    Both of my parent's interview has now been scheduled by NVC. Although the case status for my parents in CEAC still says At Nvc, I randomly called NVC yesterday and they mentioned that the interview for both my mom and dad was scheduled within the last 1-2 days for April First week at Mumbai Consulate.

     

    The last communication I had from NVC was on Feb 11 (via email) when I got 2 communications that all documents have been accepted and will let us know when interview dates are confirmed.

  2. Hello All,

     

    Apologies for the late update on this. I got an email from NVC last week that they have accepted all the documents for my parents and are currently waiting for an interview slot at the Mumbai consulate and I will be informed accordingly.

     

    Because my parents were born prior to 1970, I did not have their birth certificates and the following are the documents I sent.

    For both parents - sent sets for each parent separately

     

    a) Self declared affidavit that  he/she does not have birth certificate as she was born prior to 1970 and birth registration was voluntary and not mandatory at that time so she is submitting the following as proof

    b) Notarized affidavit from some older relative that he/she was present at time of my mom/dad birth and is fully aware of her. included parents name

    c) copy of school leaving certificate or matriculation certificate (translated if not in English)

     

    In the mean time I was also able to get the Non Availability of birth certificate for my mom but i did not submit it. because for my dad we had to go to a rural place and i didn't bother going that route.  The above sufficed so i guess we are okay now.

     

    Waiting for Interview Scheduling date confirmation from NVC now.

My mom's I-130 is showing as approved on DHS site, but still showing Case Received on the egov.uscis site. Dad's is showing Case Received on both, so there is still a bit of wait in front of me. And of course, I need to receive both approvals in mail. But thanks very much for sharing the link.

    Hey adar24, did you create 2 separate accounts for both your mom and dad's i130. because i assume we have 2 different case numbers.

    No. they will contact you. you will get a letter in mail first about your NVC case number. then you can opt in to send all further documentation through email.

    Parent's address dosn't matter. All the doucments are taken care of and sent to Beneficiary. You will need to send i864 and other documents.

     

    I will be doing email processing of NVC.

  6. Hello my parents are at NVC stage and i need to provide proof of Birth Certificate.

     

    We tried getting the Birth Certificate made but the local SDM wasn't that supportive as getting Birth registered for births prior to 1970 was voluntary.

     

    Can someone please share the draft affidavit to proof birth certificate. That can be made by my father's elder brother and mom's elder sister.

  8. Good News! Got the NOA2 approval for both my mom and dad today in mail. No text notification. Was expecting something in the mail like everyone else. Off to NVC stage now.

     

    Can everyone please update their dates in this table.

  9. In my honest opinion, I would not rely on the Option 2 (the approach that worked for me). I had no option out and had to get the GC as soon as possible as I already had a job lined up. So all i could do was bleg and plea the officer to see if he would fix / correct it.

     

    In your case, if the appointment for the visa is soon, I would propose to re-schedule it and work with full throttle to get the names in passport fixed in India. My parents in delhi were able to fix that in a week.

     

    Remember - the source needs to be fixed - The Passport.

    Here is the answer you need. Like Boss!! lol

     

    Your relative's passport (Indian of course) has 2 sections - Given Name and Surname. Let's assume your relative's name is Akshay Kumar. Check your relative's passport how is the name written on it. I'm sure on the Given name section, the entire name is listed - Akshay Kumar and Surname is left BLANK. Since US needs a last name, they don't know what your relative's last name is. EVen if you provide clear first name and last name of DS 260, i130 etc etc, US at the time of issuing VISA (after NVC) will only use the Surname from PASSPORT. if the passport has no Surname listed, then they use the entire name as last name, and your first name then becomes FNU (First name unknown). So based on my example, the visa of your rleative will be issued as FNU Akshay Kumar. It does not end over there, the GC, SSN, Bank accounts, DL all use the name on the Visa which will have FNU. Its a pain. been there done that!

     

    To correc this, you have to get the source corrected which is the passport. I had to get that done for my parents and my brother before they even applied for their visas. But for my GC I ended up with FNU, Akshay Kumar on it. To fix this what i did was (at the time of first entry into us on GC, remember first) I requested the immigration officer who was finalizing my entry to please correct this in the records. he was nice enough to file a petition for me to correct the name. I showed him other documents like my birth certificate, license etc that clearly listed out my first name as Akshay and last name as Kumar. It required a lot of convincing from my end to get him file a petition but he did. In all cases, the USCIS has the right to cancel /deny the petition as the source - Passport needs to have a Surname listed on it.

    I just sent in 2 I-130s for my parents yesterday with the basic requirements for the form I130 i.e My birth certificate for Mom, and My parents marriage certificate and my birth certificate for dad. I know that during the NVC stage the birth certificates of my parents would be required, but here is the issue

     

    My parents  (both) were born prior to 1970 in India therefore they do not have a birth registered, they never needed one. What are the documents that will help me get through NVC successfully. Somewhere it says to submit the non availability of Birth Certificate and secondary evidence, but I also read that we could get away with just sworn in affidavits

     

    Can someone please help who may have recently gone through this process.

    864 form is submitted at the NVC stage, So once the i130 has been processed/approved the application goes to NVC stage. at the NVC stage the petitioner has to submit 864 or 864a to prove that he is capable of sponsoring the beneficiary in terms of funds etc. also NVC request other documents like birth certificate, police clearances, other documents for the beneficiary. the NVC takes all these and then once processing there completes the application goes to the consulate (in the region where the beneficiary lives) for processing. 

     

    the form I693 - Medical form is something that the doctor fills out during medicals (prior to actual interview as medical examinations have a limited time validity) and sends it directly to USCIS or hands it over to the beneficiary in a sealed envelope which is opened by the USCIS officer at the interview. Again I'm not an expert but this is all for consular processing and the way it was followed when I was going through my i130 through consular processing. If you are petitioning someone who is already within USA, I am not an expert in that regards.

    If you are sponsoring for your parents and they are already in the US on some sort of Visa then i1485 is required. If they are outside of US and will do consular processing from outside, then 485 form isn't needed. Also I-131 is for Adavnce Parole, required if your parents need to travel outside of US while their I130 is pending and have ALSO filed I485. This doesn't apply if parents are already outside of US and doing consular processing. 

     

    G325a is not for parents. It is only for spouses. and let me correct that, they have retired g325a and now for spouses only you need to submit 130a. No i130a for parents.

     

    FYI - if your parents are already in US and you are foling i485, you can also file i-765 ( i believe the fee is included) so that they can get work authorization
