  1. My husband visited twice on his B2 after we filed the I-130. He had no issues at the POE. He had plenty of evidence of ties to prove he would return after a short visit - but none of it was ever requested. I concur that you should have your ticket booked for when you plan to return - or at the very least, tell the officer you have it booked for this date but may extend - but will not stay longer than 90 days. You need to leave before the date that the officer will stamp on your passport.

I have no specific knowledge with regards to your questions, but wanted to share our experience: that it is definitely a possibility that you will be granted entry - my husband was after we filed the I-130.

    Good luck!

  2. My husband had his interview yesterday. While at the interview the CEAC status changed to "Administrative processing." He was told that everything was fine at the interview and told to come back on Tuesday to pick up his passport. After the interview CEAC status went to "Ready" (with the language about it being ready for an interview).. and then today it is back to "Administrative Processing." Should I be concerned? Please help! Thank you!

  3. Any way your boy friend can increase ties to his home country (maybe start a degree program for which he has to return.. something along those lines) and reapply? Just a thought - though I'm not sure as to how good of an idea it is. He could get a letter from an administrator stating that he is enrolled and is required to attend in person.

Also, my now husband told them he was coming to visit me when he applied for his visitor visa - they asked him if I was his fiance - to which he truthfully replied no. If they asked if I was his girl friend - he would have said yes and I don't know what the outcome would have been. He visited me 3 times - once pre-engagement, once while we were engaged and once after we were married - had no issues at POE. So, maybe it is an option to tell them he wants to come here to spend time with you and meet your family. Maybe that's a bad idea - unfortunately it is all so dependent on subjective judgment of the interviewer.

And, I totally understand your frustration with feeling the need to expedite things when you may not have done so in other circumstances. We also considered one of us taking 6 months off to spend with the other - but neither of our jobs/obligations allowed it. Good luck...

  4. Hi all,

Please respond if you anyone with knowledge is around. My husband is at his interview - his interview time was 45 minutes ago. I just checked the CEAC website and it says "Administrative Processing" - full text below. Does this necessarily mean that the visa was not approved??

    Text (Status updated today):

Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days. Under the U.S. Immigration and Nationality Act, Immigrant Visas for "Diversity Visas" cannot be issued after September 30th of the year in which you were selected to apply for a Diversity Visa. For example, entrants into the Diversity Visa Program in Fall of 2011 were selected for Diversity Visa 2012 Program, and selectees MUST apply and receive their visa prior to September 30, 2012 otherwise they lose eligibility to receive a Diversity Immigrant Visa, regardless of additional administrative processing. In addition, please note that some immigrant visas may not be able to be issued if the annual numerical limit for that category has been reached.

    Thank you!!!
  5. HI everyone, I'm just starting my application for the IR-1/CR-1 for my husband, but have been reading posts for about a year now! We are just about to put our I-130 in the mail, but we were starting to wonder about the holidays. Is the beneficiary allowed to visit the USA on a tourist visa, with the intention of going back to his home country after the holidays, while our IR-1 is pending? I'm sorry if that is a basic question but I have been confused by the information I have been getting and just want to make sure we are not jeapordizing our visa. Thanks!

My spouse was issued a multiple entry visitor visa prior to our engagement. He has visited several times after our engagement and subsequent marriage (and, after the I-130 was filed). Each time he had evidence of a strong intent to go back after a visit. He has returned every time after a few weeks and has never had a problem at the POE (he has visited twice after the I-130 was filed. Obviously, he could have been denied entry at the POE.

  6. Hello nice members,

I have a question and I need your opinions on this.

When do they legally or logically start requiring 2013 Tax papers/returns instead of 2012?

I am asking this because it is quite possible that my case will be completed by the end of November. But, we will not have an interview until late February or early March 2014. As you know, the deadline for filing tax returns is until middle of April. And our sponsor usually does it late.

My logic is that they cant ask for 2013 tax papers before the deadline. But I am kind of worried about it. Does any of you nice people have an idea ot heard something on this subject? When would they require you to have 2013 tax papers as the most recent one assuming you get to the interview in early March?

    Really appreciate your inputs.

    Cheers,

    Sol

As long as your interview is before April 15th of 2014, I wouldn't worry about a return for 2013. If by some chance they want you to bring in a return for 2013, they should list it on the interview letter (giving your sponsor plenty of time to file). However, I highly doubt they can require a tax return before it is due. Good luck.

  7. Hi, I'm not sure I have the right answer, but this is what I did. You cannot file single - you are married. So, you can either file married filing jointly (apply for ITIN) or married filing separately. I didn't apply for an ITIN for my husband, so I filed married filing separately (for 2012) and intend on amending after my husband has a social security number. When filing married filing separately - you cannot file electronically. You file by paper and put in "NRA" (non resident alien) in the space where they ask for your spouses social security number. If you get an ITIN it is "probably" a tax benefit to file married filing together (just a thought - this is not tax advice!!!).

    Good luck!

  8. Hello everyone!

I have a question to people who got their case number from NVC. Did everyone of you got an e-mail with the case numer? Or maybe you got it only by calling them and never recive an e-mail? I wonder if it is just a sense calling case the line is always busy. Maybe it is just better to wait for an e-mail or just send them e-mails with request?

In my case - I got the email 2 days after the numbers were generated (I got them on the phone the day they were generated). I couldn't pay the AOS Fee until the day I got the email with the relevant numbers though - so I didn't gain any time by calling. However, it definitely made me happy and I was prepared to pay the fee and send in the AOS package the second I was able to pay the fee online. Good luck!

  9. Hi all, question for the experts:

On my interview letter some items are marked as "O" and some as "Y" - but the explanation for both is the same (The NVC sent this form or document to the U.S. Embassy or Consulate). What's the difference between "O" and "Y." Is it that O is original and Y isn't?

For two of the items - the passport and the photographs - I know the actual passport and additional photographs need to be taken in. I'm just wondering if "Y" means something more .. i.e. whether I need to provide more financial evidence. I (the Petitioner) submitted all the required financial information (3 years of tax returns, pay stubs etc.) - is there anything else I need to have my husband take in? New pay stubs? Please help! THANK YOU.

  11. Tracking this way is from NVC to your embassy.

    I didn't find any shipments from NVC to Sri Lanka embassy for the 15th ( EXP 11 OCT 2013A ) Today 10/16 is written ( EXP 14 OCT 2013A ) Tomorrow 10/17 will be written ( EXP 15 OCT 2013A )

Thanks. I had just looked again before I saw your post.. and found what I pasted in below. Can this be it? Though maybe not - since you say EXP 15 OCT 2013A is for tomorrow.... If this is it -the mailing date is the 16th? (so I can confirm with NVC as to when they mailed). THANK YOU.

  12. Happy for everyone in October who already have an interview date. Looks like I am the only one still waiting for an interview. I call NVC everyday and no appointment yet. Should I be doing something else? Does anyone know how long it takes to get an interview for Ciudad Juarez?

I'm no expert.. but I don't think there's anything you can do at this point. I was expecting to hear back at the beginning of November (based on studying general trends - there wasn't much information for Sri Lanka). Was completely surprised to hear back today - maybe something opened up in Sri Lanka.

    Good luck! Hang in there!
