  1. It means they will make a decision and will notify you of the outcome either on the USCIS page (if you have an account and is linked well) or via mail...

    the whole interview only took 10-15 min, all the IO asked is only yes or no questions on i-485, after like 10 min the IO told us to wait outside (the waiting room) then she review our case and called us back to the office and gave me a letter that says An Adjudicative review of your case is needed. No additional information is required from you at this time please inquare after 30 days, and she put our living address on this letter, and ask again is this your address? i said yes, then she told us we can leave and wait.

    anyone who got this letter before? can share any experiance with me ? thank you!

You post is confuse, first you said "... the i-485 was denied because my asylum case which was pending on the immigration court", and then you said "then gave us a notice wait for decision", or you case was denied or you are waiting decision, which information is the correct one?. If she gave a notice wait for decision, it means she didn't reach any decision in the interview and she needs more time to decide.

    i-485 denied mean the first time i filed i-130 and i-485 2 years ago, all the cases like this the USCIS can only approved your i-130, and they dont have the authority to approve your i-485 because the asylum case is still pending on the court, but i said my asylum case has been terminated last year, and i filed i-485 again, this time only for the i-485 interview

    dont wanna explain my case, anyone who got the similar case? asylum → married a USC

    today i attended our marriage interview at 300 N los angeles st 6th floor, actually my I-130 has been approved on march 2012, but the i-485 denied because my asylun case which was pending on the immigration court, but my asylum case has been closed by judge last year, and today i and my wife went to the interview ★★the interview took only 15 min, the IO didn't ask anything about our marriage, my wife was never asked any question, the lady only asked me those questions like Have you ever been ......... (questions on i-485)★★ and copy our marriage certification, then gave us a notice wait for decision, im so curious for this IO, she never asked anything about our life, nothing, then gave us a wait for decision letter, what does this mean?

    i've been filed the i-485 on Oct/2012, and i done the fingerprint on Nov 26th/ 2012, i got EAD on Jan 5th/ 2013 by mail, and still waiting for the interview letter, i checked my i-485 on CIS web it still keep showing scheduling for interview, it was like 3 months from the date i filed my AOS until now, anyone filed AOS currently in los angeles area and got interview letter? who can tell me the processing time from the date you filed to the date you received the interview letter, about how long? thank you so much!

  5. I m so stressed , my application is taking forever to be processed , I went for the interview early October, 2012 but the status still saying "testing & interview . Do anybody have an idea why is it taking so long?? :blink:

    is your green card based on marriage? if yes, then after the interview it would take a long time (time will be vary) to make a decision by ISO, someone got respond 6-10 months after the interview, depends on your case, marriage GC always got suspected by IO. thats why it will take long long time to get result by investigation.

    my friend told me he got the green card without an interview, is it true? i know his green card is based on marriage. and my status now is i-130 approved, i-485 is scheduling for interview, EAD got approved also, do you guys think my GC will be approved without an interview also? im wounding what kind of situation that can make a GC approved without interview? anyone got GC without interview here? thanks for sharing all of your stories. happy new year guys.

    Attorneys are waste unless you have complicated case(in that case you really need to find good attorney not JUST ANY Attorney).

    Sometimes you think you have attorney with you and you feel relaxed, and worst part is when attorney is not that active or attentive, you lose.

    thats what i wanna ask, ya if i bring an attorney definitely i will feel relax, but im not sure the interbiew will be Stoke or just regular, if it is just regular i dont wanna waste money to get an attorney, coz my I-130 has been approved, i guess the following interview is not gonna be hard,thats why im asking coz im poor.

Uscis can't change the BIA decision just if your appeal was "sustained" ,but if the decision was "remanded" then Ucsis will render a new decision either approval or new denial.When the sentence is sustained it means the appeal overcomes de grounds of denial. Ask your lawyer if the sentence was sustained or remanded.Good luck.

    thank you so much, actually my I-130 got approved on March this year, about 9 months ago, but i didnt file my I-485. and currently i checked my I-130 on CIS website it still showed my case got approved and from March this year my visa has been transfered to NVC.

  9. Usually... though for cases that smell of fraud, they can RFE you for proof of bona fide marriage (you see this in CR/IR-1 cases that have numerous red flags). It is possible that they sent that and the response was not sufficient, and then an appeal was filed? It was filed as a stand-alone petition, so USCIS didn't know a I-485 was coming.

    Maybe that's not what happened though... I am curious how a mere petition ends up in BIA.

    it is curious a lawyer would recommend filing separately in case the I-130 is denied.

    I-485 is based on I-130, petition for relatives which means the CIS accept the relationship between applicant and petitioner, no matter what kind of relationship such as couples, children and parents siblings, 130 and 485 can be filed separately or together, up to you , but even if you file them together if the I-130 dont get approved I-485 wont be approved also, this is what my attorney told me, and last year i filed my I-130 got RFE letter, then i filed so many evidence they still reject which means they didnt believe, then i got a letter that i can appeal within 30 days, then i did it, finally my I-130 got approved, this is my story. if I-130 approved that means CIS already accept the relationship which is a bona fide marriage (if GC is based on marriage) then now i filed adjust of status for my GC.

  10. and also did the IO separate you and your wife? only 3 questions sounds impossible, there are 2 reasons why the interview went quickly, 1st i think is they dont wanna waste time due to you didnt bring sufficient documentation, which means you did t complete the whole interview, thats why you got 180 days to wait, 2 is if you dont mind i ask do you have a baby? if both of you guys have a baby the interview will be done as fast as you mention. ive seen this situation before.

  11. Congratulations on your approval of the I-130. Here's where your case gets a bit dicey. Since they denied your application the first because they suspected fraud, they will be going over your I-485 with a microscope so a lawyer may come in handy. However you absolutely have no "RED FLAGS" then save your money and skip the attorney. What's the attorney going to say different from what you have told him/her. Good luck.

    LOL thx for helping , they review my 485 with microscope, so funny, its just a green card application, its not tons of diamond in front of them, they dont need to identify careful as you mention i think, but anyway, i will get an attorney, better and safer. for me everything's clean no criminal records, and my wife is from a US military family, everything's clean too, i dont think they have any excuses to deny my case since my I-130 got approved.

  12. OK the fact that they already suspect your marriage to be fraud changes things, definitely bring the attorney.

    Your lawyer is correct, you wil get a ten year greencard if approved.

    thank you for helping! i think i'd better get an attorney to go interview with me, it will be safer, at the beginning they denied my I-130 application due to they suspect the marriage is not bona fide, and i got request for evidence letter, and finally got denied, but we appealed and we got approved, thats what my case going from last to current, and now i file adjust of status (485) for my greencard, and i check my status on CIS web it shows within 30 days i will receive interview letter, coz my fingerprint check has been done on Nov 26th.

  13. Your I-130 can certainly be revoked, do not think that it cannot.

    The IO would need to have a good reason but it has certainly happened before and no doubt will again.

    haha , my attorney told me if the I-130 got approved by BOA,(which got higher jurisdiction than CIS) CIS can also appeal for this decision, but generally speaking, they not gonna do that appeal with BOA, coz they got so many cases everyday, they will be busy haha, and they really need a break.

    and also my attorney told me if this time i got approved i will get 10 years greencard, coz my marriage is over 3 years, if marriage is over 2 years before the interview, then the greencard will be 10 years without conditional, its the law.

  14. First of all, congratulations on your I-130 approval. I have never heard of people filing I-130 and I-485 separately but definitely you can file one earlier than another. But you should be prepared in case the immigration officer ask you the reason not to file those forms at the same time. Was it because you were not so confident in the whole application? Saving money is never a mistake but being less confident can be sensed right away and it can only make people feel somewhat sensitive in dealing your case. Just be prepared in case of that question asked during the interview.

    Second, as long as your beneficiary of I-485 is of true relationship, be it the spouse or close relative, there is no point to hire an attorney. However, if you don't know how to prepare for the documents, it can be another topic.

    When you talked that you are a little poor and sad man, you can collect all the required documents on your own as long as you have faith and hold belief in yourself.

    Just start working on the papers, be it financial likewise, be it assisting proof, and a good collection of evidence will give you more courage.

    thank you so much, the reason why i file 130 485 separately is 130 must be approved before 485, even if i file them together if my 130 cant get approved and my 485 is not gonna work, dont wanna pay 1000 USD again, im so poor. this is what my attorney told me, i really dont know, and my I-130 got 2 approved letter couple months ago, and also i checked it on CIS web it said my case got approved and it has been transfered to National Visa Center

  15. You should bear in mind that not everyone who has an approved I-130 is eligible for adjustment of status. You must have entered legally, and unless you are filing as an immediate relative of a US citizen, you must have maintained a lawful nonimmigrant status for the entirety of your time in the US.

    With an approved I-130 it will likely make your I-485 easier, but it's no guarantee of success.

    You don't have to hire a lawyer to attend the interview. In fact, unless you have significant red flags (and you don't mention this one way or the other) then there is not much a lawyer can do for you during an interview. It would depend upon the totality of your circumstances as to whether it would be a good idea to hire one or not.

    ya i enter US as F1 student, no criminal records my wife also, everything's clean thank you for your help, im just wounding to hire attorney or not, coz i dont wanna waste much more money on it.

  16. They can revoke the approval of your I-130 at any time. The final say is left to the interviewer - the petition was approved that allows you to proceed. it does not mean your marriage was found bona fide. They can and will still ask you about your marriage at the interview.

    This is a DIY site, so most people do the whole thing without a lawyer. We don't know anything about your case, though.

    CIS dont have this authority to revoke my I-130, coz my I-130 is not approved by CIS, first time my I-130 got denied by CIS coz they didnt believe our marriage is bona fine, and we appeared to BOA with so many evidence including my wife's dad's affidavit who is a US special force commander also as an representative of SF association, after we appeared then our 130 got approved in 1 month, i think it got approved right away if plus the mailing days.

    so for my next interview CIS not gonna check our marriage again i think.
