    I have a little piece of advice for those waiting on Waiver decisions:

    When I filed for divorce, I was very worried (ofcourse) about alot of things including my immigration status. And as the divorce process progressed, I went on forums trying to study waiver cases based on divorce like mine. Trust me, this is one of the most useless things ever! I worried for no reason whatsoever.. I literally googled "I-751 denied" to see those who were denied and understand what they did wrong. I tended to worry too much, but honestly i see alot of people here worried, too. I know this is a very normal way to feel, but it really doesn't help. I've read tonnnssss of posts relevant to I-751 Waivers. You know what I've found out? There's 3 different categories for those filing waivers:

    1. Those with good terms with their ex-spouse: Usually these cases go very smooth, as long as the immigrant has enough evidence the relationship was real.

    2. Those with bad terms with their ex-spouse, Usually causing the ex to report the immigrant as a fraudster. USCIS isn't stupid, they know people hold grudges against one another expecially following a divorce, so it's not unusual to expect the USC spouse to accuse the immigrant of marrying him/her only for the GC. In such cases, it has to do primarily with the evidence presented by the immigrant, but due to the nature of the accusation, the case also passes through Immigration fraud department. This causes it to take a much longer time than usual, but all the cases (except for 1) that I've read have been approved, atleast by filing N400 application, which forces USCIS to adjudicate (i.e approve or deny) the I-751 on file.

    3. Those who really ARE fraudsters: Obviously no one will post online saying they're a fraud, so I've never came across this kind of case (Atleast online). Mostly posts which talk about fraud are posted by their USC ex-spouse, so it's hard to judge whether or not the case is real. However, these cases are usually accompanied by the accusation of fraud by the USC spouse and will certainly take much longer times.

    I know you think this is crazy, but I actually wanted to have an interview! I was so worried they were gonna deny my case without interviewing me even though (praise be to God) I've had more than 300 pages of evidence. And I thought an interview is my chance to prove my marriage was real.

    If you're worried, sad, etc, please keep the following in mind:

    1. You're a permanent resident.

    2. You're authorized to live in the US

    3. You're authorized to work.

    4. You're authorized to travel.

    5. The time you're spending at the moment is counting towards your citizenship.

    Besides the little piece of plastic's expiration date, are you any different than a permanent resident whose conditions are removed?!

    What's the worst case scenario?

    Assuming your marriage is real ( I have no pity for fraudsters), you have the following outcomes (and God knows best). You either will:

    1. Get approved (no RFE, no interview)

    2. Get RFE, then approved

    3. Get RFE, interview, then approved

    4. Get RFE, interview, then denied

    5. Get RFE, interview, then denied. File motion to reopen, get approved.

    6. Get RFE, interview, then denied. File motion to reopen, then appear infront of an immigration judge for a hearing. Then defend your case, in which the burden of evidence to show that your marriage was a fraud is on USCIS. I havent heard of a hearing that didn't end up with an approval.

    Above all, keep your trust in God, not your evidence. God can do magic far beyond your reasoning.

  2. My case was pending due to pending security check for almost 9 months. It wasn't hard, cause our day to day life was not interrupted by waiting, and we were not stressed as we have nothing to hide. Worst case scenario, they would do a house visit! we would greet them with tea! LOL

    To your questions:

    1) It was one by one with a single interviewer. She told me that that's her style of interviewing and she does that to everybody, as it is safer. That doesn't mean they are suspicious ( I got approved the next day as the approval date had the next day, so I believe they were not suspicious)

    2) We never had an attorney

    3) they didn't check anything. We reviewed our answers in our way back home and we got everything right. The interviewer told us that we will get a "positive" news in about a week and she told us our file is super thick and she needs to go through it one more time. No checking

    4) All random questions from easy ones (what is her birthday) to tricky ones ( when was the last time you went to her parent's house and how long did you stay?) and some easy stuff about our documents, our house, rental history, works, jobs and stuff like that.

    By the way, I got my card, two weeks after approval.

  3. I am not an august filer, but I had my interview at march 21st. It was a stoke interview and we were separated and asked some 30 questions. We got all right, as we have been together for now 4 years. 3 days later, I got letter of approval as well and my case status is still the same, case was received. So I think it is normal. Mine took 16 months from filing to approval. It was mostly pending security check.

    Thanks for sharing these details, 16 months is unbelievable time for ROC applications, I can't imagine how difficult it was for you to wait all this time!

    I have few questions regarding your Interview if you don't mind:

    1) Did they Separated and Interviewed you guys at the same time with two different Interviewers? or it was one-by-one with single Interviewer?

    2) Did you guys take your Immigration Attorney with you at the Interview? If yes, was he allowed to be present with each of you when you were Interviewed separately?

    3) Did they ask same ~30 Questions to both of you, to check if your answers differ?

    4) Generally what kind of questions were they? Specific to the Documents you've or you haven't submitted? Or related to your married life together?

  4. You're right. It was just the only thing I could think of. Unfortunately, when I got home there was RFE in the mail. The online system doesn't show it. They are asking for more proof of our marriage after we moved to California. That was part of the delay in filing is that we sold our house, moved and settled down in California and that was during those 90 days before so I guess our evidence for California was very little. I can now provide more obviously, but some of it is annoying like they want the 2015 taxes and W-2s and we literally just gave it to our tax adviser to file so I'll have to wait to get that back before I can provide it to USCIS causing further delay.

    Also, they want bank statements for 2 other bank accounts showing both our names, but they are in my name only (I'm the citizen). My husband and I had a joint account with a 3rd bank, which I already gave to them. I'll send more bank statements since those. They obviously did a credit check on us to see I have 2 other accounts and gave me the partial accounts numbers for reference. We didn't add him to my existing accounts, we just created a new joint account. Nothing I can do about it now except explain.

    Also, they asked for us to explain if we have lived separate from each other since November 2012, which we haven't. The longest we have ever been apart is 1 week. We are rarely apart, so I think they may be seeing on my credit report other addresses that I could never get removed after I was a victim of identity theft and those addresses still show on my address history.

    The list they gave is pretty long and very specific to us, not a generic list. I think I can give them most of what they want, I hope it is good enough and I'll just have to write a long letter of explanation. They definitely went over our papers in details to pick up on these finer details that I didn't see myself could be misinterpreted as if we moved away from each other or something and maybe they held onto our file until near the end of tax season so they could ask us for 2015 taxes to see if we filed jointly and both us filed as residents of California, etc.

    Thanks for sharing these details with us. It would be very helpful. It's interesting to know what they check and how accurate they are about the things they want from us.

    I would say atleast they got back to you with the RFE, and now you know that once you complete this last step, it's end of that horrible waiting time and you are done.

    I have few questions for you if you don't mind:

    1) From where did they sent you the RFE, and where you need to submit those papers? California Service Center or your Local Office?

    2) How many days they've given you to submit those papers? Did they clearly mention "Submit By Date" or they just mentioned something like "Within XX Number of Days"?

    3) Does the RFE letter say what may happen if you fail to submit those papers within the given Timeframe?

  5. I have his tax return in 2010 that shows the address that we used to live but that was when he was single so his status in the transcript is single. He is getting mad at me so I think I should give him a few more months to calm down then I would ask if he can write an affidavit and/or a 2011 tax transcripts.

    I also know that I can submit the emergency list from my employer. I will submit the list from my current job and my previous job too (if I can) coz I listed him as 1 of my emergency contacts. Trying to think of stuffs to submit to make up the joint bank acct and tax returns wacko.gif . Thanks Everybody!

    I know it's early to ask this question, but I would really appreciate helpful responses.

    My 2 year Conditional Green Card expires on 30-October-2015, hence I'm planning to send my I-751 to Vermont Service Center(VSC) around 07-August-2015.

    By reading all those related forums, I feel that it may take between 6 to 12 Months for VSC to complete processing my application.

    And as far as I know (please correct me if I'm wrong), I can apply for Citizenship (N-400), after 3 Years from my arrival to USA, which is 30-October-2016.

    So if we assume that I get my Permanent (10 year) Green Card after 12 Months on 07-August-2016, how this possible delay is going to affect my Citizenship Process (N-400)?

    Do I have to wait one more year (07-August-2017) to apply for Citizenship (N-400)?

    OR

    Regardless of when I got my Permanent (10 year) Green Card, I can still apply for Citizenship (N-400) after 3 Years from my arrival to USA, which is 30-October-2016?

  7. Hey thought i would pop by see how things went for you ?

    I am still awaiting my SSN and green card.

    But its been 3 weeks since i arrived here on monday coming so going to SS Office on Monday to request one.

    Hey, don't rely on them to send you the SSN.

    I also waited for 3 weeks then I went to local SSN Office (Chicago), waited there almost 3 hours waiting for my token # to be announced, and then the officer lady told me that NVC has not forwarded them my SSN request yet, and usually they dont, that's why she is getting many cases like me who wait for 3 weeks and then go for the inquiry. After that she asked me to file a new appication form right then and there and after that I got my SSN within 2 weeks at my address.

    So dont waste time in waiting for them to send you SSN, I would suggest go to the nearest SSN office very next day once you land in US. And dont throw away the address stub which comes along with the SSN card, it serves as an address proof for approx 90 days, I used it to open my bank account as well as to get my Illinois State ID Card.

    I do not have any official link for these info, but I can share my personal experience.

    My passport was issued from State A ( My hometown ), then moved to State B and spent 6+ months then moved to State C ( Chennai, TN ). I applied for PCC from Chennai using my State A issued passport. I was not required to collect any PCC from local police station. No other PCC from State A and State B. All I got 1 PCC from Chennai PSK. That is it.

    Just want to confirm my situation with you, as I'm also going thru the same confusion:

    Basically I'm from Ahmedabad - Gujarat and since last 3 years I'm living in Hyderabad - AP. My consulate is Mumbai.

    As per NVC guildelines, I've got the PCC from Hyderabad RPO (got both the PCC and it's Endorsement Entry in my Passport), and then went to Ahmedabad RPO to get a PCC from them, but they told me that there is no need to have another PCC as I've already given one by the Hyderabad RPO. They said it's enough for USA visa, and the Indian Government don't issue another PCC unless the current one is expired. (means there is no chance that I will have both PCC's at the same time!).

    So I've submitted my Civil Documents to NVC on 26th July 2013 along with Hyderabad RPO PCC. But didn't heard anything from them as of now.

    It would be very helpful if you can advice if I'm on the right track or not.

    did u submit your police clearance from the passport office. my husband went to the passport office for pcc but they told him he must first change his martial status to married instead of single on passport. so they said we must reissue passport and then get pcc. did you have this problem in india too? did they ask you to change your msrtisl status is? or did they not ask if u are married? reply soon.

    I'm not sure if they ask in India or not as I've already changed my marital status in my passport and then only we've filed the petition. So I got the PCC from passport office quickly.

    I submitted all the documents for DS230 to the NVC in USA.All documents are gonna be verified and returned at the time of the interview. What i have heard from a lot of people is, you can send copies and bring originals at the interview... But I have heard of delayed cases where they send back reqesting for more information. In my case I did get every document before hand and submitted everything here in USA. I am sure, its a good practice to send it to the NVC rather than sending it to the Consulate. Better safe than Sorrry!! idea9dv.gif

    I've already submitted my documents to NVC and they got it on 27th July. As our situation is almost identically same, thought to check with you if I'm on the right track.

    Want to clarify few assumptions:

    1) Now if my documents are found ok, the next step would be NVC will send my file to Mumbai Consulate and will also schedule the interview date?

    2) The "Packet 3" shown on our timelines is the same DS-230 form and Civil Documents I've already sent to NVC? or different?

    3) The "Packet 4" will contain only the Interview Letter and a list of what to bring at the Interview or will also have other documents?

    4) What kind of questions they've asked you in the Interview?

    I had a similar problem ... try calling USCIS and speaking to a tier 2 to find out where it is ... we also got a senator involved .. not sure how much that helped because they didnt get back to us but between the constant phone calls to USCIS and the senator something much have worked because NVC received out file a few weeks ago .. (almost 2 months after we were approved) ... some others on this site have said that some local offices are apparently keeping approvals for extended periods of time in order to send them to NVC in batches.... I hope it works out for you smile.png

    So now it's clear that this delay is somewhat common, we have no other option but Waiting!!

  12. Glad to hear you have both been approved! I still have not received a response to my email (over a month now). But it's encouraging for me to see you have both been approved as you have NOA1 dates close to mine. Hoping that translates to something positive for us. I'm in Tokyo visiting my wife right now and it would great to get some kind of news while we're together smile.png

    I got my NOA2 on 3rd May but even after 1.5 Months, NVC hasn't received our file yet!!

    My wife has mailed them as well as called them multiple times, but they are giving the same answer that they have'nt received our file yet!!

    Is there anyone else experiencing similar delay or there is something wrong with our case?

    I didn't received any reply to my mail till date, but today my wife informed me that our petition is been approved and hard copy of the NOA2 is on the way. goofy.gif

    I've also checked on USCIS site and the case status is been changed to "Post Decision Activity"... dancin5hr.gif

    My wife had a telephonic conversation with the USCIS lady official, and she said now Indian Backlog for I-130 Petitions is getting processed quicker then before, so good news for my Indian friends!

    Still no luck with NOA2, while many others who got their NOA1 after mine, already got their NOA2. :(

    I'm a beneficiary in India and trying to dial the helpline # mentioned in NOA1 - USA ISD code 001 + 1800-375-5283, but it's not reachable.

    There is no NBC email id given in NOA1, can anyone have NBC email id for such inquiries?
