  1. Yup, I'm aware, that's why I'm so mad/sad! I submitted one service request that wasn't responded to within 45 days, so i had to submit another one and this letter arrived a few days later. It states that it serves as a response to any enquiries that have been made into the case. My congressman's office is also looking into but I assume they will now just come back and say that USCIS sent me this letter and that's my update... we'll see. As far as i know my case is still at the NBC (that's what it says when I log in to case status updates).Totally out of line that my local office is handling applications submitted 3 months after mine.

We have the same field office, I filed mine on January 2013 and they sent me a Potential Interview Waiver Case letter last week. Seems like our application stays at the NBC office for a little while, unlucky us ( :

  2. Yay, they've updated. As of June 30th, they are processing January 11th. We're getting close!

Seems it takes them a month per month, so they should already be processing Feb. 20ish by now. Oh well, at least they made it to 2013!

Finally! We almost there.. Let me know if they send you an interview appointment.

got txt and email this morning at 8am that reads .... maybe they are reading vj and starting to wake up?

On August 19, 2013, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days

Congrats! So y'all approved without interview. That's great!

  3. Because the days between the I-94 expiration and the acceptance of the AOS package are overstay, illegal days. If you have 180 or more and you leave the country you will be banned and unable to return. It says this right on the AP approval letters. If you adjust in country, those days will be forgiven once you become a GC holder. If you just have a few overstay days, you can use AP, but the OP has years of overstay days.

I know it sounds bad to say that those days are illegal, but I don't mean anything nasty by it. USCIS understands that it may take more than 90 days to get the AOS sent out, but the fact is that a K-1 visa holder is only given 90 legal days at POE. The marriage, by itself, does not protect your status or make your stay legal. Only the AOS makes your stay legal. So the people in this situation aren't going to be deported or anything, but they can only travel internationally once their GC is approved.

That's good to know! I guess i may not be able to use my AP bcoz I'm one of those late filers ( :

Maybe that's one of the reason I didn't received a combo card , they sent me a document letter on my AP approval and EAD card not valid for reentry . But why they still approved my AP and they knew already that I can't use it?

Thank you for the very helpful info Harpa!

  4. My EAD card (combo EAD and AP) came yesterday. USPS made me nervous though, the tracking status was delivered but it was nowhere to be seen, thankfully the delivery guy pulled up a couple of hours later.

Now just to wait for my interview on the 2nd of May, and that's the last hoop to jump through, immigration wise anyway.

Now to get my SSN and drivers license sorted out. Such a relief that things are moving along.

Congrats to the combo card and good luck on your interview!
