  1. Just give it some more time. You should always take that online thing with a grain of salt though, it doesn't update accurately 100%. Some have had approved I-485 and I-130 petitions with no movement in the online notification. As long as your delivery service showed it was safely delivered, you shouldn't be concerned. Good luck!

    Thank you for the reply - you've eased my mind! I've been panicking non stop worrying if I sent in enough documentation etc. The RFE was in regards to the I864 and I864a. We filled them in backwards so to speak, so we re-did supplied all the latest tax info for those two people (my wifes parents). Not sure if I need to prove that they are married with joint bills/bank statements or not. That's why I was worried I hadn't heard from them!

    I sent in my RFE documents 2 days after receiving the request for more information. I can see that USPS delivered it, but when I check my case status - nothing has changed. Should I receive any notification that they got my RFE documents?? I called them up a few times, and they are 100% unhelpful. They can't give me a yes or no. So I'm stuck wondering should I just resend the documents or wait 30 more days. Got my biometrics done the day I received the RFE, so that has to be a good sign. Hopefully!

    EDIT - Got my biometrics done the day I received the RFE, so that has to be a good sign. Hopefully!

  4. I filed all my paperwork on May 1st and just had my biometrics taken last week. Today I received a notification for request of evidence based on the I-864A I filed.

    My now partner (US Citizen) has not had a job for the last two years and has just become self employed as of 2015. So her tax returns for the last 2/3 years are next to nothing. So we thought we could have her parents joint sponsor my application using two i864A's - however I just got the letter back saying in order to do this I have to be listed as a dependent on their federal tax returns - which obviously I am not.

    So I'm not sure what to do now, as she doesn't earn above the minimum poverty amount based on her tax returns and we can't/aren't able to use her parents as co-sponsors. Is there anything I can do here or are we stuck?

  5. Yes I have a feeling that my VWP would well and trully be done for. Which is a risk I knew about when I went down this path. It's an awful feeling right now - caught between wanting to go home but also not wanting to just give up on everything in the US.

    Edit - my only real option is just to wait and see what happens with my application and hope it hurries up.

  6. Hi all,

    I just sent in all my docs recently with regards to my AOS and they have been received. I also applied for my emergency travel at the same time, as 10 days ago my dad found out he had a brain tumour and just had surgery on it.

    My question is - if I were to go home now and forfeit my visa application. What are the implications of doing so? Would I be banned from re-entering the US for 3 years? Can you petition this at your local embassy?

    My SO has no issues with moving to Europe to be closer to my family, however - if I wanted to visit her and her family after I cancelled my AOS (now I would be an overstayer), I don't think I'd be allowed to visit the US again. I'd really appreciate any help as I am lost!

  7. Thank you so much for taking the time to do all of that Gianluca. It was really helpful to see! I may use it too as a reference for my own application.

    The main thing I'm trying to figure out is the whole having her parents sponsor/petition for me. Is that just the I-864 form for them aswell as my wife - with my wife being the main applicant? There seem to be so many different options and combinations!

  8. Looooong time lurker,

    Long story short. After 6 years of long distance, I came over to visit her in the US (she is a citizen) and we got married on new years eve. I came over on a tourist (esta) visa. Which is now out of date. The bad part of things, which is why I did this thread - is she has been out of work for the last 9 months and so does not meet the financial requirements. Money wise we are fine, with more than 30k saved. However this doesn't help us for the AOS paperwork as it wasn't earned during the last 2 years for her and her tax returns show pretty much a 0 for last year.

    So - we are living in her parents, who luckily have a granny flat for us to use while we get paperwork sorted. They have offered to sponsor me and sign whatever paperwork is needed to petition on my behalf.

    My main goal is to get my AOS in line asap and then to get my EAD (employment card) as soon as possible, as I have some great job opportunities available here from when I last lived here 2-3 years ago.

    Should I have my wife and her parents fill in I-864? I've looked at the guide (http://www.visajourney.com/content/i130guide2) and from that I need to fill in the following

    1. I-130
    2. G-325a
    3. I-864
    4. I-485
    5. I-765 (optional)
    6. I-131 (optional)
    7. G-1145 (optional)

    Is there anything else I am missing? What should I focus on first so that I get my AOS and EAD asap?

    Thanks a million in advance for any advice - I'm feeling a little swamped right now and panic is starting to creep in. Specially when I read that it can take 3-4 months before you can even think of getting a EAD back.

  9. Hi - just a quick post to ask what will hopefully be a simple question! I am now in the states and will be for the next 6 weeks with my GF. I am here on a tourist Visa, and due to an illness on her side of the family - it looks like our wedding plans are being pushed forward by a good 12 months!! So I'm aware we will have to file and AOS and other bits and pieces - but my main concern is I need to be back in Ireland at the start of August for my brothers wedding (I'm the best man!).

    My question is this, if I got married and filed all the paper work this month - would I be eligable to leave the country in August to go back to Ireland for a week or two without too much hassle coming back to the states? I have searched the forum and I guess I'm getting too muddled up in abbreviations and paperwork!!

    Fingers crossed this isn't a stupid question! Thank you all in advance!

  10. So myself and my go have been together for 4 years. Both of us have been back and fourth a number of times. We've both done year long j1 visas to Ireland/California. Now I'm over in California on a tourist visa for the next 4wks or so. I don't know if its valentines day or just how amazing things have been going for us both in the past 12 months - but I am thinking of proposing.

    Now hoping she says yes, would it be better for us to get married ASAP and try to adjust my tourist visa while? I'm not really sure of the process from here if we do decide to get married now. Obviously we would want to try and minimize the time out of work as we are 25/26 with about 15k usd in savings. So I would be looking to get a job over here as quickly as possible.

    I didn't come here expecting to get married, but now that I feel like the time is right-I want to get all my ducks in a row so we can hit the ground running.

    I've had a read through of various guides here, but there are some forms i have no idea if I would need etc.
