  1. I think you should still resubmit the 2012 tax return with you petition. You need to try to submit it as early as you can within that 90 day period from everything ive read on here. But i see what you are saying. It would be a good extra evidence but you need to leave time incase your petiton is lost in the mail, or if you did not fill out your form correctly and need to resubmit it. They also need time to issue you your one year extension. Alot of couples on here submit only 2 years from what ive seen. I think that waiting for the tax return might be pushing it. But then again there are lots of couples that wait alittle before filing because they dont have there packets finished yet. I think that if you wait till you get your w2 and then you have to wait to get your tax return back it may take to much time.

    Thank you so much for your help! We will file with 2012 and 2013 tax transcripts and inform USCIS in the cover letter that we will be filing jointly for 2014, so if they need that tax transcript, they could request it.

  2. I have to apply for the Removal of Condition, I-751. I can apply within a 90 day window prior to the expiration of my conditional 2-year green card. That window period starts on the second week of January. However, I don't get my W-2 until after January 31st. My wife is the petitioner. We filed joint income tax ever since we got married. I was thinking I could use the 2014 joint income tax returns as a proof for bona-fide marriage. Thank you.

  3. So in January 2014 my conditional, 2-year green card will expire which my wife sponsored for. But in March 2014, we will be celebrating three years of our marriage. Should I be applying for the removal of conditions or for US citizenship directly? Do I need to hold a green card for three years or have to be married to my US citizen spouse for three years with two years of green card? Please kindly help.

  4. My wife, who's US Citizen, has sponsored me for my green card. I have a conditional green card. My wife is a student at Yale University and I just got into Stanford. While we are married and are currently living together, I would like to attend Stanford and she doesn't want to transfer out of Yale, which I understand. Can I finish my school in California and she in Connecticut? When we both finish school, we will be living and working together. However, we are worried that if we stop living together for a few years to finish our schools, it may be a issue while we apply for my removal of conditions for the green card. Would the USCIS understand that sometimes even married people have to live separately to make something out of thier lives? Do we have to show the same address for both of us? We love each other so much, but opportunities like these don't come often and I got full scholarship! Please advise!!!
  5. My wife and I are using our text message history for the marriage based green card immigration interview to prove that our marriage is bona fide. We have other evidence as well, this is just a part of it. What we'd like to know is whether we have to get our text message conversation history certified, which we printed out already? We are asking because the letter from USCIS says all copies of the documents we are submitting must be certified. Thanks for your help!

  6. My wife and I have a green card interview soon and we need to prove that our marriage is bona fide. We have a long history of text messages. We can print them all out and show them to the immigration officer. But how do to certify the text messages? Or we don't have to certify them? Is just printing them out and showing them as they are, okay? I see in the letter it says every copy of anything has to be certified. Please help!

  7. My USC wife applied for my adjustment of status in November while I was in legal F-1 student status. Her I-130 petition for me has been approved, my I-865 (Employment Authorization) and I-131 (Advance Parole) were approved and I received my employment authorization card, which is also an advance parole card. I have been using my work authorization card to work full time as a computer programmer for a software company. Now my new semester is about to start in school and if I don't go to school full time, I will lose my F-1 Status. Will I still stay in legal status and be able to continue to work until my wife and I go for the green card interview? Our marriage is bona fide, so we aren't concerned about the interview. It's just the time before the interview that we are worried about. I can't go to school full time because I'm working full time. My wife doesn't work and I need to keep working to support both of us. Please kindly advise! Thank you so much for your time and consideration!

  8. My wife who is a US citizen filed for my i-130 and i-864 after we got married. We just moved a month after filing the paperwork. She updated our address on i-130 using USCIS's online feature. I updated our address by calling USCIS and filing AR-11 which also updated my address on i-485 and i-765 automatically.

    Does my wife still have to file I-865 Change of address form for i-864?

    My wife and I already filed I-130, I-485, I-864, I-131 and I-765. However, we just moved to another address and need to change/update our address with the USCIS. My wife is a US citizen and I'm a F-1 visa holder in the United States right now. How do we change/update our address? Is the process exactly the same for both of us? If different, how do each of us do it?

  10. I am filing I-864 as a joint sponsor for an immigrant friend. Since my income is not sufficient, my wife is filing I-864A. I am including the proof of my citizenship with the Form I-864 but my wife misplaced her documents, so she's unable to include the proof of her citizenship with the Form I-864A. Is the proof of my citizenship sufficient? My wife and I filed JOINT federal income tax return.

  11. My wife and I concurrently filed the I-130 and I-485. I had a joint sponsor since my wife and I are unemployed. My joint sponsor is married and filed the income tax jointly with her husband. Their most recent year's income tax returns were $110,000.00 (as shown on a copy of Form 1099-MISC). I guess Form 1099-MISC is same as income tax return form. My joint sponsor just guessed and wrote "$23,500.00" under her individual income section in the I-864 form.

    Now the problem is that USCIS says that my joint sponsor's income did not meet 125% of Federal Poverty Line for the joint sponsor's household size, which is 3 people.

    Can my joint sponsor just fill out another Form I-864 and simply add an increased amount of "individual income" since her combined income with her husband was $110,000.00?

  12. My wife didn't file income tax returns to be submitted with Form I-864?

    My wife and I concurrently filed the I-130 and I-485. I had a joint sponsor since my wife and I are unemployed. My wide and I didn't know that she (my US Citizen wife) also had to fill out the Form I-864. Although we know that now, there's another problem. They (USCIS) are asking for her most recent tax return. My wife was dependent on her mom and did not file her (wife) own income tax since she (wife) had no income of her own. My wife's mom filed the income tax returns however. How do we explain this to the USCIS since they are asking for a copy of her most recent income tax returns.
