  1. Employers only allow yourself and your spouse and children, parents cannot be covered.

I did read through that link above by ebunoluwa where they got the parents insurance through healthcare.gov and the premium tax credit for $100/month, but the argument is whether that is something that is allowed according to the IRS or not because of the following line in red:

    5. Who is eligible for the premium tax credit?

You are eligible for the premium tax credit if you meet all of the following requirements:

    • Have household income that falls within a certain range (see question 7).
    • Do not file a Married Filing Separately tax return ((unless you qualify for a special rule that allows certain victims of domestic abuse and spousal abandonment to claim the premium tax credit using the Married Filing Separately filing status (see questions 9 and 10));
    • Cannot be claimed as a dependent by another person
  2. What if i don't claim them as dependents? I'm confused about the line that i highlighted in red below, it's from irs.gov regarding the premium tax credit. I know i can claim them as dependents but what if i don't and they just file separately as a married couple, will they be eligible?

    • In the same month, you, or a family member:
        • Enroll in coverage (excluding “catastrophic” coverage) through a Marketplace
        • Are not able to get affordable coverage through an eligible employer-sponsored plan that provides minimum value (see questions 11 and 12)
        • Are not eligible for coverage through a government program, like Medicaid, Medicare, CHIP or TRICARE
        • Pay the share of premiums not covered by advance credit payments
  3. I have read too many topics discussing this but i haven't found a clear answer, maybe i missed something and someone can help out.

Long story short, i'm bringing both of my parents to the states and I want to make sure that getting them health coverage will not cost an arm and a leg.

    1. They are 65+ but i know they won't be eligible for medicare because green card holders are not eligible for it.

    2. They won't have any income.

    3. They will be living in my house.

I have read that they can get health coverage through healthcare.gov and be eligible for premium tax credits but it's a grey area because some people said that they can only get the premium tax credit if I don't claim them as dependents when filing taxes and others has said that it's not true, whether i do claim them as dependents or not, it wouldn't matter and they would not be eligible for the premium tax credit since i CAN claim them as dependents.

Can anyone give me more info?

Will they be able to get health coverage for maybe around $100-200/month per person? or is it going to be $400+/month per person?

    Thanks,

  4. Hello everyone,

I was wanting to check if anyone knows whether there's a time limit to pay the IV bill. I paid the affidavit of support fee for my parents already and the IV fee got invoiced, but unfortunately my mother needs medical attention for a few months and since she is in canada, she is well taken care of and healthcare is free. So if i delay paying the IV bill for a couple of months or so, would that be an issue?

    Thanks in advance.

  5. Yeah for some reason they were not able to get my dad's fingerprints digitally so they used ink and i'm hearing it takes months, I told them to go to the local police station and ask for a CPIC check using the name and date of birth and they were referred to the RCMP again for fingerprint scanning. Not exactly sure how I can be helpful from the states but oh well.

    Thanks for the replies.

  6. Hello,

I was hoping someone has gone through the process of bringing their parents residing in canada to the US. If so, do you know what type of police certificate to request? my parents went to the RCMP (royal canadian mounted police) and they had their fingerprints scanned which will take some time to process due to unexpected delays, however i heard about something called a CPIC check, which is a name and date of birth check and not requiring any fingerprints.

Am i getting this correctly or is the fingerprint check required? do they need the CPIC check? if so, where do they go for that?

    Thanks,

  7. sorry i meant DS-261 agent form.

    I'm the petitioner.

The first question was to put in the case number and invoice number and whether i'm the applicant or petitioner so i chose petitioner and filled out the form.

The last question was "Did anyone assist you in filling out this application" before signing and submitting. I have the option to choose Yes and provide information or just choose No and submit.

  8. Hello!

I'm trying to submit DS-261 as the petitioner and the last question i am being asked before signing is "Did anyone assist you in filling out this application".

Do i choose No, even if i'm the petitioner filling out the application. Or do i choose yes and put my information again? Or do i just choose that i'm the applicant when first starting to fill it out?

    Thanks,

  9. Hello VJ!

I just received the instructions from NVC with the next steps for both of my parents and i have a couple of questions regarding the case numbers and the AOS fee and hopefully someone can answer them for me.

    1. Each of my parents have been assigned a separate case number... is that how it usually is or should both my mom and dad have the same case number?

    2. I was reading somewhere that the AOS fee of $120 needs to be paid only once per case unless the cases are joined. So do i need to pay $120 for my dad and another $120 for my mom? or do i need to have the cases joined somehow and pay $120 only once?

    Thanks in advance!

  10. Hello everyone,

I have been reading about the NVC process in these forums but i wanted to make sure that i'm not missing anything and maybe someone can answer my questions.

So basically I received the NOA letter from USCIS with a notice date of march 30, 2016, stating that the I-130 application was approved and transferred to NVC for both of my parents and that the NVC will contact the beneficiary with the next steps, which makes me wonder:

    1. Am i not going to be contacted or receive the instructions as the petitioner? My parents pretty much can't be handling any of that with the language barrier and i wanted to be the one who handles everything up until the point they would have to go to the interview.

    2. The things i've been reading on the forums state that i should be calling NVC to check if a case number has been assigned and if so, ask them for the case number and Invoice Identification Number and also says not to worry about asking for the Beneficiary Identification Number because it's no longer needed. Is this correct? and also does this relate to my first question and allows me to handle the process instead of my parents?

And as far as the next steps, are these correct and in the correct order?

    1. submit ds-261

    2. pay IV fee

    3. pay AOS fee

    4. submit ds-260

    5. mail supporting/financial documents to NVC.

    Thanks in advance!

  11. Hello everyone,

I just sent both I-130 applications for my mom and dad to USCIS and I thought I'd start gathering the documents needed for NVC. I needed to check with someone who has successfully been through the process and make sure I got this right and I'm confused whether the supporting documents that are needed to have my parents come to the states will need to include mine as well or do I, being the petitioner only need to be concerned about gathering the financial documents (tax transcripts, pay stubs...) for the AOS.

    SUPPORTING DOCUMENTS:

    1. Birth certificates: I need to send the birth certificates of both my mom and dad correct? or do I also need to send mine? I already sent mine with the I-130 applications.

    2. Marriage certificates: I need to send the marriage certificate of my mom and dad correct? or do I also need to send mine? I'm divorced.

    3. Police certificates: I need to send police certificates of my mom and dad correct? if so, does it need to be from the country of nationality or from the country they currently are residents of?

    4. Photos: I need to send photos of both my mom and dad correct? or do I also need to send mine?

    5. Biographic data page of passport: I need to send this passport page of my mom and dad correct? or do I also need to send mine?

    Am I missing anything?

And finally, are my parents supposed to send the documents to the NVC or am I sending them as I am the petitioner?

    Thanks in advance!
