  1. Update - we went back to the Social Security office, and we got another person this time. We also came with my wife's birth certificate (including translated copy), and three forms of identification, showing that her middle name is not part of her first name.

    All this evidence turned out to be unnecessary. This individual just spotted the problem, and was able to fix it, thank goodness. I didn't want to have to resort to hiring an immigration attorney.

  2. So, there is not really a mistake on the part of the CBP and the I-94 since the name on the K-1 visa is exactly how it is now on the I-94, correct? If the names were wrong on the K-1 visa, then why did you not contact the consulate to have it fixed before using it to enter the US?

    I do not really know how you can get it fixed now, other than letting DoS know it is wrong and asking them what to do about it since you already used the visa to enter. I would suggest waiting on the SSN and filing for AOS and filling out the forms correctly, separating her first and middle names in the appropriate manner. The name used on the AOS forms is what should appear on the EAD/AP and green card. You can use the EAD/AP to get her SSN then in her correct name.

    We did not contact the consulate because my wife at the time jsaw her first and middle name on the visa and she thought it was ok. On her passport, the field "Given names" contains her first and middle name. On the visa, her first and middle name is part of "Given name" which is slightly different - she didn't notice it.

    Do you happen to know who specifically I need to call at DoS? Which office?

    Do you forsee any problem with AOS?

  3. I am helping my new wife, who arrived in the US on a K1, to apply for AOS. This morning we went down to the SS office to change her name, and we discovered there is a problem.

    On her K1 visa, it has both her first and middle name as her "given name." Accordingly, when she entered the US, CBP filed her I-94 as her given name consisting of both her first and middle name.

    I have called USCIS, CBP, SS and NVC without resolution to this because this is, obvilously, in error. We are very worried this is going to create an issue for AOS.

    What should we do about this? How can we get this resolved?

  4. Hello everbody. I am soliciting all of your advice and wisom because I am going through a difficult time in my relationship to my fiancee. She arrived in the US late August, and we still hope to get married next month, but there are complications that are making such a decision more difficult because this is not what we both envisioned.

    In a nutshell, we do not have the blessing of my parents and my brother and sister-in-law have concerns that we are rushing too quickly into marriage after living together for just over a month now. Throughout our relationship, they have never had a chance to really get to know her because she lived in Eastern Europe, and my parents only met her for the first time when they met up with us during a trip to Rome in May. There are a lot of dynamics at play here. I wish we had more time than three months...

    My question is - if my fiancee decides to go back to her native country in the interest of putting the wedding on hold to allay any and all concerns and have all questions answered, what are our options and chances of obtaining another K1 visa? Would there need to be a waiting period before we could apply again? Would we be flagged in the system for extra scrutiny with a much greater chance of being outright denied? Could we marry in her native country and have her come into the US on a K3?

    Is there also chance that we could ask for an extension of the K1 visa? (unlikely, I know)

  5. Hi everybody. Wanted to let you know that my fiancee's K1 visa was approved today!

    I sent my I-129F petition October 26, 2012. The whole process from sending the petition to K1 visa approval was 265 days (8 months and 22 days._)

    Special thanks to everybody at Visa Journey for helping to make this possible - we would not have been able to maximize our chances of success if we had done this alone or even through a lawyer. This website is an incredible resource.

    I have a friend from Bulgaria who came to the US on a J1 visa and she is working at a deli in North Carolina. Long story short, she is very unhappy with the workplace, and desires to work someplace else.

    Is there any way she can do this while remaining in the United States? What are her options?

  7. My fiance and I just recently got our NOA2, and we are both very excited about it. It should be on its way to the NVC and we expect it will be heading to the American embassy in Bulgaria very soon.

    At the same time our application for the K1 Visa is being processed, I have separately, for myself, been filling out an SF-86 application for security clearance. In addition to many other details, I also have to list any foreign contacts that I've had regular contact with, and my fiance is, of course, one of those and is a very important one. No doubt, they will want to do some kind of check on her and her family members, but I doubt it will be too extensive.

    My question is this: Are there any possible caveats that could result from both these processes happening in tandem? Could the K1 Visa be rejected based on any other investigation another department of the US government is making into my fiance because of my security clearance application? Could my fiance be denied entry into the US even after the K1 Visa is issued?

    We both have nothing at all to hide, but we are talking about the massive bureaucracy that is the US Government and we are both worried they could reject her just on some stupid technicality like this.

  8. I've flown to Europe to visit my fiance three times in the last 7 months, and next week I will see her again. Obviously, not everybody can see each other with regularity when it comes to these long distance romances, but it really helps a lot and makes the time go faster.. Rather than only looking forward to the day the I-129F application is approved, you can instead look forward to the next time you can be together again.

  9. "Tired of waiting" is not an excuse... I feel tired of waiting too... sometime.

    not easy to have long distance relationship, especially come to the stage of submitted document for K1. I am sure the "negative feeling" is just for awhile... (fingers crossed)

    I wasn't saying it was a legitimate excuse. I am saying that it sounds like he is using it in order to hide something else from her that he does not want to reveal in order to let her down more gently. My guess is he found somebody else.

  10. Give him some space to think, "if you love something, set it free..." Allow him time to think. It could be cold feet. Men are different to women and reality may be settling in. He might only be realizing what a big deal marriage is.

    Or, maybe he found somebody else, either in the US or in another country, and just used the "tired of waiting" excuse in order to let her down more gently. The reason I think this is because it's the only thing that makes the most sense for him to end this so suddenly on the verge of major movement in their application.

    I hate to sound negative about this, but he's only human.

  11. when is the best time to call up uscis to ask for a tier 2 rep, and ask for service request? if i got my noa 1 on oct. 4, 2012, and per igor's list the case might be adjudicated bet april 12 and april 17? should i call april 4th (which is the 6th month since i received the NOA1) or wait about a week or two after we reached the 6th month mark before calling USCIS? thanks.

    I would wait two weeks. Give them some kind of grace period.

  12. Just wondering what your case status looks like. Our status appeared now too, stating that the alien registration has changed regarding our I-129F, Petition for Fiance. Just wondering if this is common. I have seen some others post similar responses on here as well. Thanks!

    The status looks the same as yours: alien registration changed regarding I-129F. In the "Initial Review" stage.

    Looks to be pretty common.

    Firstly, best of luck to all of us in our applications. We all share the same anxiety. Waiting.

    Secondly, the NOA1 receipt number doesnt seem to be working for me. I goto uscis.gov almost every day and still get the 'case not found' message. I really hope that they are so busy processing our applications that they forgot to update the status on their website :)

    Anyone else having this problem?

    I can't wait for it to be April 19th! (VJ's estimated NOA2 approval date).

    Same thing is happening to me. I called USCIS to verify there wasn't a problem, and they said that they had my case and it was processing and that it will take roughly five months. They said that if the case is not on the website, it's because of technical problems and that they are working on it.
