  1. Hi all,

    I have a friend that brought her fiancee to US based on K1 visa. They received a package on the day of the interview that they weren't supposed to open, but at the POE they didn't ask for the package.

    So now, they are wondering what they need to do with it.

    Do you have any idea? My guess is that at the point of entry, the immigration officer should have asked for this package.

    Also, can you advise if he needs to apply for SSN before marriage? They are planning to get married in a month. The point of entry was a month ago.

    A friend of mine is applying for K1 for her fiancee. He lives in Guyana.

    Their file was approved and now they have to pay the final fee so they can schedule the interview. They've been told they have to go to Georgetown to pay cash.

    But the guy lives 10hrs away from Georgetown. Do you know if the only way to pay the fee is cash in Georgetown.

    Has anyone paid the fee lately?

  3. The problem might also come when they ask you at the interview questions like my husband was asked at what might be the easiest embassy to go through. For example they asked him where I was working and if I was currently employed. They also asked where I was currently living/staying. You see, you'll need to answer those questions truthfully or risk a lifetime bar for misrepresentation.

    Perhaps this would be a bad time to come back to Romania especially since you are almost done.

    It is a bad time , you are right, but it's his wish...

    I guess we have to prepare the documents for a sponsor...

    If the primary source of income were to change or cease between the time the I-864 is submitted to when an interview takes place, then a new I-864 will need to be submitted at the interview. If your husband quits his job to stay in Romania, then the new I-864 will either need to have sufficient assets or a joint sponsor will be necessary.

    So, they would still set up an appointment for interview? I thought they would put visa on hold and ask for a new I-864 or a sponsor and only after that they will make an appointment for interview.

    I have a question. We sent the documents to NVC, NVC confirmed they got our file and that we should wait for 60 days.

    My husband (USC) is in USA right now, but he is planning to come back to me to Romania.

    I am pretty sure this will mess up with our process. Will NVC call the company we sent the Employment letter from and check if he works there or they are more interested in the taxes?

    Will we have problems if he comes to live with me till I get the visa?

    Did any of you go through this?

    Please give as many details as possible.

    My husband (US citizen) is filing his taxes for 2013.

    From IRS site I understood that :

    - Married Filing Separately- requires ITIN

    - Married Filing Jointly doesn't require an ITIN or SSN

    I cannot apply for an ITIN because the process is too long and requires my passport. My country does not issue certified copies.

    The Instructions for 1040 also mention:

    If your spouse does not have and is not required to have a SSN or ITIN, enter “NRA

    In which case can NRA be used? Can it be used for MFS?

    Can anyone advise if it would be ok to file MFJ? Does MFJ not require an ITIN?

    the tax guy advised to file SINGLE, cause I do not have a SSN/ITIN, but we don't want to have problems at the interview.

  7. Hi all,

    We have applied for a Spouse visa. My husband is American.

    We have got to the point of NVC process: we need to pay the fees and then send all the necessary documents.

    My husband has been living abroad (with me in Romania) for more than 1 year. He came to Romania in 2013 and before that he came here and left several times and he didn't have a job for more than 2-3 months in USA. therefore we interrupted the visa process, as we do not have any sponsors.

    the following are the documents we have for now:

    The last 1040 we have are from 2009 and 2010.

    Last W2 are from 2011 and 2012. we have a payment stub from 2012. He didn't file for Tax return in 2013.

    He will go back to USA soon and look for a job and we want to continue the process for the visa.

    My questions to you guys are:

    - do we have to wait for him to work for 6 months there before we proceed with the NVC process or can we do it even after a month of work?

    - Tax return transcripts ordered from IRS (preferred by NVC and of most consulates/embassies) RECOMMENDED

    OR

    - Tax returns (1040), W2s, 1099s, and any other schedules/worksheets (if applicable)

    Is this correct? We do not need 1040/W2 if we have the Tax return transcripts ordered from IRS?

    - I am tring to understand what is the difference between:IRS Tax Return Transcript and Federal tax returns. Can anyone explain?

    - will the fact that my husband hasn't worked for such a long time in USA, affect the process? I am referring to the Tax return documents, as they will be from 2012?

    - he has a kid from another relationship, and he mentioned his kid on his last 1040s. when he will fill in his tax return for 2013, does he have to add me too?

    we got married in December 2012. Is it necessary for him to fill in his tax papers for the year he missed ? He moved to romania in sept 2013.

    That is about it for now :)

  8. Hi all,

    I received my 3rd notification regarding the transfer:

    "The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office".

    Does this mean my file is still with NBC?

    1st was saying it was transfered to another office, 2nd was saying it was transferred to our local office.

    How can I find out where it is? Will I receive a4th notification?
