  1. A little background on my case. I arrived in Canada with my paretns in 1979 as a landed immigrant. When my parent filled out the Landed Immigrant form, they've made a mistake on my BOD and therefore is incorrect on my passport as well. As part of the sponsorship submission the NVC request for original birth certificates in which I've provided (Vietnamese Birth Certificate) but they will not approve my VISA because my BOD is not the same on my Canadain Passport. They request I amend my passport before they approve the VISA, which means I have to amend my Landed Immigrant form. I have gone through the process of getting that amend but I am worry it might not get amended because it was my parents who made the mistake. I am still waiting for a response for amending the Landed Immigrant yet. The normal waiting time is 6months and I am onto the 5th. My question/concern here is, if i can not amend my passport is there anything else I can do? Please help.

  2. Thank you everyone for the quick response. I am truly grateful for all your help. I have registered for loomis and obtain the print out. I think I'll wait for the package and then pay the immigation (green card) fee later. Now I am ready for the interview. Wish my luck everyone!!!

  3. Thank you so much for the info. Since I've already paid the Immigration VISA processing fee ($230) then I am assuming the Immigration Fee is the same thing that's why they sent me the letter for Visa Interview. It starting to make sense now. As for the Loomis, do they keep my Canadian Passport after the VISA interview?

    Btw what does GC mean?

  4. I have a very ugrent questions that I need to get answer ASAP because my interview is next week. I am a Canadian citizen and my wife is sponsoring me to the US. I submitted all my information via email and now I have the interview letter with the scheduled date for next week. Can someone explain why do I need to register and pay the imigration VISA? I have no issue paying but my interview letter does not say anything about this. I am going through the IR/CR1 process. Please help. I am running out of time.

    thank you

    Kevin

  5. On the G325 form the section "This Form is submitted in connection with an application for:" What should the "Applicant" select and what is the "Beneficiary" select if my wife (US Citizen) is filling out the form to sponsor me?

Also, at the bottom of the same form where it say "Applicant: Print your name and Alien Registration Number...etc." What should I enter because I am NOT an "Applicant".

  6. ^^^ what SHE said^^^ I suggest you come over to the Canada forum since it is advice from fellow Canuckers that would help a lot in your case. There is ton on information in sticky threads there that will help. I believe I mentioned this already so if you've already looked I apologize for repeating.

I can't seems to find the Canadian forum. Can you provide the link to the forum?

The reciprocity schedule for Vietnam has the following:

When primary documents are unavailable, secondary evidence regarding Vietnamese who fled their country beginning in April 1975 may be available from the individual and his or her refugee record. If the applicant received first asylum in Taiwan, cable AIT - Taipei; if in Thailand, cable the U.S.Embassy in Bangkok, Thailand and slug for ODP; if elsewhere in east or southeast Asia, cable the U.S.Embassy in Bangkok, Thailand and slug for RMA/ODP.

Do your parents still have your refugee card/record?

I still have my Immigration Record which contain my birth date. Can you submit that as proof?

  8. Look at this website. http://travel.state.gov/visa/immigrants/info/info_3195.html#certificates

    Birth Certificates

You (and any family members immigrating with you to the United States) must obtain an original birth certificate issued by the official custodian of birth records in your country of birth, showing your date of birth, place of birth, and parentage Important Notice: All Immigrant Visa applicants must submit a long form original birth certificate. Short form birth certificates will not be accepted.

    The certificate must contain the:

    •Your date of birth

    •Your place of birth

    •Names of both parents

•Indication by the appropriate authority that it is an extract from the official records

    Unobtainable birth certificates

If your birth record is not obtainable for any reason, a certified statement must be obtained from the appropriate government authority explaining why your birth record is unavailable. You must also submit secondary evidence such as:

•A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)

•An adoption decree for an adopted child

•An affidavit from a close relative, preferably your mother, stating the date and place of birth, both parents names, and your mother’s maiden name.

Note: An affidavit executed before an official authorized to take oaths or affirmations must also be provided. More specific information is available from the NVC.

By appropriate government, do you mean the government of Canada?

  9. Thank you for your feedback and detail instructions. I came to Canada on a boat when we lost our country to North Vietnamese in the 1979, and my parent lost my birth certificate while we were at sea. Long story short I can not get a replacement from my country as I do not have one anymore (South Vietnamese).

I am just preparing the BC for the step after I-130. I am a newbie so please be kind and patience and help!!!

    Thank you!

  10. Ohh wow..good thing I live in Ottawa. She lives in Seattle, Washington, so the instruction said to submit to Phoenix, AZ. I've already submitted the Canadian sponsorship forms, so now i am starting the US sponsorship process for her to submit to the US Immigration. If everything goes smoothly she should get her Canadian PR by June. Which means she doesn't have the 180 Days restriction anymore.

  11. My wife is still in the US and I am in Canada. This is my understanding of the process, so place correct me if I am wrong.

Stage 1 is to file I-130 (Petition for Alien Relative). When we receive approval then we proceed to stage 2 which is to file I-485 (Application to Register Permanent Residence or Adjust Status).

Please let me know if this is the correct process or the fastest way.

  12. I am a new member to this form and I am looking for guidance and advice as to what is the best approach for my situation. Please forgive me if I may have the same questions that were posted previously , if that is the case if you could direct me to the proper posting.

My situation is as follow. I am a Canadian citizen and my wife is a US citizen. We were both legally married in Seattle, WA a few months ago. Now we are trying to start the paperwork to bring me to the US. Please advice as to what is the quickest way, the process we need to follow along with the proper forms.

    Thank you everyone.
