  1. So this is random ...

     

    After successfully getting my wife to the U.S. (she's had a green card for years now), we're working on my in-laws. They're actually being sponsored by my brother-in-law who is a U.S. Citizen so it's an I-130 we're after, a "Petition for Alien Relative."

     

    It's a bit complicated because my father-in-law received his I-797 notice of action in Feb. 2011 while staying in the U.S. for an extended period. But by the time the form arrived, he already returned to Taiwan, where's he's been living for the last 6.5 years. I'm just finding out about this and trying to help, but I'm not sure how to proceed because it's been so long.

     

    - Are cases closed if people don't follow up with the appropriate materials?

    - On his I-797, it states that he needs to submit an I-485. We'll get that together now, but if the case is still pending, will that prevent him from entering the U.S. in the meantime?

    - Also, since he returned to Taiwan (the case was started in Texas), does he need to submit an I-824? or can he come here and wait it out?

    - Making matters even more complicated, the paperwork was started in Texas, but my brother-in-law has since relocated to Montana. Is there some sort of change of address for that is needed in cases like this?

     

    Any help or advice would be much appreciated. I recall Visa Journey was extremely helpful when I was applying for my wife's visa, so hopefully there's someone out there with some insight.

  2. So I am just about to submit my I-864 (and I-864a, joint sponsor), and I'm just curious if anyone know approximately how long these forms take to process, or what happend from here on out?

    I know that NVC requires at least 20 working days to process documents, but after the I-864, what are the next steps? Will NVC then assign our interview? This whole thing is super confusing.

  3. In November 2012 I filed the I-130 petition for an alien relative, my wife, and in December 2012 I received an I-797 that said that our case had been accepted for review.

    From December 5 until now, there had been no movement in our case, but just today I checked the USCIS website and our progress jumped to "post decision activity" and it says that the petition has been approved. Does anyone know exactly what this means? Apparently something else should arrive in the mail in a couple days, but I'm just trying to get a better understanding.

    If anyone has any insight that would be of much help.

  4. 4-6 months until you receive NOA2, not until you receive visa. 8-10 months for the visa. read these for more info on next steps and etc:

    NOA2 is not a packet or anything, NOA means notice of action, it's just a letter from USCIS stating that they have taken a certain action with your petition. Most people get two, the first one stating that your case has been accepted (which is what you've received) and the second one stating that your case has been approved and is being transferred to NVC.

    Read the guides, everything you need to know about the next year of your life is in there ;)

    I'll check both those links, but what is with all these inflated timelines people are writing here. Most other couples I know are clearing their completed visas in 4-6 months for everything, some even with green cards.

  5. Did you list her address in Mainland China on the petition form? If so, her interview will be in Guangzhou.

    That ship has sailed, OP has already filed the petition and paid the applicable fees.

    Yea unfortunately Direct Consular Filing is (and was) not an option since I'm temporarily here. Yes her address is listed as Mainland China.

    you filed the 1-130 and you received the receipt notice of auction 797, noa-1, now you wait and wait for notice of approval noa-2,maybe 8 to 10 months to become complete,

    8-10 months? What? That's outrageous. Most timelines are like 4-6 months. Can you provide any evidence of this slow rate?

    Also for noa-2, will USCIS send something to my house telling me it's time to start noa-2? How / when do I know to begin this packet?

  6. I'm an American living temporarily in China with my wife, who is Taiwanese.

    We just received notice that our case has been accepted and we received our I-797, which is basically a notice of receipt along with our case number.

    Can anyone offer any insight on what the next step is? and approximately how long it will take USCIS to contact me moving forward?

    Also, another question . . .

    My wife is Taiwanese, but she lives in Mainland China. Any insight on whether her visa interview will be in Taiwan, where she's from, or China, where she lives.

    Thoughts, suggestions, and insight are all welcome.
