  1. Hello all,

    I passed my interview last Monday! But I do have a question regarding change of mailing address. I asked about this before and people told me I could do that at POE. When I was at the interview, they asked me if I wanted to change my address, so I did the change there. After I received the visa package, the front slip showed that my final address is the new address I provided them.

    However, I logined to DS260 form and the old unavailable address was still there....So I'm wondering if I am safe to pay immigrant fee now (My flight is tomorrow) and the green card will be mailed to my new address.

    ( I think I read somewhere about a lot of people pay for the fee after POE so they can make sure plastic green card is sent to the right address, and if you pay the fee too early, USCIS might start produce the green card earlier and it could be sent to the old address. )

    Any input will be appreciated.

    I have one question regarding change green card mailing address. The address I put on DS260 is no longer available, so I am wondering what the process will be if I want my physical green card be mailed to a new address after I enter the U.S.

    Does change of address on USCIS website work in this case? To my understanding, USCIS change of address only applies when you already lived in a previous address and then moved to a different place. Am I correct?

    Any input will be appreciated!

    Finally there's someone from Taiwan ! On another forum we have a post for Hong Kon , Macau and Taiwan selectees.

    Yes we are likely to see 1000+ CN increase in later months. My guess is that the CN jump will increase more around Mar to May time.

    Once we have the CEAC data, we should have a better idea compared to 2014 CN progression.

    Are you doing CP at the AIT?

    Yup, I am doing CP at the AIT. Hopefully there will be huge increase for the next following months....my friends in the states are getting married next July-ish and I want to be able to attend their wedding after I move there! haha

  4. So is it possible for Asia to have 1,000+ type of jumps for the next few months? When they first published the cutoff number for October, I thought we could go faster this year than in 2013 and 2014!

    My CN is AS67xx........what's my chance to get the interview in April?

    Based on the information I saw on this forum, can I say I will have an interview next May - June? (not sure if I count it right though since the cutoff is kinda different from 2012 to 2014. And what my chance will be like to have an interview?

    I have one quick question and hope someone can help me.

    I have record of 2-month-overstay on my student visa due to H1b application denied. I was just trying to pack everything back after the denial.

    I have a business trip coming in 2 weeks so I went to apply for B1/B2 at US consulate. It was a bit difficult since I'm from a VWP country and they questioned why I overstayed and stuff but I passed. Today I received my passport with 1 month U.S. B1 visa (June 3 - July 2).

    It has a notation on it:

    IBM
    Raleigh, NC
    June 15, 2013 to June 29, 2013
    B1 in lieu of H1b

    what does that B1 in lieu of H1b mean? I am going to attend a training and salary will be paid in my home country (this is written on my invitation letter). Will I get into any trouble when I go through CBP?

    Also, after this business trip (I hope this trip will help to clear my record a bit?), if I want to go back to the U.S. for travel in the future, can I use ESTA to enter the states? (I applied ESTA before I went to consulate interview and my ESTA did get approved)

  7. How can you have "overstayed in the U.S. for 78 days due to H1B denied"? You either were allowed to stay while the application was pending, or you weren't. Whether you were granted or denied shouldn't change that.

    Oh, I probably didn't say it clear.

    The overatay started counting from the day I got denied. I was allowed to stay while the application was pending because it was filed before my student visa expired.

    The denial notice came on October 17 and was waiting for the lawyer to see if we were gonna appeal. Then I started to pack my stuff and sell my stuff like car, apartment lease, etc in order to move back to my country. I left on Jan 3. Hence I overstayed for 78 days.

  8. If you have a boyfriend in the US he may petition for you as a fiance, that is a way for you to go back to the US

    With an overstay and a USC boyfriend, I trust you have strong ties to your country yes?

    To answer your question, you will be certainly asked about your overstay. Do not take the 'it wasn't my fault' stance you pose in this threat. Your status in the US is your responsibility. Consulates do not like the "it wasnt my fault' defence. Own up, tell the truth and explain what happened.

    Thanks. I'm planning to tell the truth anyway but I was just wondering if they would have some sympathy even just a little because the denial was sudden and I was already planning to work in the U.S., but I absolutely agree with your suggestion. Never have that "it wasn't my fault" attitude when I talk to them.

    I do have strong ties to my country because I was offered a full-time job right after I got back to my country (and my parents, family are all in my country). One other question though, I've heard people talking about this online that U.S. and Canada share the information? Is this true? I was thinking if I couldn't enter the U.S. then maybe I can meet my boyfriend in Canada instead. Will this the safer route? Any thoughts?

    p.s. How about H1B route if I can find an employer to sponsor me?

    I was just curious about whether there is any difference for overstay on different visas. I mean, will the consulates treat these overstays differently or they will just treat you a law breaker anyways?

    I overstayed in the U.S. for 78 days due to H1B denied. I entered the U.S. with a student visa, got a job in my grace period, and the company did H1B petition for me, then I got denied because of cap-exempt stuff.

    I'm wanting to know that when I go apply for a tourist visa (since I'm not eligible to VWP due to my overstay), will they forgive my overstay since I couldn't really control it because the denial was so sudden and I had to move my 4 years stuff back to my country and get everything settled/sold before I left the U.S.?

    I mean, I understand if you go to the U.S. with a tourist visa or VWP or a student visa (when you didn't apply for jobs), then you overstay, that's a big no no since you already know when you are going back. I am just wondering will my case be different than those overstayers?

    Thank you for your opinion and suggestion. I need to go back to the U.S. again in May (I came back to my country in Jan) because my boyfriend is there plus my best friend is getting married.

    p.s. I'm still applying for jobs in the U.S. though and hope someone will hire me and bring me back with H1B. But is H1B the only way for me to go back with no problem?

    An overstay or breach of conditions if you had a U.S. visa does not make you ineligible to use the VWP (so long as you did not overstay long enough to cause a 3 or 10 year ban to be imposed, and the ban is still in force) but you may want to avoid the risk of problems on arrival by obtaining a U.S. tourist visa. Of course, applying for a tourist visa does carry a risk of refusal.

    Can anyone verify this statement is true? Since I overstayed on M-1 student visa instead of VWP.

    I'm new to here. And I really need your help.

    Here is my story of overstay -

    I entered the US with F-1 student visa for grad school in 2008 and kept legal status while I was in the U.S.. When I finished my OPT, I went back to my country on time. After I went back to Taiwan, I got a M-1 student visa for flight school and came back to the US for school. I-94 expired on August 24. 2012.

    After finished my M-1, I got a job offer (related to my grad school major) when I was in M-1 grace period. They submitted my H1B application before my grace period ended. Then about a month later, my H1B got denied because of cap-exempt rule. (long story..)

    I started to pack and tried to sell my stuff, contract of the place I was living and my car. Meanwhile, Thanksgiving and Christmas were coming, I thought if I already overstayed since the day after H1B got denied, couple of more days overstay shouldn't change anything. I decided to go back after Christmas because I'm the only Christian in my family and we don't celebrate those big holidays in Taiwan anyway. So I could celebrate these two holidays with my friend and her family.

    I overstayed for about 2.5 months after h1b application got denied.

    I have no intent to stay illegally, otherwise I wouldn't come back to Taiwan after I overstayed. Now my best friend's sister (I'm very close to her family while I was in the US) is getting married in May and I really want to attend her wedding. I'm just wondering what kind of problems I will have when I re-enter the U.S.? Or how can I enter the U.S. without causing any problems?

    P.s. my country just joined visa waiver program not too long ago, and I haven't used it yet.

    My M-1 visa grace period expired on Sep 23, 2012

    H1b application got denied on Oct 17, 2012 (Lawyer told me that we were not going to appeal on Oct 24, 2012)

    I went back to my country on Jan 3, 2013

    p.p.s. I already got a manager job in a big company in Taiwan. Will this be enough to show I have ties to my home country?
