Guys, my PD is June 14 2014. NO2 at sept 14, 2014 and was approved. Been more than a month now and no news. Should I call nvc? Need all the help I can get guys. What are my next step?
Novemner VB - cut off date 1 March 2013. Probably your PD will become current next year Sep, Oct! So call NVC after 1y

Hi -
I am wondering if anyone is/was in a similar situation as we are now. Here's what happened:
1. My brother in the Philippines was petitioned by my sister under F4 category with a priority date of April 1991.
2. Four years ago (2010) the priority date became current so as his agent I gathered and submitted all application documents and paid
the fees to NVC for his family including his wife and 2 derivative beneficiaries/children.
3. One of the derivative benefiaries was only 18 when I submitted all documentations and fees in 2010.
4. The priority date for F4 retrogressed while we were waiting for notice for interview date.
5. While the visa application was dormant I kept communicating with NVC about the status and alerted them to the
fact that one of the beneficiaries wil be aging out soon. Each time they just emailed me back stating that the application
was on file and waiting for visa number to be available.
5. The priority date is now almost current but one of my nephews has aged out (22 years old). Last week I received a letter from
NVC that this nephew has aged out, does not qualify for CSPA and therefore may not be able to immigrate.
Can we contest this decision by NVC given that we already completed all applications and paid the fees back in 2010? Will a lawyer be able
to help make a case for my aged-out nephew to be allowed to immigrate with his family? Is retrogression considered delay in processing
time for this case since we were documentarily qualified in 2010? Any info or help will be appreciated.

yes, your observation is remarkable. you are right!
So can I apply for F2A Immigration for Wife and Kids in separate immigration petition?The answer is YES, you can fill out I130, but no one can tell you what the decicion will be. I mean in the worst case scenario you will lose several hundreds dollars!

that doesnt make any sense and here is my reason why......this category (F2A) was made current back in the summer of 2013 and therefore the NVC has been catching to meet all the filers up to that date. The visa bulletin has been showing sep 2013 as the priority date because thats when they were all out of visa numbers and the backlog started again,,,,,so if all priority dates are current before sep 2013 how can they retrogress to 2012 ?
Do not forgot that cut-off date became current on September 2013 because USCIS did not have enough approved petition and NVC had free visa number. So now USCIS approve more that enough petition and on the other hand lot of people in the USA adjusted their status. What I mean lot of people who were in the USA August and September 2013 married and fill out I 130 and I 485 /I 485 adjustment status/. In the same time Lot of people came in he USA married for LPR. We do not how many people adjusted their status. That is the key!

Panda, if you predict 8 months backwards, the cutoff date wood be 8JAN2013, not 2012
I predict 18 months back!

from 10/2010 up to 12/2011 the VB moved 62 months and the regression was 38 months! My opinion is that I expect around 8 months back I mean cut-off date 03/2012 - 04/2012

Can I ask a question? I filed my i130 on September 11th 2013. Transferred to NBC - transferred to Nebraska - now transferred to local Boston office. I sent all of my original support documents in the original file. Now I am adding the 485 to my file - but they already have the Affidavits of Support and an inch file that goes with it. Will I have to do it again???

Why do you add your I 485 now? You had to do this when you fill out I 130? I do not think you can Adjust your status now /I 485/ I mean the VB must be "current", but it is not!

Never mind. We have very good movement for 10 months - almost 18 months. I will be happy if VB reachs 22/12/2011 in September VB.

She has I 551 since November 2012. She entered in USA November 2012 and left USA December 2012. We are planning to travel back to USA October 2013 so I don’t think she will has any problem on the border because actually by the end of October 2013 sill will have been outside USA less than a year. But I just wondering why they didn’t take fingerprint from my daughter when they issued her Immigrant visa October 2012 in US embassy in Europe and now they asked to take it.
Maybe it’s a good idea to travel couple months earlier, I mean when we receive the letter from NBS just to take the plane for USA and go the defined date for fingerprint.

My husband and our daughter became LPR November 2012. We found that our daughter’s family name was written wrong on the Green Card so on 17 January my husband filled and sent I 90 form to replace the Green Card. On 02 May 2013 National Benefits Center sent Fingerprint and Biometrics Appointment Notice for our daughter. We still haven’t received the letter and don’t know the date, but I and our daughter is outside USA till October. Please give me advice what to do? Should we try to reschedule?

im in the same situation..but do we have to file another ds230 for baby and 400$ fee if mother case is already completed.
When you inform NVC, the name of your child will appear on web site of NVC with option for pay the fee /in 2012 My husband paid 404 USA for our daughter, after that you have to fill DS 230 and the sponspr have to fill new Affidavit of Support/

I agree, 2.5 months is not that big of a big jump, but that's not really the issue. The problem is the fact that the VSC stopped approving F2A cases last year and their processing time got stuck at January 2011 for over a year. Consequently there are loads of people who will be current next month but who cannot be given a visa number because their cases are not completed yet. Once they are through the NVC process they will need visa numbers and there may not be enough to accommodate everyone and move the cut-off dates forward.
On a positive note, as I said before, the possible retrogression won't be very severe, and the cut-off dates should recover fairly quickly afterwards.
Indeed, someday there will be regression but I do not think it will be this year.
I've got a question: How did you find information about the number of cases received VSC after January 2011?

Yes, there's definitely a good chance that we'll see retrogression in the coming months, but it's impossible to predict when it will happen and how much the dates will go backwards. I would think that we may see some good movement in June (since the VSC filers will in all likelihood not complete their cases on time for being scheduled for a June interview), but thereafter the cut-off date movement could slow down, stop or retrogress. Since the VSC was stuck at 23 January 2011 for so long, I would say that everyone with a PD prior to that must have completed their cases ages ago, and the furthest any retrogression would go to is 1 February 2011.

I do not think that 2.5 monts is a big movment so I don't expect retrogression. If may VB show cut-off date 01.03.2011 that will be movement 9 monts from the begining of the fiscal year - 01.10.2013 and that is not a big jump. Base on the previous years I think the movment for the fiscal year will be 16-17 monts

Hello.
My daughter and her father received their permanent resident card green December 2012. They also took their social security number. They came back in Europe January 2013 and we found a mistake in the surname of my daughter appears in the green card. It is written „......” instead „......” / USCIS just have missed the last letter/. So we sent back GC to replace. I understood that the proces of replacement will take up to 10 months. My question is that: Can my daugther travel back to USA only with І 551 stamped in her passport If she does not recived her corect CG?
