I guess that your GC delay might be caused by the background check.
USCIS is reviewing your case now. If everything goes well, you should expect the I-797 Approval Notice between April 12 and May 27(90 days after the 2nd fingerprint).

Second fingerprint is for the production of Green Card. It should be code 2 (photo, signature and fingerprint). I checked the green card's photo, which was same as the photo taken at the 2nd biometrics appointment. However not every applicant is required to do this. Some applicants repeat the fingerprint(Code1: 10 fingerprints) because the previous fingerprint might be bad or damaged. I don't know the reason. If you have the 2nd biometrics, your AOS should be approved and receive the card within 90 days.
Good luck to you. Hope your AOS will be approved within 6 months instead of mine (8 months).

My AOS was approved.
Timeline:
I-485, I-131, and I-765 Filed Date: 06/19/2012
1th Fingerprint Date: 06/27/2012
Within 2 months both I-131 and I-765 were approved.
2nd Fingerprint Date: 12/28/2012
I-485 Approval Date: 02/20/2013 (Approximate 8 months)
Conditional Green Card Received Date: 02/27/2013

You are right.
Any individual who on or after February 1, 2013 receives an immigrant visa package from a United States consulate or embassy abroad (including Canada and Mexico) must pay the USCIS Immigrant Fee.

On Feb. 1, 2013, USCIS will collect a new fee of $165 from foreign nationals seeking permanent residence in the United States. Applicants will pay online through the USCIS website after they receive their visa package.

When an applicant files I-765 along with I-485, he might not be required to do the fingerprint for EAD. However, he might be required to do fingerprint(code 2) for renewing his EAD while his I-485 is pending.
One online blogger suspected the fingerprint code and called ASC before the appointment. The code was changed accordingly.

If you can't wait, you can file a new petition to request USCIS to reprint the approval. The application is simple and might cost you few dollars.
Your AOS approval will be your second option.

Code 1 is 10 fingerprint. It is an important part of your background check and determines admissibility for green card, which might be expired within 15 months. Your first fingerprint should be valid. It might be a mistake. You should receive the same code number.
Code 2 is index fingerprint, photo, and signature; and is for EAD, green card etc. Before receiving the green card, I-797 approval notice shows that some applicant may be required to report for biometrics processing (photo, fingerprint, and signature).
Code 3 is "Code 1 Plus Code 2."
By the way, a lucky EB-5 applicant received I-485 approval within 2 months in 2011. Other received an approval notice within approximate 4 months in 2012. It is not unusual to see the waiting period between 12 and 20 months. Each case is unique and depends on individual visa processor's load and speed.

1). You can file a new petition to request USCIS to reprint one.
2). Wait for your EB-5 AOS.
Did you receive any RFE or second finger print request regarding your I-485?

Your EAD should be stamped with AP; and it can be used as travel document while your AOS is pending.

Did you remember the fingerprint code number (1, 2, or 3)?
It should be '2' (Index finger, photo and signature). This is for EAD, Green Card, or ....
Within the 90 days of your second fingerprint, your CPR are likely approved.

The second fingerprinting is a good news to you. It means that someone is working on your case now. All you can do is waiting and check the mailbox.
By the way, did you file the application by yourself or a lawyer?

The USCIS website shows all categories of employment based AOS processing time instead of EB-5 based AOS, which is one of them. So you won't need pay much attention on the general AOS time. You have waited for approximate 10 months now. If I were you, I will call the customer service because the website case status wasn't often updated. Please verify your address and update it if you have to move. Did you receive any RFE or the second round fingerprint request?

When was your I-526 approved?

I mailed my I-485, I-765 and I-131 to California Service Center in the middle of June, 2012. Within 2 months, both I-765 EAD and I-131 travel documents were approved.
Today is Dec 6, 2012.
I am wondering how long I have to wait. What was your recent EB-5 AOS journey?
