  1. Ok..here is the deal...I sent in all the documents including my original birth certificate and marriage certificate to NVC. This morning I get a checklist stating that they need my original birth ceritificate and marriage certificate. What do I do? Did they lose it? I would have to go back to my country in order to make new originals, I am sure they r not going to make another one without my presence! I am so so so stressed....

    Any help would be much appreciated!

    1.) Contact your U.S. Senator or Representative. They will have someone specifically assigned to immigration issues in their state offices--don't call the Washington offices; from personal experience, they'll just assign you to the Senator's or Representative's local reps. OR...

    2) Reply to the address where the requested information was supposed to go explaining that you have already submitted the requested documents.

    3) A couple of questions for you: You did send the documents via certified mail, return receipt requested, right? You have the receipt for when they signed for the documents, correct? If you did not do this, they might not have ever received them.

    4) Our I-130 was lost at the Nebraska Service Center. Our Senator's local representative who has an office where we live, contacted CIS via email and, at his urging, CIS searced and found the documents. So, the first suggestion may be the quickest.

  2. Cristina is a citizen! The Oathtaking Ceremony was scheduled for 11:30 a.m. today. It was at the Federal District Court in Lincoln, Nebraska, only blocks from our home! It took about 2 hours and she was part of a group of 38.

    The judge's remarks were outstanding, emphasizing that most American born citizens have roots in immigrants who came here years ago. They are the ones who built our country into what it is today.

    Done with Homeland Security for good! And relieved! And happy!

  3. Cristina had her Naturalization Interview this morning in Omaha at the Homeland Security CIS office--actually located in Carter Lake, Iowa.

    We arrived around 9:00 a.m., turned in the interview letter and waited. Her appointment was set for 9:15 a.m. and the interviewer called her at approximately 9:35.

    She was sworn in and asked for her Permanent Resident card and drivers license to verify her identity.

    She was asked if we still lived at the same residence and if she still was employed at the same business. Affirmative to both questions. She asked her to name her husband--that is me :dance: . She looked at the files in our application, two big stacks. She used a check list to mark each thing as she reviewed the files and asked questions.

    Next she asked if she wanted to take the old civics test or the new one. Cristina opted for the old one since she had studied only those 96 questions. The interviewer looked at a copy of the test and went through 10 questions. Cristina got 100%. She was then asked to write an English sentence: "The color of the stars on the flag is white."

    She also was asked if she would volunteer to defend the country. Of course she said, "Yes".

    Cristina said she had documentation but the interviewer said her file was in order and nothing additional was needed.

    That was all. She gave a paper, N-652, Naturalization Interview Results, which shows she passed the English and U.S. history tests. The A) box is checked: Congratulations! Your application has been recommended for approval. At this time it appears that you have established your eligibility for naturalization. If final approval is granted, you will be notified when and where to report for the Oath Ceremony.

    This only took 5 minutes!

  4. Hello Everybody,

    My wife will receive a 10 years Green Card in the mail within 3 weeks from now. :dance: I was wondering which process to file after she receives her Green Card.

    1.) Does she has to apply the Remove the Conditions of Residence(Form I-751) within the 90 days on the 2nd year from the date she got her green card?

    2.) Can she skips the Remove the Conditions of Residence process and applies for the US Citizen (Form N-400) after 3rd year of our marriage?

    3.) Does USCIS gives K-1 visa holders a 10 years Green Card? I thought K1 visa holders are suppose to receive 2 years instead of 10 years. I was hoping I am wrong. My wife came here with a K-1 visa and I don't understand why she will receive a 10 years Green Card.

    Conditional Permanent Residence is granted with a two year card--unless the visa holder has been married for more than two years, in which case a 10 year card is given. She would not need to apply for something she already has--apparently she is without condition because the 10 year card is without condition.

    She may only apply for U.S. citizenship 90 days before attaining the third anniversary of her permanent residence.

    I don't understand why the 10 year card either.

  5. Sent N-400 July 2. Received July 3....since we live in the city where the so-called Service Center is. Biometrics appt. July 31, 10:00 a.m. in Omaha. Hoping for a September interview by the way things seem to be going for other filers.

  6. I was told that Casablanca does not need the I-134 for a K1 visa anymore. So I did not send it to my fiance. Please let me know if anyone filing in Morocco knows the answer to this. He will receive this packet sometime soon and I need to get this to him if he does.

    It really pays to listen to those who have been through the process and have learned from experience. When my wife came her on a K-3 Visa, we were required to submit an I-134 Affidavit of support. The Affidavit is still on USCIS's website and it is required as far as I know. It is required. According to the instructions for the I-134, Affidavit of Support, you can use a letter from a bank officer identifying when account was opened, current balance and deposits made during the past year. As far as income is concerned, include copies or certified copies from IRS of your Income Tax forms. You should also tell INS you will have a new job soon and have the prospective employer provide a letter stating date and nature of employment, salary paid and wheter the job is permanent of temporary.

  8. I am just applying for husband. I just read in a post here that someone called USCIS and they said its not fee. So would you send without fee? I just find that really odd.

    Assuming that you are submitting the I-129 as a K-3 petition, there is no fee according to the instructions for the newest I-129f here http://www.uscis.gov/files/form/I-129Finstr.pdf . Please note that this petition is sent to the same Service Center where your I-130 is being processed. It is important to get that right! You will need a copy of the I-130 Notice of Action, NOA 1, to be filed with the I-129f.

    It depends, of course, on the individual case and what your expectations are. We wanted an I-551 stamp in her passport and that is what we got.

  10. :help: Does the foreign spouse really needs the copy of the I-129F and I-130 when the time comes that the I-129F is approved? Does the US embassy of the foreign spouse where she lives need it? Is it really needed during the interview?

    No to both questions. They will have the original petitions sent to them by NVC.

  11. When you send back the requested info for an rfe...do you receive a receipt back,or any sign that they have received it? I mean,aside from using a tracking # to be sure it's been sent or signed for (although both the rfe's i got,had to be sent to a PO box so i couldn't get tracking info)

    Using the receipt number from the receipt you received after submitting your AOS petition you can check the status online at USCIS'a website. It will state the information has been received.

  12. Really stupid question, I know, especially since I've been in this process for so long, but how do you see if your application has been "touched"? All I see when I check the case status online is "Card Production Ordered"

    Since card production has been ordered, your application is approved. It is probably not going to have any more touches.

  13. Well, the good news is that we got our NOA1 today. The bad news is that we also got the Biometrics appt. letter and we're going to be out of town on that day :( If we try to reschedule, will it delay everything? Has anyone re-scheduled before?

    It is quite common to reschedule. Many have done it from what I've read on VJ. Since card production is in the distant future from when you file, the only delay would be for processing fingerprints for identity checks by FBI, etc.

  14. After you submit your I-751 application, you will receive an NOA that extends your conditional GC for one year, and you are work and travel authorized during that period.

    Usually, the 10-yr. GC arrives prior to the year extension.

    Really? Do you have some statistics showing that is true? Ours took 7 months almost to the day. That is the more likely scenario for most service centers now. There have been exceptionally fast approvals, but, from reading others' experiences here, seldom does the 10 year GC arrive before the 2 year expires.

  15. I just received my card in a mail....If you’re in customer service you should be ready that even you don’t like something about the customer or you having a bad hair day you can’t show it off. Can you imagine going to your bank with some questions about something you don’t understand and your banker raising the voice just because you don’t get his explanations the first time? I bet you will never come back to that bank. The difference with USCIS Customer Service is that we don’t have any other place to call with our questions. Even if the customer asking stupid questions your job as a customer service representative is to give the customer the correct answers and educate the person without showing any expression of anger....Why sometimes the USCIS Customer Service is what any American would find unacceptable?

    Everybody has his own opinion and I respect it. But just think of what I wrote above. Would you come back to that Bank or Grocery store?

    Congratulations! I agree with your discussion regarding customer service. I would not return the a store if treated badly by a rep. But, as you say, immigrants have no choice as to where they 'shop'.
