  1. I just got off the phone with the national number. Apparently there is a new law for non-citizens that they will not give any information over the phone regarding their social security cards or status. We have to go into the local office again. Does anyone know what law change she is referring to? Because there is nothing on the website, the phone recording, or the letter we received from the social security office to verify this information. Suddenly I'm in favor of the government being shut down, these people are not good at their jobs to say the least.

  2. We applied on September 10th in the Oceanside office. Phone calls are still being transferred to the national number, so they are not actually working yet I guess. I waited 45 minutes on hold last week only to be told they couldn't handle any card requests. I'm currently on hold for a 50 minute wait with the national number and fearing the worst again. Many job sites require you enter a social security number just to submit your resume and here in California they can confiscate your car if you're not driving with a Californian license, which apparently illegal aliens may now apply for, but we may not (since there is a social security card application pending).

  3. Hi All,

    Just wanted to update you, we got the following checklist and I asked for a supervisor review 10 days ago because I have no idea what to do. The cheklist is saying that the income amount listed for both myself and the co-sponsor doesn't match the irs document I submitted. I used the adjusted gross income and the amount is exactly the same in both instances. I have no idea how to resubmit something that was correct the first time. This is adding months to the amount of time I will be away from my husband, any advice????

  4. reading your timeline -

    you've paid all the fees and sent on the AOS set.

    i see nothing about IV Set sent, though (that's the Packet 3 sent date in yer timeline)

    so if you've not sent that out, NVC is waiting on it.

    re: 'receiving stuff from NVC' -if you've sent in everything already - then ya wait for the case completion stuff.

    IF you gave over email addresses to a NVC TeleOperator, then notifications come in via email and not postal mail - so if you've been receiveing email notifications already, the interview letter will arrive via email as well. There will not be any notifications sent via postal mail, and no appointment letter sent via postal mail.

    so, if you have not been receiving email notifications, and have gotten postal notifications in the past (I don't deem this likely, as yer going fast at NVC, per yer timeline) then SURE - the interview letter will arrive via postal mail. Unknown about forwarding procedures done overseas, but if that was in the USA, the letter would be sent back to NVC and NOT forwarded.

    Thanks for the info, yes, we've been getting e-mail notifications for everything. I'm sending in the IV package on Monday, and we leave on Friday for the states. My US address has stayed the same throughout the process, and my husband's mail is being forwarded while we're away automatically through the Belgian postal service. So, sounds like no worries then, great!

  5. Hi, we're going on a family vacation to the states for a month (we live in Belgium) and our mail is being forwarded to a friend's address. It is possible our case will be processed at the NVC while we're away and that they (or the embassy in Brussels) will send documents to us while we're away. Can anyone say if this is with regular mail? Or will we have to sign for it personally.

  6. I got a checklist for original marriage certificate. I sent the original marriage certificate. So I requested a supervisor review? Is there anything else I should or can be doing? Please help. Thank you in advance

    I didn't send any of the documents from our NOA process with the AOS package and wasn't planning to send them with the IV package either. Is it necessary? If the NOA 2 is approved, why does the marriage have to be checked again?

  7. Hi, I just noticed on part 5 21. a-g it says list the amount of persons you are sponsoring, in my case, one, my spouse.

    Then underneath it says list those you are not sponsoring...yourself, your spouse, etc.

    (if you are currently married enter 1 for your spouse)

    I'm confused! I'm married and I'm sponsoring my spouse, so how can I count him as persons not sponsored?

    maybe I'm stupid, but this doesn't make sense, anyone have an explanation?

    2. Is there a USCIS field office in this country / Is DCF still possible? No

    3. When did you file the I-130: January 2013

    4. How long had you been living abroad: 18 years

    5. Do you reside in the country legally? Yes

    6. What is the reason for your residence: work permit/student/tourist/to be with husband

    7. Did you list your foreign address on all forms in I-130 package? Yes

    8. Did you send I-130 package from abroad? Yes

    9. Did you include evidence of your residence abroad in the I-130 package? .No

    10. Did you mention the fact you reside abroad in the cover letter or write a letter describing your current situation and the evolution of your relationship with your spouse (mentioning your residence abroad)? Yes

    11. Has your case been "auto-expedited"? How long between NOA1 and NOA2? 98 days including 1 RFE

  10. Hi, we are preparing to send in our two sets of documents to the NVC. When the beneficiary goes to the interview at the embassy, will he need all the original documents from the NOA process as well? And, we are required to send a certified copy of the marriage certificate to the NVC, will we have to order an additional (original) certified marriage certificate to bring to the interview? The same for all documents, we ordered them, and now must send them in, so how do we bring the originals to the interview?

    Also, one more question, I am doing the AOS with assets only and a co-sponsor. What documentation will prove the assets (money in a checking account) and how will the cosponsor prove income (my Mom has 3 years of IRS transcripts and is retired-retirement benefits are above the poverty level guidelines).

  11. Direct consular filing is unavailable in Canada and other VJ members very familiar with Canada have posted time and again that consular personnel at the US Consulate in Montreal are very strict on domicile with regards to the US Citizen.

    Joint Sponsor is your only option (your wife will still have to complete and submit an I-864).

    Hi,

    As I understood, you can also meet the financial requirements with cash (125% of poverty level x 3) in which case you wouldn't need a joint sponsor. We're in a similar position although I will move to California a month ahead of my husband.

    To prepare I have a few questions, if I used a US address for all correspondance (and a Belgian address) will I still need to prove my intent to relocate to the US? Isn't it proof that I received mail at a US address during the visa process?


    Another question I will be using cash instead of income as well as a co-sponsor for the AOS. (cash is 3 x poverty amount), how do I prove the cash? Is an account statement from my us bank account enough?


    Another question, I may already move to the US address before my husband's interview and he'd say in Belgium, are there any issues of doing this in the middle of the process?



    Any insight would be greatly appreciated.
