  1. My fiance arrived in the US about 6 weeks ago, and we have gotten married. Yeah! But we would like to apply for his Social Security Number. Can we still do this or is his K1 visa not valid because we have already married and thus have to wait for our adjustment of status to go through? We are desperate as he needs an SSN to open a bank account and get a driver's license. Any assistance would be extremely helpful. Many thanks in advance!

    Our filing date was March 4, 2013. USCIS received our request for evidence on September 4th but we have not heard back. I called USCIS but they originally said that the 60 days was just an average waiting time and we were not guaranteed to hear in that period of time. Has anyone else had this problem? I called yesterday as we still have not received any notification, and USCIS has submitted a formal request.

    In addition, what is the process once we receive the NOA2. Does my fiance immediately schedule an appointment or how does this work? And then what is the timeline after that?

    Any assistance would be greatly appreciated!

    USCIS received our responses for the request for evidence on 4th of September, but we have yet to receive our NOA2. I called USCIS before I left out of the country on November 1st, and the one representative told me that 60 days was only the average time. However, I called yesterday as we still haven't received the NOA2, and the USCIS representative filed a formal status request. First, has anyone else experienced this delay in receiving the NOA2?

    Second, after we receive the NOA2, can you please remind us what happens? Do we receive a letter scheduling my fiance's interview? And then do we schedule it and then wam, we are done and he can finally buy his ticket to come to the US? Or how does this work? We are toying with the idea of obtaining an immigration lawyer, even though it would be a financial struggle, as we feel we are getting stuck.

    We believe that he needs the police clearance records which is going to be another major hurdle, but please let us know. We were hoping he would be here by Christmas as our filing date was March 4th, but given that it is November 24th and we have yet to receive our NOA2, this seems bleak. But please let us know your thoughts. Any guidance, motivation, or anything would be very much appreciated:).

I have all of my mail forwarded to me but i am still nervous about not receiving something about the visa application. I am based in Georgia, so i assume i would have to contact the East coast office if i was required to contact anyone. Please, please, please advise!

  6. I have looked at many people's timelines, but I would like to just confirm. We submitted our I-129F on March 1st. The US Petitioner received something in the mail a week later acknowledging the receipt of the document. Was this the 1st Notice of Action? And were we supposed to do anything? On the K1 Process Flowchart, it states that the NOA1 should take 2-3 weeks but it took 1 week for us. So I just want to confirm. When should we expect to hear again? Assuming we have already received the NOA1, I believe the next step is the 2nd Notice of Action, correct? The K1 Process Flowchart seems to be slightly different in terms of processing times than reported on other members' timelines. Also, should we be doing anything now?

    Lastly, the timelines depend on the service center, but how do we know which service center will receive our applicaton?

  7. Thanks guys. Say, how do we determine the filing location. I am based in Georgia. I am completing the letter of intent for the K-1 visa.

    And i would like to finish all of this paperwork by tomorrow as i leave for out of the country tomorrow, and am just making this a priority.

  8. Also, we are having problems remembering the addresses where we lived in the past 5 years - i.e. "Plot 237 in .....". For example, i lived in Egypt for 3 months, but lived in 2 different residences - but never received postal mail there. I have honestly no idea of the stree of the first place as it was only for 1 month. On my tax forms, I am stated as saying that i lived at my US address during this time. Therefore, do i really need to put my Egypt addresses? Same with the beneficiary. we can't remember for the life of us the address of his apartment in Egypt. can we just put the section of the city, or do we really need to complete the house number?

  9. How long did it take you from when you first submitted the I-129F? We are still in the process of putting these documents together, but must be sent by the end of this week!

    In theory anyway, the processing times for the petition (I-129f) do not vary by country. In practice it is not unusual for petitions for beneficiaries from countries which are considered to harbor terrorists take longer. Ukraine is not one of those countries.

    Processing times for VISAs vary greatly depending on the consulate. Ukraine has always been fairly quick about making an interview appointment.

    Expect 8-10 months for visa issuance. Expecting less than that will probably result in disappointment. For Ukraine, figure 2 months after the petition approval for the NVC stage and the interview appointment.

    So technically, if we wait the 90 days to get married, we won't be married until 1 year from now?

  10. Ah, thanks Alla. That is extremely depressing, but I guess that it what we need to hear. Should i just get pregnant:)?

    The only problem is that his business is in Nigeria, and he would prefer to go back to Nigeria while waiting for this whole process if it is going to take so long. He is in his final year of school in Ukraine, but can take classes online. So will Nigeria take longer than 8-10 months? Does Ukraine take a shorter period of time than the 8-10 months? Sorry, i can't find where you wrote 2 months (I think it was in response to another one of my desperate posts). But i still don't know what the 2 months referred to.

    How often does he need to go back to Ukraine if he decides to relocate to Nigeria? Just once for the interview as he can always have a friend pick up his mail?

    Lastly, in Nigeria in early 2011, we became legally engaged, where you sign papers to state that you intend to marry, but there are no legal ramifications. Is this a problem when obtaining a fiancee visa because it was so long ago? We did this at the time because we thought it would assist with a visitor's visa.

    So many questions. We appreciate all of your help. After 4 years together, I knew this process would be daunting and that is why i kept putting it off, but with all of the information we receive here, we couldn't be more grateful. Thank you!

  11. Thanks for the info. So to confirm, for the interview, will he (the beneficiary) AND I need to provide police clearance reports for all countries we have lived in for more than 1 year? Or is it just him? So the beneficiary here is a Nigeria resident who currently attends school in Ukraine, but also attended school in Egypt where we first met. So, he will obtain a police clearances for all 3 countries since he has lived in each of them for more than 1 year. But what about me (the US citizen)? Do I need to obtain any police clearance reports?

    In terms of the employment, because he never worked in these countries, he should not include his schooling under employment. (Weird how it is different when you fill in your customs form when entering the US-ugh).

  13. Of course, to add more fuel to this annoying process, my fiancee and I have lived in various developing countries for more than 1 year. It is my understanding that HE ONLY has to obtain police clearance reports from the countries that he has stayed in for more than 1 year, and I do not need to provide any police clearance, correct? Both of us have no records, but the problem is getting those records. Does anyone have any suggestions about how to obtain a police clearance record in a country that he is not a citizen of and doesn't currently reside in? We still have friends in Egypt, but can he obtain a police clearance record without having to go back to the country with whom is requesting the clearance? I believe that we read that the USCIS or other body provides you with a letter to give to the police, but is it best to start just trying to obtain this clearance while waiting for the documents to be processed? Any suggestions will be greatly appreciated. Thanks!

  15. My fiancee and I are applying for a K-1 visa. He goes to school in 1 country (and has a 1 year residency visa that is renewed every year), but is a citizen of another. What country should he apply in? The two countries are on 2 different continents, so it is not possible to constantly fly back from one country to another. He can also relocate to his country of citizenship to apply for the visa there, and take classes online. Any advice would be great! When we have applied in the past for visitor's visas, both US embassies in each country have told us that we should be applying in the other country. So any help would be great!
