  3. Hi Folks,

    My husband came back from abroad this week, and since his AOS was approved while he was away, the officer took him to a secondary inspection room, gave him a stamp that said "Paroled," and sent him on his way.

    The officer didn't say anything about further instructions, so do we have to do anything else now?

    I've read that if you don't travel somewhere within a year, then you must go and show your green card to some office to make sure you're entered correctly in the system. Is this correct? I know he should be here on his LPR status, not on a Paroled status, but I'm not sure where to go from here.

  4. On August 15th, my husband and I had his AOS interview. The next day, we left the US to visit family with my husband's AP combo card in hand. We are still abroad, and we received news that his AOS was approved and it has already arrived at our home. I think I have a pretty good idea of the procedure for him to enter the States at this point, but I wanted to make sure that we are doing things correctly. Any comments or instructions would be very helpful smile.png

    Since we have his AP card with us here, our plan is to arrive at the airport and just show the AP card and explain that his GC was approved while we were abroad (and make absolutely NO mention of entering in any other way--old F1 visa, I-94, etc. tongue.png ). I undestand that he may be sent to a secondary interview of some sort and possibly get an I-551 stamp? I believe that this is the correct way to enter at this point, but if I'm wrong, please correct me!

    Otherwise, we could go to the US embassy here and ask for a Letter of Transmittal (I think that's what it's called..) so that we can have something to show the officer that his GC was approved while we were abroad.

    Our last option is for me to mail his GC to him when I arrive home a week earlier than him. I really feel nervous about this option though. Even with a tracking number, that card needs to be treated like a bar of gold.. I definitely don't trust the mail!

    What is our best plan of action? Enter on his AP and expain the GC approval while abroad + bring a Letter of Transmittal? Unsure..

  5. We finally received the letter for our AOS interview! Oddly enough, it is scheduled for the same day that we will be leaving for Europe. My husband's combo card arrived already, so traveling is not an issue, and our flights are scheduled for the evening, so there is no problem with the times colliding. But will this be an issue at all?

    I have heard that some applicants are asked to surrender their combo cards and i-94 at the interview.. could we request a stamp in his passport so that we are able to travel? Or would it be a bad idea to even mention travel plans?

  6. Today, our case status updated to " Your I485, Application to Register Permanent Status or to Adjust Status is now ready for interview scheduling."

    The site says that we will receive a notice when the scheduling is complete. For those ahead of us, how long does the scheduling part tend to take at this point? Is there any chance that we could be scheduled for an interview this summer?

  7. What sort of proof is needed for the field office to approve an expedited AP? We made an Infopass appointment in the hopes of speeding up the AP, and we can bring the plane tickets, but as far as letters/other documentation, we don't have much.

    What have others brought to the Infopass appointment that was accepted as proof? Do we need a letter explaining the nature of the trip?

  8. We received my husband's Biometrics appointment letter, and decided to give it a shot to try and go early. We arrived at the Milwaukee office after lunch today, and after convincing the security bull dog that we would be unable to keep the later appointment, he let us through no problem.

    All in all, we were in and out within an hour! smile.png

    Next, we are still waiting on any news about his AP. We received NOA1 on the 16th for all of his forms, including I-131. We are May filers (after having to resend the AOS that was originally from April wacko.png ). Since his Biometrics is done early, is there any chance that his AP and EAD will be approved soon? He will have to go out of the country at the end of July, and we are praying that the AP is approved and sent soon.

    From reading others' timelines and a little research, it seems like the AP will take about 3-5 weeks from the time the biometrics are done. Is this about accurate?

    We filed to the Chicago lockbox, and I believe our AOS was sent to Vermont, if that helps at all.

  9. Just some colleges located close-ish to home in my state, one was an all womens college, one was a medical specifics college, the 3rd was " general " I would say because its in other states. But they all had different requirements and wanted different types of proof for residence. One would let me claim my husbands time living here by using a dated state ID, the others wouldn't. One wanted me to prove residence since date with BILLS in my name from when I first moved here, which was pretty much impossible lol.

    I wish these colleges would be consistant! It would be nice to get a straight answer for once, haha

  10. We mailed out my husband's AOS packet back on April 15th. On the 30th, we received the packet back in the mail with a letter explaining that we had the wrong check amount headbonk.gif *sigh*

    We re-wrote the check, double checked the entire packet, and sent it off express to:

    USCIS

    FBAS
    131 South Dearborn-3rd Floor

    Chicago, IL 60603-5517

    We received delivery confirmation with signature the next day at noon (this is the same address we had originally sent the packet to).

    Now, 13 days later, we still have not heard anything from USCIS. Is this normal?

    Normally, this would not be an issue, but we have found out that my husband must go overseas in two and a half months. When we originally filed the AOS, the timing was perfect for his I-131 to be accepted, given the 90 day processing time. But now, we are extremely concerned about the I-131 being approved before he has to leave.

    What should we do? Would it help to contact USCIS now? I have a receipt number from the original application being returned, but I'm not sure if that's the same receipt number that we keep throughout the process. Should we request an expidited I-131?

  11. I went to the financial aid office (who apparently is in charge of determining residency at our university), and the woman I talked to seemed to know next to nothing about this. All she kept saying was that "he needs to have been a resident for 12 months prior to enrollment." Completely unhelpful dry.png



    That is pretty ridiculous to get three different answers! What kind of schools did you check (private, state)? Ours is a state university, if that helps at all.

  12. Is it possible to get in-state tution for my husband while his AOS is pending? He was an F1 visa holder prior to our filing his AOS.

    Under the state statute, 36.27(2) (cm) "Any person continuously employed full time in this state, who was relocated to this state by his or her current employer or who moved to this state for employment purposes and accepted his or her current employment before applying for admission to an institution and before moving, and the spouse and dependents of any such person, are entitled to the exemption under par. (a) if the student demonstrates an intent to establish and maintain a permanent home in Wisconsin according to the criteria under par. (e). In this paragraph, "dependents" has the meaning given in 26 USC 152(a)."

    My husband came here to be with relatives, but enrolled in an ESL course very shortly after arriving. I moved to this state to be with my family and to find jobs. I started college almost two years after moving, and I have remained continously employed since then.

    Has anyone else been in this situation? Obviously, the school will have to follow the laws for determining residency, but does it just vary from school to school?

    My hubby and I filed his AOS this week! Thanks to everyone who helped us!!

    We had some questions about how the interviews and biometrics are scheduled.

    My hubby will be out of the country for one month in August. Does anyone know how things work if he is out of the country, but gets scheduled for an interview? The nature of his trip makes him unable to return during the month. Is there any way that we can adjust the interview for before/after he is back, assuming the schedule it for August?

    Also, can he go for the biometrics early once he has the appointment letter?

    We did file the I-131 paperwork with his AOS. The i-131 has the dates of his trip on it.

I think the point mentioned in the instructions is that it can't cause you undue hardship to liquidate an asset...like if you listed your cars and your home, then you'd be homeless without transportation, a hardship. When you send in proof of ownership, you might mention it is one of two vehicles..

    Would that be mentioned on a cover letter or additional letter for the I-864 package?

    I had some questions with meeting the I-864 requirements.

    My husband and I are both in college for another year, and until we are settled with our own post-college jobs and incomes, his parents will be continuing to help support us financially at approximately $2,000/month.

    We have no cosigner, so I will be the sole sponsor for my husband. My current income is about $14,000, as I can only work part time jobs with school (I have only been working "real jobs" for the past two years). We have approximately $35,000 in combined assets (cars, bank, etc.). I understand that assets count at 1/3 of their actual value for supplemental income. I also have a good financial aid package including scholarships, but I haven't been able to find out a lot of information as to whether that would count as supplemental income, too.

    Is there a good chance that we would be able to qualify for the income requirement without using his parents' support? We are trying to do everything on our own and I'm really hoping to get through the application process without any snags.

    Everything else is in good status; he has had no overstays and has been here for about 3 years now. We both have totally clean records and everything.

    Any help would be really appreciated!
