  1. this was the first reply from our congressperson inquiry,

    Form: I-485

Thank you for your inquiry regarding this constituent’s immigration matter. U.S. Citizenship and Immigration Services (USCIS) records confirm that your constituent’s case is pending background check clearance. USCIS is committed to adjudicating immigration benefits in a timely manner while also ensuring public safety and national security. A small percentage of applications and petitions have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed.

If a background check reveals an issue that may impact an applicant’s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible.

USCIS realizes that your constituent may be frustrated by the progress of his or her case. However, the agency must balance individual inconvenience against broader issues of public safety and national security.

We hope the information provided is helpful. If we may be of assistance in the future, please let us know.

    Thank you,

    Immigration Services Officer

    Congressional Unit

    U.S. Department of Homeland Security

My wife and step son want to go back to china to see her mother since she recently had heart surgery and not knowing when the interview will happen , is complicating the trip back. it is really unfair to pushed aside without consideration

  2. Was wondering if anyone else has had the long wait for AOS at the Washington field office. Our projected ETA has come and went and all we got was still processing more or less. I have used my representative in congress's liaison office near our district, several times over the course of this process. this time we received this,

 What is there to consider? We are married, over a 1 yr. and what exactly.

The customer service is lousy at least in the Washington area, how is that possible at the nation's capitol to get treated as of no significance, while other regional branches of the agency HSCIS finish in half the time?

  3. Are there updated links to follow for adjustment of status ? I noticed some of the links are broken and others appear over 7 years or more older. I am getting conflicting information of AOS for my wife. We are nearing her 90 days and need to get the AOS I485 going. One answer to a question we haven't found the answer too, is, do the filing fee's need to be paid along with the application or does it come after the I 485 AOS is received ? And is it beneficial to file the whole list of documents together at the same time .

    thanks

  4. First things first, we were approved on 7-15-15 at Guangzhou Embassy. Very fast and a few simple questions were asked and we were approved !!!. A question of importance now to ask. My fiancée needs to wrap up some things before departing stateside and we were wondering how much time can she delay before her visa expires? I have heard or read somewhere on the forum 6 months from date of issuance from the consulates office visa approval date, but I can't find anything in the forum. Also does this apply for the K-2 as well? we filled with he intent of the K-2 following the K-1 at the same time, but the K-2 may delay because getting the courage up to transform his/her life to the American school system (language barrier has the K-2 worried)is a daunting task and he/she wants to hone their language skills a little more before departing on the life changing journey. Any advice, links, etc. is greatly appreciated .

    thanks in advance

  5. thanks for the information ! I am trying to tell her we don't need it now because once we are married in the US, my health insurance will cover this, (and at a great deal less than anywhere else on the planet) but she thinks we need to do it, so I agree as long as we get the I-693 form. I think it is no big deal but we will try it her way first ! either way the hard part is over with !!!

thanks to all ! the info on the AOS is very helpful like all the other info we have used on this site !!!

  6. First, we have passed the visa interview, wow a nervous process to say the least. Now my fiancée tells me she still needs to get vaccinations before the visa is issued and before coming to America because it will delay her green card state side. Is there any thing to this or is she just getting bad or outdated information. I really need a quick answer. She is insistent that we must do this ASP, but nothing was indicated from her visa approval that she needed to do anything else, other than wait for the sealed documents and visa. thanks in advance

  7. I can't connect to the links on the embassy portal for Guangzhou and it is becoming a bit of a nightmare trying to navigate the procedures that they require at the embassy.

We have received and responded to the packet 3 (Ds-160) and are waiting for the packet 4 to arrive. what exactly is the packet 4 and what if any other forms are required to fill out? we are becoming nervous and not sure what else is required of us, any help is greatly appreciated.

  8. I received my fiancée and self's NOA2 (I-797) today !!!!! It was kind of weird the language that was used, I take it there is no generic paragraph used, but rather unique to the individual. Is this a correct assessment ? Mine indicated it was,

    1. forwarded to the listed consulate

    2. noted that this was my second approved I-129F and as such entered into a multiple visa petition tracking data base.

How would I know which consulate they are referring too ?

as far as the second question, have no clue what bearing it as, since it was 15 years ago.

Just looking for the next step in this juggernaut process,

    thanks

  9. If they need something more from you, then you will receive an RFE(request for evidence), and you can supply what is needed.

Why are you worried the petition will be denied? If you provided everything required, both are free to marry, and you showed proof of meeting in person within the 2 years before filing, then you should be approved. If your petition is being processed at the TSC, then you are waiting longer, as they are quite backlogged. Still less wait than a spousal visa though. They are also backlogged and waiting about a year.

Waiting is never fun, but it is part of the immigration process, at every step of the way. It sounds like your petition will be approved soon, so you are almost at the end of the road for waiting while separated. If you ditch that now and marry in Vietnam, then you will begin again by filing a new I-130 petition to start the process for a spousal visa.

No, you cannot enter the US with a tourist visa with the intent to marry, stay and adjust status. Having intent to use a tourist visa as a means to immigrate is fraudulent.

  10. Finally got an answer after petitioning for my fiancée back in august 4 of last year. Not what I was expecting, at all.

What exactly does this lead to now. I have a very difficult time even fathoming what possibly could be wrong, this is not the first time I have petitioned for a fiancée visa. I did so some 14 years ago and legally divorced last year before filing for my fiancée.

    • employment check
    • income check
    • divorced check,
    • evidence of relationship check
    • visited three times check
    • daily texting and weekly video chatting check.

does anybody have a clue ?

    thanks

  11. I have been checking the processing times on the VJ website and they do not accurately reflect what is on the USCIS website. Here on VJ, you can look up the processing times or go (by link to USCIS site) and also check the dates that have or are being processed. I am curious, which one is more reliable ?

In my particular time slot it shows I129f k1 & k2 visa processing out of the TSC for the date of July 31. Yet the link to USCIS is showing the month of May processing times, very confusing and deflating. Does anyone have a take on which one is more reliable? Calling the service center does little good.

    thanks in advance

  12. a follow up. I finally got hold of someone at the uscis, about the computer problem. She said basically a work in progress, typical business answer from uncle Sam. What is interesting she was able to tell me my noa1 date with general info, but she told me they were processing Aprils date @ TSC. looking on this site's dares it indicates processing dates for august 2 2014, which is it ?
