  1. The scam - They will hack or find a way to gain access to one of your newly imigrated spouses social or IM accounts. In our case it was QQ the most popular social network in China. The will take advantage of the time differnance between the US and their home contry. While you are aslleep they will contact anyone online and posing as you or your spouse or a friend that your spouse gave access to the account and tell them there is an emergancy and ask them to please send money asap to the scammers account and they will try and withdraw the money before we are awake to do anything about it.

My wife has been in the US for just about a month now and this happend to us yesterday and to a friend of hers that was last week. So please let your family and freinds know that this may happen so make sure they check with you before sending any money.

  2. My spouse was on a J1 visa when we met and the 2 year stay requirement expired this month. However, during those 2 years she spent about 4 months on a tourist visa with me in the US. My question is will those 4 months be deducted from the 2 year stay requirement? NVC didn't have an answer for me and everything else I have found seems to be conflicting so if you and your spouse have J1 visa experience I would be grateful to hear how it went.

  3. Hi Friends,

I petitioned for my spouse back in November (form I-130), and I received my NOA2 indicating that my petition was accepted on December 12th. I contacted the NVC yesterday to check on my status, and in return they attached a document with the subject: "I-601A PROVISIONAL WAIVER OF UNLAWFUL PRESENCE."

Now I'm super confused. My wife has NEVER been to the US, so why am I receiving this notice? Is this just a formality and part of the process? Should I disregard it? Because the notice does indicate that, "This notice applies to you if you are currently in the United States..." and this DOES NOT apply to me at all.

    What should I do?

    Thanks in advance!

I got one today, as far as I could find online it is something new so if your spouse is not in the US disregard it.

  4. Got this emailed to us today not sure why, any one know if this is just a standard thing they send out?

I-601A Provisional Waiver of Unlawful Presence

This notice applies to you if you are currently in the United States, are or have been unlawfully present

and plan to apply for an immigrant visa at a U.S. embassy or consulate abroad.

Beginning March 4, 2013, certain immediate relatives of U.S. citizens may apply for a provisional

waiver of inadmissibility due to unlawful presence before leaving the United States. For more

    information, please visit immigrantvisas.state.gov.

Before filing Form I-601A, YOU MUST NOTIFY THE NATIONAL VISA CENTER (NVC) by

emailing NVCI601A@state.gov. Failure to notify the NVC that you plan to file Form I-601A will delay

    your visa application.

  5. can post of the body of that email here, redacting the personal info and casefile #?

    thanks !

    Dear Sir/Madam:

The National Visa Center (NVC) received your correspondence.

We received electronic documentation for this case. Please allow up to 20 business days from the day the email was sent for the scanned attachments to be uploaded to the electronic case file and reviewed.

    IMPORTANT:

Do not let more than one year pass without contacting the NVC concerning this visa petition. If a period of one year passes from the last date of contact (by telephone, mail, or e-mail) with the NVC, all submitted fees and documents expire. If this occurs, the fees must be paid again and documents must be resubmitted in order to continue the immigration process.

As this case is processing electronically, all forms and documents must be sent via email as scanned attachments to NVCElectronic@state.gov . Sending physical documents to the NVC will delay the processing of your case.

  6. This is from the CR-1 guide and where we are in the process - A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC, the NVC will send your relative a packet of forms that you and your relative must fill out before your relative can be given an interview date with a consulate abroad

We have not got the DS-3202 yet so I am just waiting on that before we can do the electronic processing.

Question about the Affidavit of support, I am self employed so I don't don't get a pay stub would a copy of the deposits to my bank account be good enough or do i need to get something from the company that i am contracted to?

  7. Thanks Darnell,

We just got our approval letter about 2 weeks ago and are now just waiting for them to send the package. However, we did all documents that were listed in the guide for this step before she went back to China. I know once we get the package they will list what they want us to send, so do you have any recommendation besides the evolution of relationship letter and what is listed that we should include?

  8. Recently my wife joined an online group of women that are going through the visa process in her home country of China. At first I thought it would be a good support group for her, however, it has become source of stress for both of us. The group tells her that she will need documents that are not on the list of CR-1 guide or anywhere else I can find. A couple of these documents include 6 months worth of my pay stubs, photo copy of my passport including the Chinese visa, a letter explaining why I am not at the interview, just to name a few. Are these normal things requested by the NVC or is this just bad advice? I want to make sure that we send all they need so we wont have any delay in the process but at the same time I don't want to bog them down with unnecessary documents to slow them down.

Any advice or experience in this matter would be very appreciated.

    Thanks and Good Luck
