I have file i485 on August 18, 2013 and September 11, 2013 I got a RFE for a recent tax return and I replied back in couple days. Again on October 18, 2013 they have send me a another RFE but I haven't received the letter stated what they need. My question is, is this a bad thing because this is second RFE and my case is based off K1 visa? I thought my case is straight forward case. I filed my AOS couple weeks after my i94 expired, will this might be problem but I married within 90 days.

Am not saying that we not going to file for AOS. My only question was, will it cause any problem or would they ask us why did we file AOS pass 90 days? we going to file as soon we collect all the documents and am worried we will pass the 90 day mark before I will be able to send in the packet to USCIS.

I'm about to file AOS for my wife who came to United States on K1 visa. My question is, will it be a problem if we pass 90 days before we file? I mean do we have to file within 90 day after US entry. Will it cause any problem she pass 90 days before applying AOS? Because we are still in the process of collection all the documents.

It depends on the reason why they put you in AP. where you missing any documents at the time of the interview? Most AP cases gets resolve in 60 days.

Dubai has nothing to do with K1 visa, you need to check Dubai's requirement if they require passenger to have a tourist or transit visa.

I have never come across such arrangment where airline is providing room during the transit.

Yes, they will provide you with a room if you have 10 hour or long stay over at the airport.

My fiancée will be travel to USA on k1 visa. She is traveling via Dubai where she has 10 hours of stop in Dubai and the airliner have provided her a room to rest. So, my question is that can she leave the airport if she is coming to USA on k1 visa? Will that cause any problem here in US at the POE?

I understand that. But my point is they should not hold back passports for such a long period. Let them complete administrative processing and once they take a decision , they should call for passports for visa stamping. If some one wants to travel for urgent business purpose, how can he get back the passports ?

You can send a e-mail to ustraveldocs and request for your passport to be return and they will send it back to you.

I had my interview in chennai back in 2011 and i got refused and I was told to file the waiver...

My waiver got approved in jan 2013.

Mumbai consulate send me 221g on 12th feb to submit passport, medical, and my wife's taxs I submitted all the document with passport on 22 feb still waiting...

What I want to ask is on ceac when I check my status it was updated last on 27 feb but it shows refused i don't know why... It don't say if I'm on ap.... I emailed ustraveldoc couple of times but they never understand what I'm asking they keep saying u can check ur case status on ceac well I know that... In last email they said

Hold 221(g) / 214b refusal... I don't understand what's going on with my case:(

Anybody knows what is the Mumbai consulate number how can I call them...

What did the ceac website said before you submitted the passport and other documents? Have your wife call the DOS and find out exact status of your case.. Good luck!!

Congratulations! I doubt there's any requirement that she has to travel by herself. You can do either.

At the immigration line yes you can probably join her saying you're her fiance. i've even seen girlfriend/boyfriend going there together. If they want to process her separately I'm sure they'll just tell you to go back in line.

Hi everybody, my fiancée finally received her visa after 221g pending for last 2 months.

I have a quick question, I was thinking about going to India so I could travel to USA with my fiancée. So, does she have to travel to USA by her self, or have I could travel with her? Also, at the POE, is it better to go by her self at the custom officer or I could join her? I mean will the custom officer ask me any question or anything? Thinks everybody for your help!

Hey guys, my fiancée finally received her passport with visa today.

it's taking around 60 days to clear 221g pending cases.

so, i checked the DOS website and it said it has been issued. when i try to track the passport it says 'no information available for this passport and when i called DOS they said its still under AP. Is really my fiancee visa been issued or its this mistake or what? does anybody has this similar problem or does it take a several days for update? any help please!! thanks!

You are no longer required to submit packet 3. You take your packet 3 and packet 4 forms at the time of the interview. Just go onto Delhi consulate website and print out all the forms and follow instruction. You also need your medical and PCC done before going to the interview.

my fiancée had received 221g for missing PCC on dec 28, 2012 and she submitted her documents on dec 31, 2012. So, I just called DOS today just to see if there was any update and they told me that the consulate has not yet received her documents. VFS people tell me that the documents have been delivered to post. This is the first time I called DOS for update so I don't know if they are right or not. Did anyone has or have this same problem? What should I do?

Ohk. I got the appointment letter via email btw. I'm cutting my trip short and going back tomorrow to get started on PCC's. *Fingers crossed for no issues with PCC +interview*

Usually it takes 2 to 3 weeks at the police station and once you have it from them, you could take that to the passport office and they will give it to you in couple of hours.

Alright. My fiance will call DOS his morning. Lets see what happens. And I'll try UStraveldocs.

It's my pleasure helping someone in need. I was also confused, when I filed k-1 fiancée visa and I was search for information day and night to figure everything out. How you already got your PCC done? If not, you probably want to go head and apply for it because it takes some time to get PCC....good luck!!! Let me know if you need help

So since I would have to wait a while before my fiance woke up and called DOS, I emailed CIUND@state.gov and they emailed back saying my interview was scheduled for 15th March.

Then I called the support-india number 0120-660-2222, and they told me that that email itself was sufficient to take to my medical appointment and embassy interview. Does that sound right? Because it doesn't to me..

I'm more nervous now since its only a month away, and i just dont trust vfs and what they say.

You could call DOS and ask them if the embassy have mailed out packet 4 to the beneficiary. because in packet 4, it will have a hard copy of interview appointment letter. If not, call ustraveldocs and request for a duplicate interview appointment letter by e-mail. You will need a appointment letter for your medical and you gonna have to make a appointment your self.
