  1. Hi guys,

    I recently got RFE for form i864a. Hope you guys can help. My situation is like this. My father's a joint sponsor as my income isn't enough to sponsor my wife. My dad makes about 40k per year which should be enough for the poverty line standards. I filled out i864 and my dad filled out a i864a. Presently I still live with my dad. My dad only claims my little brother on his taxes and my brother doesn't work or have any income. Now I receive a RFE that my brother also needs to filed a i864a? Does anyone know why as my dad's income should already be enough. Oh yes they also ask for proof of relationship to the sponsor. would that be proof for my relationship from me to my dad or my brother to my dad? Would birth certificate be good enough as proof? Should I send in both my brother's and mine?

    NVC has reviewed the financial evidence submitted. However, additional information is

    required to complete the financial evidence review. Please provide all requested documents and

  2. it's quite possible the reviewer doesn't understand what's in front of them.

    Call into NVC, get a supervisor,

    ask the supervisor to have another reviewer review the documents, or ask that a supervisor in the reviewing section review the documents.

    The checklist doesn't make sense to me, knowing that you submitted official documents, certified by the issuing authority, into NVC.

    Yes that's what I was thinking. When i called in and talk to a nvc operator they said that they needed a true certified copy (a copy that looks like the original (color and paper material?) but Vietnam doesn't issue true certify copies of those documents i don't think, just photocopies from our originals with official Vietnam Government certified stamps by the intending dept. official.

    What step are you on where you have received this RFE? Have you already submitted the DS-230 package?

    When I sent in the original I-130 package to the USCIS lockbox I included a copy of my wife's passport, copy of birth certificate, and copy of marriage certificate (no originals or certified copies). They do have the red seal showing that they were certified in Vietnam however. Is this similar to what you sent in?

    Hi T,

    yes I sent in the AOS and IV package together earlier this month. Yeah my wife's civil documents are similar. They were all copies with the certified stamp from the Vietnam government officials with the exception of the police report which is the original(ly luat tu phap) when sending in the IV DS-230 packets. We have a lawyer in the city to help us prepared all the necessary documents. All our documents are officially stamp and translated.

    I did not attend the interview. As my fiance graduated from college and worked for a bit in the States (leaving in 2010), her English is very good. She also is comfortable with Western culture. We both were confident she could handle the interview alone.

    She did mention that many petitioners were there for the interview and she thought it was helpful. Either the petitioner was asked questions during the interview or there simply for moral support. If it makes sense for someones particular situation, it would be a positive to be there.

  5. I got a similar email as you, only it was for the police certificate. Did you make a copy of everything you sent? It's possible that something was missing. I noticed that I DID NOT include the translated PC so that's why I got the checklist. I sent in the checklisted items which were received on the 17th and I'm still waiting for approval.

    hi! all my wife's civil documents were translated and the copy that we sent in were certified copies with appropriate authorization stamps/dated and translated. However I don't remember if I attached a photocopy of the marriage certificate and birth certificate and after reading my email and forums carefully, it does seem that it is require to submit a photocopy of the original documents sending them in. My wife is in the process of resending me the documents for me to turn in, I should be receiving them around next friday. hopefully the delay won't be too long..planning on returning there soon for Tet to celebrate with her and the family.

    So I just received a email from nvc saying that I need to resubmit the following from my wife:

    -copy of passport

    -certified or original marriage certificate

    -certified or original birth certificate

    however prior to this email i got from them I had already sent in certified copies with the appropriate stamps so i called them but they told me they need a certified copy similar to the original. I don't quite understand..if anyone can help that would be awesome.

  7. Hi guys!

    I just received a Checklist email from NVC this afternoon, stating that it is missing the following documents:

    my wife's (the applicant):

    -copy of valid passport

    -certified copy of birth certificate

    -certified copy of marriage certificate

    however i know for a fact that I had send out these documents with the following AOS/IV packets so I don't know what to think right now as I am really confused and and bit down from reading this disturbing email. The documents were all certified by the local government agency and has the official certified stamp along with translations signed and certified by translators in Vietnam. I read somewhere that sometimes documents are not entered into the system at once so that it may be only an error..can anyone confirmed if this has happen before or maybe the documents has been misplaced or something? As soon as I got this email today I called them at once and got a message saying that they were closed today due to weather. Should I call NVC again tomorrow to find out what has happen to these supposed missing documents? Any advice from experience would be greatly appreciated.

  8. They dont accept calls or emails now. the only way is to complete the form on the HCMC consulate website. If money and time are not an issue, then it is best to be there.HCMC allows you to accompany her at the inetrview.

  9. If you do go, make sure you're allowed to be there with her. Some consulates don't allow the spouse in with the beneficiary.

  10. If you can afford it go, but it is actually a very simple process and not as hard as the locals say to scare the beneficiaries in to purchasing assistance they don't really need. When my fiance' went they only asked a few easy questions and reviewed her papers and sent her off with an approval. Unfortunately, the rest of my story is really ugly. But the interviews in HCMC are fairly easy if all your paperwork is done right.

    Thanks for the reply! We haven't got any problems as far as paper works goes. Everything's been pretty much smooth sailing. I don't mind to start saving up money to return to VN to be there for my wife's interview and support her through the rest of the process. I just don't want to create any possible problems if i am there that may delay my wife's interview results. I hear rumors from my dad's friends saying that I shouldn't be there for the interview and that if i go, she would most likely fail..i didn't understand that concept.. I'm just going back there to give my full support for my wife on her big day, why would she most likely fail? I ask my agent who has been helping me out with my paperwork and she says that it's totally fine for me to go back to VN for my wife's interview. Were you able to go back to VN for your wife's interview as well?

    I have recently sent out the AOS and IV packets regarding sponsoring my wife to come live with me in the USA. Right now I'm patiently awaiting news and possible interview date(s) for my wife currently living in Vietnam. I just have a quick question, would it be a good idea for me, the petitioner/sponsor be present during my wife's interview. It would be a big day for my wife and I would really want to be there for her to support her.

  12. This is wrong. Please disregard. The I-864a is for people needing to combine income. That does not apply here.

    If your father does not file a joint tax return, there is no need for an I-864a from his spouse.

    What if he file a joint tax return for 2009-2010 w/ my mom but file separately for 2011 (most recent). however his income from his work alone is about 44k /year which should be more then enough as a joint sponsor w/o needing to combine income.

  13. If you and your dad share same house address, then You fill out I-864 and your dad fills out I-864A. Make sure you include your recent tax return, W2 and employement letter. Same goes for your dad, his recent tax return, W2 and employement letter. He must also include his recent paystubs it helps them determine his individual income because he probably files a joint tax return. Employement letter is optional but its a good back up that tells them you and your dad has a job and what you make and that you will be remain their employee.

I have my tax returns and w2 from 3 years ago (2009) however I am currently self-employed for the past 2 years (2010-2011) so i don't know how i would get the employment letter for myself. I do do my taxes every year and have my tax returns to prove it. As for my dad we got his pay stubs ready and also a formal employment letter from his employer. Also we included another copy of my birth certificate to show my relation to my dad. Would that be enough documents concerning the AOS packet? should i include a copy of my business license?

    -i864 (dad)

    -i864a (dad)

  14. Only one of the replies was correct, the second one. Unless you are a dependent of your parents on their tax return, it doesn't matter where you live. You file an I-864 regardless, because you are the petitioner and primary sponsor. Your father files his own I-864 and an I-864a for his wife, as his household member. Filing an I-864 is the only way the qualified joint sponsor can accurately and completely state their household size.

    Thanks you for your help..that cleared up some of my confusion regarding i864 and i864a. Just another question..what if my dad files his tax separately from my mom, do we still need the i864a for her? or just one i864 from me (the primary) and one from my dad (the joint sponsor)?
