  1. As the topic says i am wondering how important is joint tax return for ROC? If we file jointly we will owe 580$ federal and 240$ state but if we file separately we wont owe (makes no sense to me but i know nothing about taxes) Now i personaly don't care even if we owe cos we'll pay it but my wife is being paranoid cos of all the debt she has and bankrupcy processing and she just doesn't wana pay an extra. It's not we'r loaded but if if's gonna help me woth ROC I'd gladly file it jointly. So how would it look in the eyes of USCIS if we would file separately for ROC ?!

    I got kinda strange and (un)usuall issue here. My case (i-485) was approved and card was "delivered" few days ago according to USCIS and USPS but in the envelope they sent there was no card ! :o

    There`s only notification that my case is approved and that i am suposed to get my card in 3 weeks but after i`ve called USCIS (3 times) they confirmed me (3 times) the card was actually printed, mailed and delivered by priority mail to my adress. I`ve explained them that there was no card inside the envelope on what they said that i should file I-90 form to request a replacement card which can take up to 7 months even tho i still didnt got the first one. I dont know who to trust, papper they`ve sent or themselves...

    Anyone with similar case in here?

    P.S. Am i being paranoid (again) or there`s a clear failiure from USCIS side ?

  3. I agree that IF he can fix the error it is best but in our experience, the interview was on a Thursday and we received the GC on a Saturday. The only way that could happen given the USPS is that the card was mailed before the interview. If the IO misspelled the name I would not woryy too much as it is the person that received the application who does the data entry that enters all the information for the GC not the IO. The OP can call on Monday to see what happens and hope he can get to a Tier 2 human, but I feel he will receive his GC on Monday and then see if the name is correct or not.

    I fear that there is nothing the OP can do until the GC is in his hands and he sees if the name is correct or not. The card was most likely printed Friday at the latest and put in the mail.

    She told us we will receive card in 6 weeks and if we dont get it in that time we should call 1 800 number to see whats going on. I got my EAD in mid of march and all info was good on it. I'll go tomorow anyway and see whats going on.

  4. Get the name fixed call ASAP, not sure why you didn't tell her at the interview it was spelled wrong? If your GC arrives with the wrong name spelling you will be sending your green card away and waiting around 6 months for it to be fixed.

    I spelled her my name 5 times atleast and to be honest i have no idea how i missed that. I looked at paper multiple times but didnt realised that instead of n she wrote m at some place.

  5. Yesterday after we've done our interview our IO gave me a interview result paper with circled "CONGRATULATION your i485 is approved bla bla bla" but she misspeled my first name! I was about to call 1 800 number that she said we can call in case of adress change or any questions but i couldnt get none there prolly cos its weekend. Does anyone know if that can be a potential problem?

    Also she said that my card should be mailed in 6 weeks from yesterday, now i see there are few ppl here that got their card in close to a week after they got approved so i am kinda confused ?!?! The case is also updated online and it says that my card is in production ... Anyone had similar situation??

  6. I just wana make a quick and short topic regarding my case ..

    We got our appointment scheduled for today and we got approved on spot. Interview it self was hour and 15 minutes late but didnt last longer than 35-40 minutes. We went fast through major questions from the forms after those officer asked about how we met and where. She asked me about my J1 program and that was pretty much it. She actually tryied to confuse me at some point while reading all those question with "yes" and "no" answers regarding military service. She asked if i was serving military in US or anywhere else on what i said NO but again made an extra comment (unneceserly) saying that i was drafted while being in Serbia but never served the army as it was "profesionalized" for the time being on studies, on what she replied "So you got drafted back there and you run away here". I was like "M`am i was drafted in 2006 and i came here in 2012". Anyway soon after that she took our bank statements, my DS form and few more documents we provided to do copyes. On her way back she said "I am gonna approve I-130 on spot and for I-485 i will sugest approval aswell. Expect your green card in 6 weeks from today giving me paper with interview result saying that i am APPROVED and explaining me on how to remove condition when the time comes for it. I also have to say that our officer was without any doubts a hardcore american and somehow strick and at certain point rude. She had her nails painted in American flag, her ear rings aswell and entire office was kinda in the tone of US flag :) which i like very much. She also refused to shake hands when i said thx for your time which was kinda rude but anyway everything was fine. For the time coming at home i checked my case online and i saw that card was allready in production.

  7. Regardless of what the website says, the OP should go down to the courthouse and find out in person.

    I was unable to add my Wife to my BofA account, after weeks of screwing around with them I went to Chase and got it done in 15 minutes. I used this as an example to show that there are exceptions to stuff all the time.

    Hmm had the same problem and eventually ended up opening the new account in Chase !

  8. You can't take a passport to any government office (Justice of the Peace) and get married. The same requirements are true for all - You must provide proof that you can legally marry - That requires government documents which she clearly cannot give because she is here illegally.

    Partially true ! You can get in some of the county Courthouse`s depending from state to state with document that proves your identity and get married. Been talking with several people who had absolutely no problems by doing so and got married while they were out of status.

    You are asking for a miracle when you are dealing with laws and procedures. I'm sorry to be so blunt, but you need to consider going back to your country voluntarily and by doing so, if he truly is the man you think he is, you two can work out a plan where he gets a good job, earns enough money to come to your country and begin the process of a legal VISA process -

    Good advice i`d consider it without any doubts if i`d be in your place.

    It will be tricky, but don't think for a second that getting married while you are here illegally will allow you to stay. They will deport you on the next plane and you'll be banned. Don't take that risk -

    Again partially true. They may deport you but they may not it all depends the way you fight it but chances to be deported are alot higher than not to be !

    Anyhow i think you shouldn`t have any problems by getting married even if you are w/o ssn.

  9. when you get the letter you go to the office at the specified time with your passport and the letter and 15 mins later you're done (most of the times) then just wait to hear from the uscis about the approval of EAD/AP if you applied for it or just for the interview letter for GC or transfer letter to CSC in case your case is transfer which most likely could mean no interview for you.

    Please update your timeline so we can help you better! Biometrics appointment is usually (not always) one month after NOA1.
