I am helping my brother with his I-130 Package. Last year he filled this out and sent it for his wife but the USCIS sent a notice for intent to deny. It was hectic after that and he wasn't able to send supporting documents. So now he is starting all over.
For question #2 in part D of the I-130 form the question is Have you ever before filed a petition for this or any other alien?
Obviously he should check yes. But then they ask give name, place, and date of filing and result.
He would put the name of his wife the date it was filed and the result is intent to deny, right? But what is the place? The place she lives or where he filed the petition, the USCIS? I don't understand and don't want to give him the wrong answer and he goes through a hard time with this again. Please help. Thanks.

I am helping my friend put together his AOS package but some questions on the I-864 form are a bit confusing. He is sponsoring his wife with my sister as his joint sponsor.
On part 3 it asks about family members. He has 2 children with his wife that are with her over seas. Their son has a passport but the daughter does not yet have hers. Is he to check the box that asks if he is also sponsoring the family members that will be traveling with the intended immigrant and include their names for part 3?
Or does he not include their names and in part 5, Sponsors household size, does he add 2 for the question #4 if he has any dependent children?
Also for the joint sponsors I-864 form does she include the children or just mention the principal immigrant?
Please let me know this is the only thing confusing me.

Ok. So now I understand what documents need to be sent in this AOS package. So on his form I-864 he includes his wife and both his children. On the joint sponsors I-864 form she just includes his wife. Correct? Thanks so much. This makes a lot more sense.
Yes they both fill out their own I-864 form and submit most recent tax transcript or tax forms with W2 and (Letter of employment and most current tax stub these are optional)..
The children he will have included in his household total, but only his wife will be included on your sisters since she is the only one immigrating.

I am helping a friend complete his AOS package for his wifes visa. His joint sponsor is my sister. What are the documents/ checklist for this kind of affidavit of support package. Does he and his joint sponsor fill out and sign separate I-864 forms? And send their separate tax returns?
Also, he obviously includes his wife the person this is for and his son. But he just recently had a baby girl. Does he include his daughter too that he has not gotten a passport for yet. And she hasn't been mentioned in the I-130 package bc she wasn't born yet. His son was mentioned and they received his information and he has a passport but the daughter does not yet have hers. Is she to be mentioned in the I-864 or not. What do we do?
Any help is appreciated.

I am helping my brother restart his petition for his wife to get an immigrant visa. He tried over a year ago but kind of denied him because there was lack of proof to show her established identity. Did anyone else have this problem and what did you do about it. I would like to send another I-130 package and for it to be approved. What should I include in the I-130 package. This is what I know that we need. Let me know if I am missing anything or should add.

1.) Do we need to send a copy of her birth certificate and translation.
2.) And what evidence of proof should we send to prove of their bonafide marriage because we had trouble last time doing this. They have a child together and my brother has already gotten him his american passport.
3.) Can I change the name of how her name was spelled before or should I keep it how is was. Was (Al Mohseni) I want to change it to (Almohseni) (without the capital)

Hey, just wanted to let everyone know that after my husband and I got back from the embassy on the 12th of january empty handed and disappointed I sat and sent the embassy about 120 emails for them to get going on our visa process and get back to us soon. Then we got a call on the 20th of january for my husband to pick up his visa on the 22nd. we went together and we waited for our turn and the guy then handed us his visa. we were so happy. we have already left for america and now we're here. I am going to miss yemen so much because I know that we probably won't be back for a long time. I wish everyone the best of luck and I mean it from the bottom of my heart. inshaallah everyone gets what theyre looking for.

As for now we're trying to get settled and to be honest I will try my best to keep looking at this site and answer questions for people but I won't be available as often as I would like. But if there is anything anyone wants to know send me a personal message so I can answer quickly.

Ok here's how things went.
We went to my husbands appointment on dec. 18. It couldn't have gone any smoother or easier. Everything went really well but they said we need the new I-864 form when he comes to pick up his visa. They gave him the white slip visa pick up slip and he goes to pick it up on January 26. Then he gets a call from them to his cell last Thursday to come in on Sunday.
We went today and his name wasn't on the list but they let us in anyway. We waited hours until they let us into the building. There wad so many ppl it was crowded so there was a man there to let ppl in one by one. Well the jerk had us be. One of the last ones in.
There was a lady there to also go pick up her visa that we knew from our village. She went in before us and came out and we were still waiting. When she left she told us that they kept calling my husbands name inside. But what could we do the guy wouldn't let us in.
So then they finally called us in. We went thru security and when we got into the consular section it was crazy packed. U could definitely tell they were way overbooked and unorganized. All the workers were in such bad moods.
We went to one of the workers (yemeni). We showed him the white slip and gave him the forms. Then he told us to leave and they will call us.
I think they would've given the visa to us that time but the guy was too lazy and overwhelmed that he just then decided not to.
How ridiculous. I was so mad. Inshaallah they will call us soon tho. Inshaallah things will look brighter for all of us.

Yeah for the paternity/ maternity affidavit doesn't the petitioner fill out the first half and then the last sheet the beneficiary fills out and signs. But where do you get it notarized if you're in Yemen?

I don't think we'll be seeing any rescheduled appointments in the end of septembet or throughout this whole month bc my original app was for the 30th and that was cancelled. And they mentioned in the email about my cancellation that all september appointments are cancelled. If anything I think for those of us whose apps got cancelled in September will get ( if we're lucky) apps at the end of October or in November. That's how I see it. But who knows for sure. What is the best way to contact the us embassy in sanaa? Thru email? If so what is their email? And what is the number of the DOS hotline?

Hey guys I've been away from the internet for awhile bc I'm in yemen and me and my husband live in the village, now im in sanaa so I can let u guys no how my visa journey is going so far.
I got case complete June 2013
Then I got an email beginning of August 2013 stating that my husband has an interview September 30, 2013.
Then I got an email August 16, 2013 stating that his interview is now cancelled and they will notify me when they reschedule.
Now im waiting like most of you. What can we do, it is wat it is.
Can anyone tell me where in yemen I get the affidavit of paternity/ maternity notarized?

I am having the worst time. It's driving me crazy. I've attempted to send my AOS package to the NVC about 3 times now each time has not worked. I opted for Electronic processing so all my files and documents and forms need to be sent through email as attachments.
The problem I'm having is that I my signed and scanned form I-864 form is too big (35 MB) and exceeds the limit that my email provider is able to send (can't exceed 25 MB)
I've already tried to send it into 2 parts. I saved half of the form (first 4 pages) as an attachment, then I sent the 2nd part as an attachment (last 4 pages) in another email. But then I got an email from the NVC saying that they did not receive form I-864. Then I called them and their supervisor told me that I must send it as a complete file attachment so that it can reviewed correctly. BUT I CAN"T.
But wait... then I sent form I-864 a website that allows large files to be sent as attachments. It gets linked from your email though so I thought it would be fine. But then I received an email from the NVC that they cannot review any files sent through different emails.
THEN... I sent the attachment through something that yahoo is doing with dropbox that allows large files to be sent. But I guess they don't get sent as attachments because I got an email from the NVC today saying that there was no attachment sent to them.
WHAT DO I DO. This is really driving me crazy. If anyone has gone through electronic processing please HELP ME. I need your wisdom and advice to get through this.
I want to be over with this but it seems like I never will. I want to not have anymore of this stress on me because I am leaving to see my husband in the beginning of June.
I don't have much time left.

It seems as though the K1 visa applications get faster interviews than the IR1/ CR1 do...
But I was just wondering from those who have interview dates (congrats by the way.. inshallah khair) , how long you waited from the time you got case complete to when you got notified of your interview date.

Last week I sent my AOS package and IV package..... I'm doing electronic processing and I got a response from the NVC 2 days after I electronically mailed them the AOS and the IV package (by the way I'm petitioning for a spouse visa) and they told me (for each package) that they have received electronic documents regarding this case and that I give them 20 business days from the day the email was sent to for the scanned attachments to be uploaded to the electronic case file and reviewed.
By the way I sent them in 03/21/2013...... So what does this mean? Are they saying that they just tell me case complete saying that they don't need anymore documents in 20 business days? Or will they have an interview date scheduled and have my case sent to the yemen embassy in those 20 business days?
Has anyone done it this way and know what is to come so I can know what is needed and what's gonna happen.... Would be very much appreciated thanks!

Ok thanks I got the idea and I appreciate your response but Sarah and Adnan you brought up another question I was wondering about. When I looked through the directions for the AOS package they want your tax returns and whatever but I don't read it anywhere saying that they also want your bank statements. Is this true. I mean I plan on sending employment letter, pay stubs and 3 most recent taxes (form 1044) and W2's. But do they also require you to send them bank statements. I wasn't aware that people did this until recently I heard from a family member that they may want them.
So sorry to shoot out answers at you guys but you guys have been such a help so I love you all for that.

She probably has an hourly position with a variable schedule. As others have said Rebecca, you can use last year's total earnings as an estimate for this year or calculate your weekly earnings x 52 weeks. Remember you're also going to need to include supporting documents with the I-864 (& I-864A if applicable) like tax transcripts, bank statements, and a letter from your employer confirming employment and your salary.

What do I put down for on form I-864 and I-864A that asks about our current annual salary?
How am I supposed to know that if the year hasn't ended.
What kind of information are they looking for? What has anyone put down for this question who have already sent their AOS package?

When I posted a while back about the nvc process, someone kindly responded and gave me a link to a guide or helpful page with so much information. It had questions about the whole nvc process for people in the spouse visa process and the answer to those questions. It also had step by step instructions on what forms and documents to send. It was just amazing!
The problem is I can't find that topic I sent with that specific link. I already checked through my profile and it only has the recent topics I sent. Maybe it still is in my profile or whatever, but I can't find it. If anyone would so kindly send me links to any helpful information regarding the AOS package it will be very much appreciated.

They don't need to be notarized but whatever isn't in english I would suggest getting them translated, so if your birth certificate isn't in english you need that translated and also your wives if hers is in a different language. I am not sure if your qualified to translate it but if you are a certified translator and have been approved to translate documents and have a license for that I guess you could. But I'm not sure about that, you should double check.

Ok if anyone has experienced this or knows what this means then please fill me in because it doesn't make sense to me right now.
My cousins case for his wife immigration is at the nvc. He paid the AOS bill and now he is in the process of getting his AOS package ready. This is understood, no problems there. But then he just recently today got a letter or 'USCIS case status notifier' that reads:
"On Oct. 16th 2014 we mailed you a denial decision notice for this case I130 petition..... The notice explains why the denial decision was made ....."
What denial decision are they talking about? His I-130 petition was approved and moved to the nvc. They are asking for his affidavit of support package. We don't understand why the uscis is involved again. This just all doesn't make sense. We would have called but we just got the notice today and we'll have to wait until monday to contact them. But we would love to know what this means and if they are mistaken or if this is something to really worry about. And what should we do?
