  1. Hello visa journey friends,

    First of all, I would like to thank all of you for sharing what you know and taking the time to reply. I had been getting so much support here. Thank you guys.

    I have mailed the visa immigration application and affidavit of support and evidences to NVC. Unfortunately got an email from NVC that the affidavit of support was incomplete or something has to be corrected. The petitioner is my mother. She petitioned for my brother unmarried minor child. My husband and my mother filled I-864s and I filled I-864A as the daughter and household member.

    I felt stuck and not sure what to do. I need your help.

    Here are the details of the checklist I received from NVC.

    I-864, affidavit of support , and financial evidence checklist:( the petitioner- mother)

    In Part 1. Basis for filing affidavit of Support, please correct the following..

    On part I, I wrote down the petitioners complete name.

    answer: I checked 1.a I am the petitioner. I filed or am filing for the immigration of my relative.

    Am I supposed to check 1.e. I am the ___1st ___2nd of two joint sponsors?

    When I filled out my husband's I-864, I checked 1.e and checked the box( first) of joint sponsors.

    In Part 2. Information on the Sponsor, please correct the following...

    Answer: I filled out 1.a, 1.b,1.c ( family name, given and middle of my brother being petitioned)

    Mailing address: I filled the lines with my brother's address in the Philippines.

    Other information:

    Country of citizenship- Philippines

    Date of birth: my brother's birthday

    In part 3, information on the immigrant you are sponsoring, pls correct the following.

    My answer: I checked the box(yes)

    Line 7. Answer is 1 as the total number of immigrants you are sponsoring

    In part 4. Information on the sponsor, pls correct the following.

    Answer: I filled the the section with my mother's information. Full name, mailing address, and my mother's place of residence, telephone number, country of domicile is USA and date of birth.

    In part 5. Sponsor' s household size, please correct the following...

    household members: My husband, myself( daughter), mother( the petitioner), my 2 children( 4 and 6 yrs.old)

    My answer: enter the number you entered on line 7 of part 3.----> 1

    Persons not sponsored in this affidavit:

    2. Yourself---> 1

    3. If you are currently married, enter "1" for your spouse. ---->1

    7. Optional----> 1

    8. Add together lines 1-7 and enter the number here. Household size: 4

    In part 6. Sponsors income and employment.

    Answer: information about my mothers employment

    Person 1.

    6.a my name and 6.b relationship to my mother, 6.c my current income

    Filled out line 10

    I checked line 11.

    I checked line 13.

    If my mother only have most recent and 2nd most recent tax year, what should I do? She started working around 2011.

    If that is the case, that means I don't have to check the line 13?

    In part 8. Sponsors contract please correct the following.

    Answer: I filled the box with my mother's name and she signed too. ( I don't understand why it needs to be corrected, she is the mother sponsoring her son)

    I was also asked to submit a w2 for my mom.

    I wrote down the answer under each part questions: any suggestion or answer you may have, please help me.

  2. Thanks! one more question, on PArt 5. question # 3 If you are curently married "1" for your spouse. ( the husband does not live is USA, not a PR nor a US citizen. Not included in the household.) Does the petitioner leave it blank or still put 0?

    #7 Optional: If you have sibling, Parents,or adult chidren with the same principal residence who are combining their income with yours by submitting Form I-864A. ( does Son-Inlaw belongs in this category? ) The son inlaw lives in the same household though.

    On the first page of the I-864, Mailing address section, do we put the petitoners address or the the principal immigrants malining address?   4. Thank you. I have another question about the IV application. I was told to do the DS-260 online application. Does that mean I need to scan the rest of the civil documents and email the files? or Am I supposed to send a copy of the application I did online together with the civil documents via mail? The change in the IV application form confused me. Is there a new procedure in submitting the IV applications? Please help me. Thanking you in advance.

  5. No your younger brother needs his own petition and fees and wait time. All siblings will need their own petitions and separate fees. Assuming they are the result of the same marriage much of the petition will be identical with only the names of her children and their birthdates being different.

    Thank you! Can my mother use a credit card to pay for the application through immigration centers? Or can I use my personal check to pay for the applications for my mother if we mail it to USCIS.

    I am a US citizen and I petitioned for my mother under IR-5 category. She is now a permanent resident and want to petition for my brother that is under 18 and unmarried. I read from the instructions for form I-130, it says if you are a lawful permanent resident of United States, you may file for this form for your unmarried child under age 21, your unmarried son or daughter age 21 or older. It's says if your relatives qualifies under this categories, separate petitions are not required for his or her unmarried under 21 years of age. Does my brother qualify if my mom was petitioned as IR-5 and now a permanent resident? What step should my mother do to get her son over? She is also wanting to petition for my other siblings that is over 21 and unmarried, she has to pay separate fees for each child, 420 x the number of children she wants to petition right? And separateI-130 application forms?

    There is a question in the 1-130 form from the next page, D. Other information, question number 1. If separate petition are also being submitted for other relatives,give names of each child and relationship.

    Does she have to answer same question for every application form for each child? I'm not sure what to advice my mom about this. I need your help. Thank you so much

  7. For some people it is odd,for some it is not. It is per situation. Because my mom cant take my younger brother with her right away according to the immigration rules. We have to follow. It is not that simple. And it is not that odd because my father is there for my brother and family while waiting. That is what they are for. It is a little sacrifice. That is why my mother is going to file a petition so she and family will be reunited. Thank you and have a great day my friend.

  8. No. Here's the deal...

    There are two broad classes of visas that the I-130 is used for; immediate relatives of US citizens, and family preference categories. Immediate relatives are the "IR" and "CR" category visas. Family preference are the "F" category visas (sometimes called "FB" so as not to confuse them with "F" category student visas).

    A derivative visa is a visa for a qualifying relative of the primary beneficiary, which means spouse or unmarried child under 21 years old. Family preference visas can have derivatives. Immediate relative visas cannot. "Follow to join" only applies to derivative visas.

    Your mother received an immediate relative visa, which means no derivatives. A separate petition is required for anyone else to immigrate. If she applies for her husband then that would be a family preference F2A visa. Since derivatives are allowed then any unmarried children under 21 would also be able to apply for visas at the same time, or follow to join within a year. Married children or children over 21 years old would not be eligible for derivative visas. A separate petition would be required for them. An LPR can file a petition for an unmarried child over 21 years - family preference F2B. An LPR cannot file for married children - only a US citizen can do that, and it would be family preference F3.

    There is no such thing as a "family group" visa petition. However, because family preference visas allows for derivatives, it may be possible for an entire family to immigrate based on a single petition, as long as everyone else who is applying for a visa is either a spouse of the primary beneficiary or an unmarried child under 21.

    Wow that is very informative,thank you. Based on your information,my mother can petition for my father and my minor age brother can apply for a visa at the same time. Does it have to be done after my mother file for the i-130? Or can it be done with the same paperwork or i-130 application for my father and brother can be included in processing the application?

    If my father gets approved for the I-30 that my mother will be applying for him,my younger brother can go with him on his way to usa? Or my minor brother has to follow later?

  9. The I 130 is used for many classes of petitions. SO you have sibling and parents and children all using the I 130. For siblings there are deriviate people like spouses and monor children. But for your petition for your mother no deriviates , your brother needs a separate petition, from either you or your mother or both. ( backup is case one of you die )

    Thank you,that is what i wAnted to know,i was confused about this derivatives. My mother then will petition for her spouse and minor son and other children that is single and over 21. She has to do it seperately right? Is it possible to do a group family petition?

    I am a usc,and petitioned for my mother who is already a permanent resident through IR-5 family petition. I have a 14 years old brother,he is unmarried and under 21. We had be doing some reading on uscis.gov and we saw something about a follow to join benefits. Theres is 1-130 petition for permanent residents family and there is something about this following to join benefit for an immigrants permanent residents children. Below is the information that was mentioned at the official website.

    If you had children who did not obtain permanent residence at the same time you did, they may be eligible for follow-to-join benefits. This means that you do not have to submit a separate Form I-130 for your children. In addition, your children will not have to wait any extra time for a visa number to become available. In this case, you may simply notify a U.S. consulate that you are a permanent resident so that your children can apply for an immigrant visa.

    The relationship existed at the time you became a permanent resident and still exists, AND 

    You received an immigrant visa or adjusted status in a preference category. 

    Does that mean that my my mother is elligible? Or the only option for her is to file I-130? I look forward to hearing from anybody that might know about this case. Thank you for your time.

  11. I had petitioned my mother and is going to have her interview. As her agent i got an email form NVC about her interview appointment this Aug.3,2010. She has to have a medical done according to the paperworks. I want to know if she has to call the st.lukes to set up an appointment? Or just go there and bring the letter of interview appoinment? I am all excited for my mom. I need some advice about this medical appoinment thing. I would appreciate any advice. Thank you! Thank you!

  12. she won't get the conditional card, she'll get a 10 year GC. she can file as soon as she get's her GC. The amount of time depends on from what country is she from. Can you let us know?

    Thank you. She is from the philippines. How long will it take for her son to get here in US. Is there any options of application she can do to get him over here to they could be together? What is the best application in her case?

    I have petitioned for my mother I-130 and she will be going through interview soon. When she gets here in US does she have to remove a conditional resident status? How long does she have to be here in US to be able to petition her 12 years old child. What is the fastest process for her to do to get him over here? What are the applications and step by step process? I would appreciate any advice and suggestions! Thank you very much. Have a great weekend! :)

    since you've filed for your mother, you'll file I864 and if you don't meet the poverty guidelines, you can use your husband as a cosponsor and he files an I864A.

    i would recommend going to nvc's website www.travel.state.gov and have a through read. In fact when you print both these forms, you'll get to know from the instructions what all you need for send. For the reqd docs, you are right about tax returns (w2+IRS transcripts), emp letter, pay stubs, a proof of relationship, etc.

    may be some other members and add more. Good luck.

    Good Morning! I have filed for I-130 petition for my mother. I already got the aos bill from nvc which i paid online and im still waiting for the cover sheet with barcode to be available so i can print it out. While waiting, i want to know what documents i should send to nvc since i am going to have my husband's support to help me on affidavit of support process. I work part time and my husband works full time. There is I-864 and I-864A. Do i need to send nvc one of each filled out or just the I-864A? Do i need to submit my husband employment letter and pay checks? Passport id? I would appreciate any advice. Thank you very much:) :D

  16. Hi Everyone,

    I need an advice from somebody who has the knowledge about this I-130 case. Or somebody who is in thesame situation. I am a USC and i have started the petition for my mother. I have recieve the NOA1 receipt notice and NOA2 Approval notice. My question is What should i do next. I Don't know the next steps. as to when im supposed to pay the affidavit of support which is $70. The letter of approval did not say anything about this. NVC will be processing the approved petition according to the letter. Does that mean that we have to wait for another receipt notice from NVC? Do we send a copy of affidavit of support to NVC?

    My other question is regarding the paperwork that my mother will be filling up before the interview DS-230 form. There was a question there DS-230 part 1 31a persons name in 14 and 29 who will accompany you to the united states now. 31b.persons named in 14 and 29 you will accompany you to the ubnited states at a later date. The persons they are talking about are my mother's children and my father. If my mother writes down the name of my youngest brother who is 12 years old on Question PartI 31a can he really come with my mother when her petition gets approved? My mother wants to know if that is possible? How does the process works? If she writes down the names of my sibling and father on question Part 1 31b will she be denied because of that? does she have to leave it blank or is it for future preference just incase my sibling follows? According to NVC Appoinment processing. If the applicant(my mother) has children who intend to immigrate to the united states or join the applkicat in United stets at a later date.In order to immigrate with the applicant to the united states the applicant's children must be Unmarried,and under 21 years old and be eligible to be listed under applicats visa classification. My youngest brother is a minor and not married. If my brother is really eligible does we have to have him go to the interview with my mother. I am very confused how this things works.
