    Hi all, here is the updated list -- i just went back to page 58 and moved forward. I know that this is not ALL updates that were given since page 58, but I did not add anybody to the list who hasn't been on there already (my apologies to everybody who I "skipped" -- gotta spend my workday wisely ;) )

    It seems, April 5th is going to be a big day in this forum! (not because I have my interview, but several of us will!)

I think it's generally a good idea not to offer the government any unrequested information.  To my recollection, there wouldn't even be any place in any paperwork where you would be providing any information about your relationship with Adam, unless you have been married to him in the past.  So unless they ask, you don't need to provide any information about Adam.

     

    Now, would they ever had any reason to ask you about Adam?  Well, that's probably a very good question.

     

    A green card (or more accurately a permanent resident status) will only be valid for 2 years, if the green card is based on marriage to a USC and the marriage is less than 2 years old.  Therefore, if you get married to Steve and he gets a green card before your second anniversary, his green card will only be valid for two years and you guys will need to apply for the removal of that conditional permanent residence at the end of those two years.  So it wouldn't be smooth sailing yet even after you marriage and his initial green card.

  3. Is anyone here being process at the Salt Lake City (SLC) field office?  We sent the application in on Aug. 15 2016 and had the fingerprints done on Sep. 6., but still haven't gotten any notice about the interview.  Has anyone who filed in Aug. 2016 and is with the SLC field office been scheduled for the interview yet?  Just want to have an idea on where the SLC office is in terms of processing.

     

    Also, will a change of address make any difference?  We're just moving to the other side of the town which certainly doesn't cause any change of immigration district or field office, etc.  It'd be ridiculous if this can cause any delay.

  4. lesthatsri: No. Once you apply for the removal of conditions on your PR, your CPR status will be automatically extended for one year. You'll receive a letter to this effect. They won't send you a new green card for this one year. But whatever you need to do that requires a valid green card, your old green card (possibly expired already) together with the letter should be enough.

    I think they do transfer some I-751's from Vermont to Cali to somewhat equalize the processing time. But it doesn't seem to be helping very much.

    It governs the naturalization of "persons living in marital union with US citizen spouse", i.e. the three-year naturalization. Look at Sec. 319.1(b)(2)(ii)©, near the bottom of the page,

In the event that the applicant and spouse live apart because of circumstances beyond their control, such as military service in the Armed Forces of the United States or essential business or occupational demands, rather than because of voluntary legal or informal separation, the resulting separation, even if prolonged, will not preclude naturalization under this part.

    You can argue that your living apart is involuntary because of "occupational demands" and that the need of having an income to support your family is a necessity of life and beyond your control. But of course, the burden of proof is with you. Of course, it may be easier if your husband just waits for the five-year naturalization.

    I talked with a lawyer and she seemed to think it should be OK to apply after 3 year of my wife getting her LPR, even though there will be periods of living apart during the three years.

    I'd suggesting consulting with an immigration lawyer or even retaining one for the application. The lawyer can probably tell you what the best way to make your case is. That is what I intend to do when my wife is up for naturalization next year under the 3-year clause.

  6. Do you know what kinds of proof they are looking to provide? I will be travelling back and forth throughout that time, so photographic evidence for that last year shouldn't be a problem, in addition to joint accounts/billing addresses/taxes/etc. Plus, my wife and child in all likelihood will be staying together with my parents during that time.

    I'm in the same situation. My wife and I lived together for about 20 months in the US with her as an LPR. I got a job overseas and she staying in the US to finish her studies. I will travel back and forth and we'll probably only live apart for about 7 months before she's eligible to apply for naturalization under the 3 year track.

    It seem that you guys are in the same situation and your wife will have satisfied the 3 years of continuous residence in the US, the only problem is the periods of physical separation. I found this on the web.

    Now, if you wife will stay in the US for two more years anyway, then maybe it's easier and simpler, possibly cheaper, for her to just wait two more years and then she'll be eligible to apply for naturalization regardless of her relationship with you.

    But of course, if you want her to be naturalized under the accelerated three-year track (so that she can join you overseas without worry about losing her LPR status), then I'd suggest at least consult an immigration lawyer, possibly retain one for the application. I plan to do precisely that. The burden of proof is on you and your wife to show that you're living in a "marital union." You should consult an immigration lawyer on what they accept as proof. The lawyer I talked with said it should be possible without giving more details. I suppose I'd need to pay her more in order to get the details.

    Anyway, I would love to hear about your experience if you go ahead with the three-year application.

  7. Another question I have is that is it possible to change consular processing (outside of the US) to change of status process (in the US) while the consular process is on-going? Does anyone know how long it'd take to have this switch?

    I suppose that my wife could join me in the US using her tourist visa and then change her status here. But I suppose that this will take months and we might as well bite the bullet here and wait for a few more weeks with the consular processing.

    I am not sure if anyone has experience a similar thing as what I am about to relate, but I have searched all over the place to find this rule in any written form other than what the embassy told us, but failed.

    Anyway, here's the story. My wife went to the US Embassy in Singapore for her immigrant visa interview on 18 Sep. 2013. Neither of us is Singaporean and she's applying for the visa on the ground that she's married to an American (me). We both worked and lived there and in fact met there. So we felt that it was going to be a routine interview and she could expect to get her visa approved that day, as we thought that we had prepared all documents carefully and there should not be any more problems.

    But much to our chagrin, her visa was not approved. One thing that they wanted was some updated financial information from me. Well, fair enough, the information they have is over half a year old and I can provide this information immediately. The other thing they wanted was what bugged me the most. They wanted her to get a new police certificate from her country of citizenship (Russia), because the one she had provided before is over six months old (it was issued about seven months ago).

    So now she needs to go to her embassy in Singapore again to get a new certificate, which will take 2 to 3 weeks. I'm already in the US and started a new job, anxiously waiting for her to join me. Yet this latest debacle will delay our reunion for another month or so.

    Now here is thing that really frustrated me. Maybe I am wrong, but in the letter we received from the NVC on what documents she should bring to the interview, it specifically states that she must bring

    "A new police certificate from your current country of residence, if you obtained the police certificate more than one year ago."

    I emailed the embassy after my wife's interview and they quickly responded that

    "Police certificates from the applicant’s country of nationality and country of residence must be issued within the last six months."

    Now when I emailed back, with the NVC letter attached, highlighting that nothing is mentioned in the NVC letter about the police certificate from the country of citizenship and the currency requirement for that from the country of residence is one year, NOT six months, I got nothing back. They generally respond quickly in my past experience.

    I also search online a bit and cannot find anywhere this six-month requirement and the letter from the NVC states rather clearly the currency requirement is one-year. So I don't know if anyone else has experienced this, or did the Embassy in Singapore simply made up this rule as they were interviewing my wife.

    We would have easily prepared all the documents, had we known what was required of us. But we were not informed of this six-month rule. Yet it is not simply an error of omission on the part of the Embassy/NVC, because we were clearly and unequivocally told a one-year rule and yet now we are told something different. Even if the rules changes after our receipt of the NVC letter, I am still under the impression that our federal government operates under the confines of the constitution which explicitly forbids the enactments of act post facto regulations (laws cannot be enacted retroactively and hence new rules can only be applied to new applicants, not applications already under process or possibly completed applications).

    Anyway, notwithstanding our anger and frustration, does anyone else know about this six-month rule for the police certificates or had a similar experience? Can someone direct me to a place where this six-month rule is written?

  9. Hi, I am not sure if this is a new topic. I'm an American and my wife is Russian. We live overseas right now. We plan to move back to the US before the end of this year. I submitted I-130 for her last November and it's been approved earlier this month and now the files have been forwarded to the Dept. of State. I just have a question regarding getting police certificates of no criminal record.

    I understand that one MUST get the police certificates of no criminal record from all countries one has lived for more than a year since the age of 16. So my wife needs one from Russia and another from Singapore (where we live now). These can be easily obtained. But she has also studied and worked in China for almost two years and hence would seem to need a certificate from China as well.

    My question is does the Dept. of State really care in this situation about getting this certificate from China when/before my wife goes for the visa interview? Has anyone been in a similar situation? I mean, she is not a Chinese national and was there not for a terribly long time. From what I understand, one (or at least one's agent) must go to the place where one lived in China to obtain this certificate. The Chinese Embassy here seems to be unwilling/unable to help. It's hardly a convenient thing to deal with the authorities in China and neither of us really wants to spend the time and money to go there just to get a piece of paper.

    In there is no way around this, does anyone know a reliable agent in China (or elsewhere) that can help with getting this certificate from the Chinese police?
