  1. Some countries of origin do not allow dual citizenship. One of my kids does not want to be a U.S. citizen. However, A LPR can inherit and live in the USA as long as desired.A legal heir can inherit without a will. Please don't tell me what I am seeking. My original question was if anyone had adopted step children.

  2. 3 hours ago, Transborderwife said:

You can make them your legal heirs through a will.  Citizenship isn't necessary.  Let them get citizenship through Mom.

    From the link:

    * All adoptions for any other type of immigration benefit, including naturalization, must be completed by the child's 16th birthday, with one exception: A child adopted while under the age of 18 years by the same parents who adopted a natural sibling who met the usual requirements.

A will names beneficiaries not legal heirs. A will can be contested. No need for a will if you have heirs. I am not seeking a naturalization benefit.

  3. My two step children have been legal permanent residents for 2.5 years. I am interested in adopting them. Adoption would give them legal rights as my heirs to any estate. Also make them U.S. citizens. Their ages are 16 and 17. Their biological father is dead. Has anyone gone this route?

  4. I feel fortunate. I walked into the USCIS field office in Bangkok June 19th, filled 3 I-130's for my family. August 20th our IR-1& IR-2 visas were issued. Visas in hand August 23. Not to suggest those two months were not filled with anxiety and stress. Relative to what I read on this forum we are very fortunate. Bought plane tickets today we fly out September 10

Best of luck to all of those still in process. And thanks to those of you that supported me and clarified my misunderstandings with consular section.

  5. I just checked the visa update site. It has changed to issued. Stating visas have been printed and will be mailed or picked up depending on our prior instructions.

I have no idea how Armenia got in there. I will try to correct that. I filled DCF(USCIS) next door to the embassy in Bangkok.

Thanks for your support. Best of luck with your visa being issued.

  6. We supplied the requested documents Aug 4th. Since then we have been in administrative processing with up dates on the 13th, 15th 18th on the 19th the visa status update changed to ready. Today the 20th the updated changed back to admin. process. This seems to happen with some frequency to VJ members. We are in Thailand if that makes a difference. The paperwork for the 221-g was for our daughters medical also further domicile proof. Any ideas on what to expect next?

  7. First of all we had a 3 day notice of our impending interview in Bangkok. Made an appointment at bumrungrad for the next day. Since our daughters are of an age that require a TB test, their were results were not ready for the interview. As the test results take 48 hours to read. That was not a problem. The problem seems to stem from my 10 year absence from America. My sister has graciously offered to let us stay with her indefinitely to work on 30 acre ranch. Rent free in lieu of labor.

I supplied several months of correspondence with the local school regarding enrollment my local bank account and current credit report, also my wife has a job being held for her in a local Thai restaurant. In the 221g they asked about me owning a car and car insurance as well as health insurance for my family. I cannot find a company that will issue insurance without a SS#. Also showing job applications The irony is I am old enough to collect Social Security. Which I pointed out. Also my current income far surpasses the minimum requirements.

My question to other members is would it behove me to establish domicile before my family? Which does not address health insurance for my family.

In response to the 221g I added several out of state bank and credit card accounts along with my wife's job offer. Along with our daughters medical results. And another letter from my sister re-stating her desire for us to live with her.

I am open to suggestion on what else to provide. Or move back to help expedite my families visas.

On a bright note the embassy requested their passports be included in the 221 g package.

  8. I had a rather simple question regarding packet # 3

Here is a quote from your consular website "Many U.S. citizens and lawful permanent residents reside outside the United States on a temporary basis. "Temporary" may cover an extended period of residence abroad. The sponsor living abroad must establish the following in order to be considered domiciled in the United States:

He/she left the United States for a limited and not indefinite period of time,
He/she intended to maintain a domicile in the United States, and
He/she has evidence of continued ties to the United States."
Here is more from your Bible
" When a sponsor has clearly not maintained a domicile in the United States, he/she must re-establish a U.S. domicile to be a sponsor. The aspiring sponsor may take steps, including the examples given below, to show that the United States is his/her principal place of residence
Find employment in the United States
Secure a residence in the United States
    Register children in U.S. schools
    Relinquish residence abroad
Other evidence of a U.S. residence
If the sponsor establishes U.S. domicile, it is not necessary for the sponsor to go to the United States before the sponsored family members. However, the sponsor must return to the United States to live before the sponsored immigrant may enter the United States. The sponsored immigrant must enter the United States with or after the sponsor."
  9. I have ties. Numerous, such as USA income, credit cards, credit union and bank accounts and have started enrolling my kids in school. I don't think you understand the gist of my question. Living outside the USA does not automatically break ties. This is about domicile. I have an address

Thanks for the kind thoughts though.

  10. I did not see anywhere that stipulated including documentation for re-establishing a US domicile. However I don't see how it could be problematic.

Since we filed via DCF things get a bit convoluted.

Have any members been there and done that??

The paperwork for packet 3 gets mailed tomorrow AM.

  11. If you are up to date on all the above vaccinations. With the medical records to back it up. Who cares when thy were administered. The list of hospitals accredited to perform the medical evaluation certainly can understand a vaccination history. It is a great added cost for the hospitals to charge you an exorbitant fee. Many people travel for reasons aside from visa required inoculations . It should not be difficult to locate a clinic in Bangkok that is recognized and specializes in travel vaccinations.

  12. Actually we may have a problem. On the I-130 we gave my wifes birthplace as Nakhon Sawan. Yesterday we received the official birth certificate, giving her official birth place as Petchabun. She had always been under the impression that she was born in Nakhon Sawan. Because it was the place of her family farm. The only place she resided.

There was never any discussion of the flooding that was taking place in Nakhon Sawan. Hence the need to travel to Petchabun. Do you have any idea how forgiving the embassy is on an honest mistake based on an assumption.

Needles to say their have been some heated discussions (arguments) between my Mother in Law and my wife. Anyone with a similar experience would be greatly appreciated.
  13. I read this tidbit while taking a break from filing out our DS-230's today. Has any member had experience with this at he Bangkok embassy? I originally obtanained my passport with my birth certificate 30 plus years ago. If I do indeed need it it looks like at least a month to obatain a certified copy. A heads up from USCIS sure would have been nice. Trying to get specific information such as this like pulling teeth from the Bangkok embassy.

"You (and any family members immigrating with you to the United States) must obtain an original birth certificate issued by the official custodian of birth records in your country of birth, showing your date of birth, place of birth, and parentage. Important Notice: All Immigrant Visa applicants must submit a long form original birth certificate. Short form birth certificates will not be accepted.

    The certificate must contain the:

    • Your date of birth
    • Your place of birth
    • Names of both parents
    • Indication by the appropriate authority that it is an extract from the official records
    Birth Certificates"
  14. My best guess is it is the luck of the draw. If they are not busy you get your I-130 in less than 5 working days. If they are busy who knows? However they are very easy to deal with if you treat them with respect.

They forward everything to the embassy which saves time. If I can get everything together, I hope to have our interview by the end of this month. It mainly depends on the new passports made today. Then the police, medical and how quickly I can type 3 copies of the DS-230
