be a joint sponsor for my niece. My sister is the main sponsor. I will use my income to assist my sister meet the poverty guidelines. However, I have filed jointly with my wife for the past 3 years but I only want to use my income. Do I only use what I made, based on W2s to separate my income from my wife, or how can I only use my income to be a joint Sponsor when I have filed taxes jointly with my wife?

    To put it in simple terms... My wife came here with a K1-Visa, got married, filled for AOS, got biometrics done, but her I-94 is expired. I understand she is ok to be here while waiting to be adjusted to GC holder, however, we are not sure how to identify her status in terms of a drivers license/ID card, etc. We were able to get a state ID card but it was a limited time card as it expired on the same date as did the I-94. My question, how do we identify her legally as she will need to be entered in the department of defense as a spouse/dependent? We also have her SSN.

    Any help is greatly appreciated.

    I have been requested to submit an affidavit of support for my parent's visa application. However, as a college student I don't make or have enough assets to be their primary AOS. I know that in order to follow through a joint sponser can help my case out. My questions are:

    How do I file the AOS jointly, the application only has a single slot for the person submitting the application?

    From the research I have been doing it looks like there should be two separate applications sent, but how will they know that one is the primary petitioner from the joint AOS.?

    Anyone have a similar case in which you needed a joint AOS to fulfill this requirement for the visa process?

  4. There's no category for disabled persons. Sorry.

    Dad can immigrate first (IR5), after he gets his green card he can file i-130 for Mom. She will be under the F2A category (Spouse of a Lawful Permanent Resident). Your sister will become a derivative of this petition. They will immigrate together. Waiting time for F2A visa is 2-3 years, which is shorter than F4.

    This is the quickest way for your sister to immigrate.

  5. Wow wait, did your parents plan on leaving her? Or what was the plan to begin with, it's not like your parents got their visas in a heartbeat, you guys must have talked about it no!

    No we did not want this to happen. I applied for all three at the same time (I-130) and they all got approved, but now only my sister has not been granted a visa. I am in the process of filling out affidavits of support, but i was waiting to hear back from NVC about my sister. So there are visas for my parents, but not for her at the moment.

  6. I am trying to immigrate my 6 year old sister who has down syndrome. My parents have been approved to obtain visas to enter the US, but there is now way that my sister can be left behind. I got a letter for the National Visa Center indicating that there are no available visas for her category F4 (siblings of citizens), and that there could be an extensive wait. My question is: do disabled siblings have a different category to be classified, and if so what is the best way to approach this situation. INS has approved the I-130 form, but NVC said there are no Visas for her at the moment ( Received the letter from NVC 03/01/2013).

    I would greatly appreciate any advise.
