  1. Now you know that you don't need to go after the waiver. You can file to adjust status while inside the USA.

    Moved from spousal visas to adjustment of status from work student tourist as the OP does not need to file a spousal visa and can file adjustment of status inside the USA.

    so I can fill out the form even if my visa expires two months ago, I mean that there is no time limit to start the paperwork?

  2. I'm Monica and I have been in the U.S. two years ago through the J1 visa which expires soon.

    I'm getting married in couple months so I'm reading about the procedures to apply for green card and the first step says "J1 Visa holders will almost always require a waiver and Should Consult With An immigration lawyer or the USCIS for more information"

    I wonder if anyone knows or knows of this case, if you could help me.
