  1. On March 12, 2012 we filed our I-129F which went to VSC.

    We have patiently waited for this process to finalize, we are still waiting for our NOA2.

    Over the past year this is what has happened:

    On October 16 we received an RFE because my fiance's visa was not translated into English. I had that resubitted and the response received by USCIS on October 19th. Since then, I have filed two service requestst, and two congressional inquiries. Service requests only push our "normal processing time" out longer (since we have to wait 60 days before we can do anything else) and Congressional inquiries are essentially ignored, e-requests are generic, etc...

    We really have nowhere else to go.. I find no one is accountable to finish our application in a timely manner, nor do I see they care.

    Does anyone have any recommendations for our next steps?

  2. When they actually get around to picking up your file and doing your name check, it takes only seconds to return pages upon pages of your most personal information. Your name is ran through several databases.

    Now when you say possession of marijuana...several facts will affect you. the primary concern is the weight.

    1. How much marijuana? MJ possession can vary between a minor administrative code violation, to higher felony charge.

    2. Who busted/ adjudicated you? The Military? Civil Law enforcement? UCMJ conviction is different than a civil conviction. Usually UCMJ records will not come up in a routine FBI name check, they'd have to be looking for it to find it.

    In the end, if you had a small bag of weed...welcome to America lol. It's nothing to worry about.

    Well it was one marijuana cigarrete that was found in the barracks , the military police fingerprinted me and take my information but the unit commander do not continued to prosecute me further for this matter but the info of the arrest was sent to fbi by the us army military police no charges were presented or prosecuted

Does anybody here has being in the fbi name check? how long is suppososed to take? i was told within six months but other people told me is longerand i dont know anyway my case was a simple possesion of marihuana during basic training at the ARMY that the reason my name hit on a the system, and im just confused

Im ashamed of my situation but any comments or adivise or judgements could help please, my i129f application is stuck in a background check from FBI for almost a year in wich I hit the name based check, this is because i was arrested in a ARMY base with simple possesion of marihuana while i was in Basic Training in 2006, i know i was stupid, The U.S Army decided not to continue file charges against me, they separate me from the service under a tipe 3 uncharacterized discharge, (this is like a general discharge it is not a dishonorable discharge). Back home this problem made me make feel really bad and depressed and more problems came, and for other reasons i was arrested for a misdemeanor of stalking in wich i plead guilty and paid a fine of $600 and a another dropped charges for possesion of marihuana and weapon law that resulted false in court my girlfriend is aware of all this mess and im not proud of it im very sorry for that, those two charges i submitt the court dispositions of them to comply with I.M.B.R.A but the arrest at the ARMY is the main issue that USCIS have right now and i have to wait for their final decission on this matter, what are your opinion should I recognize im lost in this i129f petition or it might be some chance, judge me but please and advise or opinion is needed :(

Does a k1 petition is in some way delayed for some type of scrutiny if you provide evidence of court records in order to comply with I.M.B.R.A, from the other petititions submitted at the same time frame? beacuse im a may 29th 2012 filer seven months and a half and i have not received my noa2 or any other notification at all? :( advise is appreciated

    We had our NOA1 on 16th May. Still we are waiting for NOA2. Last week we have put a service request. Today we have received an email from USCIS saying that it will take more 60 days. That means we can expect it after almost total 9 months after NOA1. Is it normal? Is anyone around there is facing or has faced the situation like us? We are very upset with this process. :angry:

    my noa1 date is may 29 2012 and im still waiting noa2 notification as well, i called today but they told me, call next week i can assume thei're still working the cases of may 2012 plus they can be slow because of the holidays approach ;and excuse my ignorance but what a service request is for?
