Hi visajourney,
Well in a nutshell my wife back in her late teens was forced by her mom to come to the USA she was here on a 3 month visa and stayed 10 months after that visa expired now in the interview a consulate officer said becaise of this which by the way happend 9 years ago today she would have to file a i 601 , do when i heard this i went histerical, depressed. Amd so on but after i got a clear mind and called and immigration office and they said that it looks like the consulate got there math wrong because they are suppose to start counting after visa is expired and if the visa expired on june 24 2004 then starting then is when unlawful entry in usa would begin which to mydateandtime.com is 318 days which is less then a year so supposably would only be banned 3 years so as this was 9 years ago if what i was told is accurate she would not have to file i 601 because she is no longer banned.... Im i right ? is the immigration office i spoke to accurate with the information that have given me? will i have to file an i 601 for my wife?
P.s the date of entry wheb she came was march 24,2003 on a 3 month visa which would have expired june 24,2003
She return to ecuador May 8,2004 this is only a 10 month over stay please help anyone that hs this info
Thank you

thats what they told her atleast two months that February was filled that maybe march or until a slot is open this has just been a long process to get my family together again... i can only imagine how many people have a hard time with this the most painful part is seeing my wife cry out of desperation that there is nothing we can do... the thing is if they would have taken the time to see the paper work we took i know she would have gotten approved she had everything our wedding album our civil wedding pitures when we were just boyfriend and girlfriend pictures with my son we had every single document needed but there was no way thatthe CO was gonna look at our file, he looked at my wife and told her you came for no reason your files arent here ... i know this is probably not the place to let go of feelings and im sorry i just need somewhere that people that have gone thru this would understand what one feels when the government is the obstacle seperating your family
-
like i thought it would happen the files were not yet in the system they shooed my wife and son away and told them to call the nvc i called and they told me to wait for an email this is a horrible day i just want my family i could not wish this depression on anyone but for my wifes sake i most stay strong and swallow it all we have left is to wait and see if everything is settle for a march interview date now
-
we will have everything hopefully they are in a good mood and help us out because i have contacted everyone i could that can help us from congresswoman to senator hopefully this helps at all
-
my wife is more then ready she has copy of everything sent medical exams and all original files asked for plus wedding pics wedding video and all
