  1. If you came on the Ir visa there is no K for your child you have to use the IR path. Your husband should file as it is faster by years. He will file an I130 package almost identical to the one he used for you. The bio dad if involved in the child's life must sign a statement they allow the child to immigrate. Make sure you know what is needed for this early on. If you need the court to grant you sole custody it might take a few. This is specific to the rules in your country about sole custody, Your sons process will be like your, petition, medical , interview.

  2. There's no set time it is different for everyone. Everyone goes into AP after interview. If they said the 17th I would think it will change anytime. Don't be so concerned with the website on the 17th call the place make sure Visa is ready fro pickup and go get. Or howevre your embassy does it.

    Thank you, it was my third additional interview :huh: finally I showed IRS 2013 transcripts, they kept it in the file and said that CO will review it but they kept my passport too and told me to pick it up on coming thursday, stil dont know exactly my visa was approved or what

  3. Everyone's 2013 will be due at interview. So I would definitely have it ready. For many of you since spouse will be here soon just file an extension you can go to turbotax file the extension free print it have at interview with your W2 real simple. no amending to do later.

    We already file 2013 through Turbotax and got IRS transcripts for 2013, should we update I-864 at the consulate or there is no need?

  4. All that needs to be updated is question 13, which doesn't have a signature on it. Just update it with 2013 as the most recent year (then 2012 and 2011 as the other years) and just print out that page. The petitioner doesn't have to do anything; you can do it yourself.

    What about question 5. current individual income and question 10 - should I count from January 2014, on old one husband wrote (before filing 2013tax) his whole 2013 income?

    I am going to have my additional interview on April 10, first time I got 221g, CO required to bring my husband's IRS transcription for 2013, He filed his tax and we got transcripts. My question is - when I go to my interview may CO ask me to update the AOS form? because on the AOS which we submitted to NVC the last tax year was 2012

    Maybe I am overthinking about that, do you know in which cases AOS needs to be updated at consulate stage?

    May I ask, why did they ask you for the transcripts when it clearly says on the offical instructions that you can use returns and W2's? We used returns and W2's so I am worried we will have the same problem. Is it because in 2012 your spouse did not earn enough to sponsor?

    Yes in 2012 spouse didnt earn enough, he just started his job this year, thats why I got with me IRS transcripts for 2012, W2 and 1040 for 2013 which shows 34000$ plus pay stubs and letter from work but CO kept asking 2013 IRS transcripts.. but I was not the first person whom CO let go to get transcripts, front of me there were 3 people , they also were required to bring IRS scripts, I think every consulate has different requirements so in my consulate it doesnt matter how much it shows on W2 or 1040 they do not trust it, they always want IRS transcripts. And also they take as a current income the last tax year, so even it was very high in 2013 it doesnt matter the important is the last filed tax year 2012

    I had my first interview on March 4, I got 221, I was asked to bring IRS transcripts for 2012, second additional interview was scheduled for March 20, I got transcripts for 2012 (which shows amount under powerty line) thats why I got with me his W2 and 1040 for 2013, payroll cheque for 2014, letter from his current job, I couldnt get transcripts for 2013 cos on that time he just had filed his 2013 tax so transcripts was not available to print, now I am waiting my third additional interview. My question is -

    CO has not mentioned to update AOS but just to be sure I wanna ask it from you guys.

    On filed AOS my hubby showed as his last tax year 2012 so now when he already has his return for 2013 should we update AOS or no?

    May it be a reason for CO to postpone my visa issuing

  9. You have already got correct advice on the tax issue. Here I am copying from the I-864 Instructions:

    Ask your husband (petitioner) to submit the 2013 tax return immediately. After he has submitted the return print out the 'pdf' copy of the return with all the attachments. You can wait for the tax transcript but that may not be available at the IRS website for another 3, 4, or more weeks. But you do not need to wait for the tax transcript. The consulate will accept a copy of the 2013 tax return as it says in the instructions below.

    Additionally, it is a very good idea to submit a letter from the employer, and also copies of last 6 months pay stubs.

    "You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to
    maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

    Thank you a lot for that information, as everybody here said i will wait couple weeks or month until transcripts will be available and I will bring to the consulate his IRS transcripts for 2013 with high amount

  10. Yes like 20 or more people, they all were called on same time 8 am morning, immigration visa interview is a little bit different than B1 or B2. They gather all 20 people in the hall and called them one by one, most of them were green card winners with family and kids, Thats good that i left my daughter at home coz defenitily she couldnt handle such long time

  11. I know. Be strong. You are not alone. Remember I told you tax transcript better than w2 forms. I thought your husbands income was well high for the previous years and that you would be taking those tax transcript with you. And to show his w2s only if asked...But don't worry this isn't a denial.

    His income for 2013 is 36000$ i think over the poverty line, so i guess i have to wait until transcripts will be available. I hope CO will be satisfied after that.

  12. Yeah he is just delaying your case. I wouldn't do that even if I lose money. Maybe he doesn't know much about I-864. Yeah if you took his previous tax transcripts they would say you need a joint sponsor.

    Yes he doesnt know anything about this process that is why he hired a lawyer, but the most cheapest and stupid lawyer ever in united States, sometimes trying to save some money people loose more than they wanted to save.

  13. I haven't done tax online, maybe 3 weeks or a month, maybe right after he files. Someone who has an experience can answer. Of course they looked at the previous year, and wanted to see this years transcripts. So gather those three docs and give them a call. Tax transcripts might take time just be patient. Everything will be all right

  14. Wait didn't you take the 2012 transcripts with you? And does the 2012 income meet poverty guidelines?

    No .. thats why I am going crazy.. its so so under the poverty guidelines.. total income for 2012 it is 7000$.. because he just started his job in this year.. If i get the transcripts with this amount my case is totally will be messed up, i hardly could explained this to him today. The reason why he does not wanna file it now is - he wants to save some money!!! He thinks if he file it when we go there ... I mean he want to show me and our daughter on it that we are living with him and save some money like that.. He is delaying my approval like that.

  15. That's not gonna help even you show 2012 tax return/transcript that is below the poverty level. Why can't you tell your husband to file his 2013 tax return ASAP now and print that out for your visa? Is his delay more important that your IR-1?

    You are absolutely right, I called him today , I told exactly the same thing, This process is taking more than a year.. I explained him that CO wants to see only IRS transcripts.. They dont care that he has a time to file it until April 15

  16. He can file his taxes online, and it takes all of ten minutes to complete... I used Turbo Tax this year and filed our taxes Married Joint over the weekend, printed off my tax returns that turbo tax saved for me in a PDF file and took them with me to my AOS interview this morning... Job done. Happy Immigration Officer. Any previous tax transcripts can be printed off for free at irs.gov.

    It seems daunting but I promise you its not. What they are asking you to provide is very straight forward. Take a deep breath, write a "to do" list and get everything that you need. You will be fine. The key is to stay calm and don't panic. As other VJ members have mentioned, you were no denied, its just a simple delay waiting for you to produce the other documents that they require. Good luck and keep us posted

    Thank you QueenComley, I called my husband today he is in Turkey now, I asked to file his recent tax for 2013 immediately, so if he use this Turbo Tax can he get the proof that he filed it . How long he should wait to get the IRS transcripts for recent filed tax ?
