  1. Hello,

    I am a US citizen who has been married to a Japanese national for 12 years.

    We lived in Japan together for our first 11 years of marriage.

    My wife got her green card in 2014 and we've been in the US for a year and a few months.

    Sadly, things just aren't working out the way we hoped and my wife wants a divorce.

    I am her sponsor on the 1-864 and I don't plan on revoking or altering my responsibilities.

    However, I am planning on moving back to Japan where I was happy.

    I'll be moving back next month to start a new job.

    My wife will stay in the US on her green card.

    Strange, I know, but this is how or lives are working out...

    Questions:

    Do I need to file a I-865 (change of address) when moving overseas?

    I would send this to the USCIS - Nebraska Service Center?

    My wife will need to do the AR-11 when she moves, is that correct?

    Anything else I should be concerned about?

  2. jeffinjapan, what is the status of your papers, did you go with what maeve808 had adviced ? You did put all $0 ?

    I did put zero for all three years, but I got the following checklist today:

    I-864, Affidavit of Support Checklist

    [x] The NVC recently completed our review of your visa case. While you meet the minimum qualifications for a visa interview to be scheduled your Affidavit of Support contained one or more sections with missing or incorrect information. Please review the additional instructions below then complete a new Affidavit of Support. (You can download the I-864 form and instructions at http://www.uscis.gov/i-864.) Once you have completed the new Affidavit of Support, please provide it to the principal applicant to bring to his or her visa interview. Do not submit your new Affidavit of Support to the NVC, as doing so will reopen your case and cause processing delays.

    [x] In Part 6. Sponsor's Income and Employment, please correct the following...

    [x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal

    income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

    ###

    They didn't say anything about 2012 or 2011 though!!! So confusing!!!

    I have another thread open on the issue and I'll post here when I get everything figured out!!!

    As stated above, I wrote "0" for all three years because I earned exclusively in Japan. After much research, I still kinda believe that that is the correct answer, so I wonder if we just explain that at the interview?

    If they are expecting a different number, I'm not sure what to write from my IRS transcript. It says a negative number for Total Income. There is also a line for total income per computer that has a positive number.

    I wrote "0" for all three years, but they only asked about 2013. Strange...

    Any advise would be greatly appreciated!!!

  4. We got almost the same email checklist as the OP this morning!

    I need some help and or clarification if possible!!!

    Our case is going to be scheduled for an interview in Tokyo, but they said 13.a.1 was wrong and that we need to bring a new I864 to the interview that matches the tax transcript for 2013.

    I wrote "0" for my total income for all three years, but didn't explain that it was excluded as foreign income. Perhaps that is the problem?

    Do we just explain that at the interview? It seems to be what the OP did, right? They just need to know why it's zero?

    Or do I need to write a different number for the transcripts? I'm having a hard time figuring out them out!!!

  5. My wife's visa is nearly complete, so I've been thinking ahead to our move back to the US.

    We hired Nippon Express, one of Japan's largest courier and moving services, to ship most of our stuff back. They can't ship until we have tickets, but that's no problem.

    My question is about the customs forms you fill out in the airplane. I remember that it asks about unaccompanied baggage. I imagine that since we are shipping most of our belongings, that we would answer yes to this question, right? If so, do we need to prepare any special forms?

    Perhaps everything is handled by the shipper?

    If somebody knows, it would put my mind at ease!

    I'm a US citizen that has been living in Japan for 12 years and married for 10 years.

    Finalizing the I-864, but have some questions about Joint sponsors!!!

    (I actually filled out a I-864A for my mom since we want to use her income and assets to meet the required level, but learned that she really needed to fill out a I-864 as a joint sponsor! Phew!!!!)

    Here are my final questions!!!

    On my Mom's I-864:

    Part 1.

    -- Question 1.

    She would click 1.d. correct? She is the only joint sponsor? (I clicked 1.a)

    Part 3.

    -- Question 1.

    She would click "Yes" correct? She is sponsoring the principal immigrant named in Part 2. (I would check this too, right?)

    -- Question 7.

    She would answer "1" right? So would I?

    Part 5.

    -- Question 1.

    She would answer "1" the same as me?

    -- Question 2.

    She would answer "1" same as me again?

    -- Question 8.

    She would answer "2" also the same as me? (It just seems strange that our two I-864 copies look like!)

    Thank you everybody!!! I'm sorry to ask such seemingly sill questions! I read those silly instructions so many times and still thought that I needed the I-864A, so I've lost a little confidence today! Thanks for helping me!!!

    We are finalizing our I-864 forms and have a pressing question!

    I've been living in Japan for 12 years with my Japanese wife and we have been married for 10 years.

    We have taken our time with the visa, so between the I-130 and now, we sold our house and moved in anticipation for moving to the US. We are still in Japan though, same city, in fact!

    Do I need to adjust MY address with the NVC?

    I looked online, but only saw forms to change address in the US...

    I'm freaking out!!!

    I'll still get mail from my old address with no problems... But should I send in the I-864 with my new address???

    Help!!!!!!

    we are finally getting ready to send our I-864 packet in!!! (Our DS-260 is already finished online.)

    Can somebody help me see if we have everything we need and in the correct order?

    Here is what I have:

    Document Cover Sheet (It's been a while, but it's the one that was printed when we paid the AOS fees?)

    Cover letter (Not written yet. Are there good examples online?)

    I-864 forms

    Tax transcripts for past 3 years

    Bank statements

    Documents to show domicile is still in US

    I-864A forms for my mother

    Tax transcripts for past 3 years (mother)

    How does that look? Am I missing anything???

  9. Hello all!

    One quick question!

    I've been living in Japan for 12 years and my Japanese wife and I are finalizing our DS-260 and AOS forms.

    We just sold our house and changed our address back to her parent's house while we wait to finish the visa.

    My mail will still arrive (redirect to) our new address, but do we officially need to change our address with Immigration? Is that easy to do? I think you can do it online, right?

    I didn't really think about this until I realized that some of our civil documents might include the new address...

  10. One more thing, when filling out the I-864, be careful about the boxes that you check in regards to which forms you are sending. The way they word things is extremely confusing. I heard from someone that you should click BOTH boxes if you are sending all 3… but then I heard from someone else that you only click the 2nd box if you are sending all 3. I am actually not quite clear on this myself but I THINK you click both boxes… maybe… Hopefully someone else can chime in on this one.

    Ouch! That does seem confusing!!! Anybody know for sure???

    I have a few questions about I-864 item number 14.

    I'm really confused, so I hope somebody can help!

    A while back I realized that I needed to back file my taxes since I am living in Japan and hadn't filed taxes in the US in a long time. You can read that thread here.

    Well I finally got my papers back from my accountant for the past three years.

    In each bundle I have forms 1040X, 1040, 1116 and 2555. I believe this is my "tax return" but I'm not sure since I don't have the 1099 and W2 forms that the instructions mention...

    Is this what I need to send?

    Do I need to get the 1099 and W2 forms from my accountant? I imagine that they needed to fill those out, correct?

    Am I better off just getting transcripts from the IRS?

    Any help would be greatly appreciated!!! I'm really confused since I told the accountant what I needed, but not sure if I got what I asked for or not...
