Just got my hard copy of my RFE. They listed 3 subjects they need more evidence on.

2 of them not a big deal(Photos and G-325A Request).

The third is a little more difficult.

It is the following:

PROOF OF LEGAL TERMINATION OF MARRIAGE:

Submit proof of the legal termination(s) of MY WIFE NAME.

Such of proof would normally be a final(absolute) divorce decree, death certificate, annulment, etc. In order for the legal termination of a marriage to be considered valid for immigration purposes, it must have been registered with a civil authority. Note: A Divorce Nisi is not considered to be evidence of a final divorce.

First of all, she has never been married before and I doubled checked all the boxes for marital status on the forms and they all are marked correctly with either "single" or "never married" and in the sections for previous spouses, we wrote "none". I am really confused why we got this part of the RFE. I cannot get proof of legal termination of Marriage because like I said before, my wife has never been married before.

If anyone has had this happen or have suggestions about it I would appreciated it.

Help please.

For the marriage termination did you write something in the question #10 if i am not wrong asking for PRIOR SPOUSE?

I might have a 'hit' on my name when applying for NBI clearance. That is, there are other people with the same name as mine but most likely a different birth date and different birth place.

Does anyone know how long it will take for me to obtain the NBI clearance in this case? I will be filing for the clearance through the NBI satellite offices in Metro Manila's malls.

The last time I applied for the NBI clearance was in 2004 or 2005 for a job, and the regional NBI office in Baguio took 3 weeks to process the application! I was told it was because other people have my name too and everything had to be coursed through the NBI office in Manila and the Baguio office wasn't computerized then.

If your name got "hit" and if you are in the province it took 2-3 weeks.. if in manila office u can get your NBI on the next day...

Anyone know when he check on case status in ceac state and said it`s ready.....

There is a date called creation date I would like to know if this date is my priority date or my case complete in NVC.....

Your priority date you'll see in your NOA1 with the receipt number (USCIS)... and for the ceac status thats the date when they creat your CASE NUMBER/ASSIGN from(NVC/DOS)

Ok from the present address now! it is the same address when she born? And if yes put the month and year when she born.. at the bottom asking HAVE YOU LIVED ANYWHRE OTHER THAN THIS ADDRESS SINCE THE AGE OF SIXTEEN? answer NO

Good question.. but in our case a lil bit funny... ok my wife works in jordan for 2 years when we fill up the ds-230/ds-260 we never mensioned that she works in other country or she lived there for 2 years and i think she should need the PCC huh? But in NVC or USEM never ask the PCC from jordan.. maybe because we dont put in the list that shes out of the country for more than six months? Do you think guys They still trace that? or just becoz she change her status in the passport? i'am confused lol or NBI clearance is enough?

I understand I will need original documents (and a copy of each) as well as 2x2 passport pictures. Do any of these items require a signature from the beneficiary? And more generally does anything at the NVC stage require a signature from the beneficiary? The DS-260 and DS-261 are sent online so those aren't an issue.

NO! but make sure all documents you submitted to NVC put your Case Number in the upper right/left corner of each documents and also the 2x2 pictures for the beneficiary put the name, DOB, Case number at back... in case they misplaced your documents and they know where they can put it back lol

on the I-864 form part 6 question 13, it says: "I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year." However, my husband only filed for each of the two most recent tax years. Are we supposed to NOT checkmark that question?

(We do have a transcript of the most recent tax year to send with the form.)

Answer: its say ONLY THE MOST RECENT TAX YEAR so if your husband file the income tax for 2012 and 2011 and theres no 2010 thats fine... they're looking only the MOST RECENT INCOME TAX, and you can still checked the box...

Part 6 question 14 says: "I have attached photocopies or transcripts of my Federal tax returns for my second and third most recent tax years."

Almost the same question; are we supposed to NOT checkmark that question? We only have a transcript to send with the form for the second most recent tax year, not the third.

answer: its your OPTIONAL you can checked the box or not..

(In case someone asks about the third most recent tax year; he wasn't working back then.)

It doesn't matter... just go to your payroll department and request a employment letter...

Ok guys we're planing for november 30 but theres no available flight that day.. so we just purchase a ticket for my wife yesterday and only december 2 the earliest flight at night 10pm.. and yeah we get that date.. theres available for december 1 but morning flight my wife dont want morning lol...

Yes you can send the same time but you can separate a different folder/envelop put a coversheet each on the top of documents..

i have received iv and AOS fees and i paid it both on the same date and i sent AOS two days ago with Bar coded cover sheet and now i'm sending Iv and is there any other Bar coded sheet for this or the same one from AOS i don't know i'm really confused please help me VJ, and one more question beside agent and lawyer does anyone else can submit iv or not.

For the IV supporting documents yes u can still use the barcode cover sheet... oh by the way did u fill up the form ds-261 (choice of address and agent) already? If not then fill up you need a invoiced identification number to fill up the form.. once they accept the ds-261 you will able to log in online to fill the form ds-260 which is IV application online form... ( correct me if i'am not wrong guys)

Interesting...she went this morning and they told her only the CEMAR was available. Did they need it for her interview? I'll try to get both CENOMAR and CEMAR just for the hell of it...thanks for the info everyone...

I dont think they need it my wife they never ask her more documents but its not hurt to get one copy of CENOMAR in case they were asking for it in her interview...

So when I went to file my i130 application for my wife in Manila yesterday they requested a CENOMAR to show that she wasn't previously married...but my wife went and they can't issue that because we're married now? Not sure I understand...It is the first marriage for both of us as we listed on the application...anyone have this come up before?

She can still get and request for CENOMAR from the NSO even she's married with you now... me and my wife are married and lately she request a CENOMAR from NSO last november 12 before her interview in case they were asking for it.. it took 2 days...

Hi guys im back my wife just got her visa today at MOA and i just have a question regarding the passport is inside the pocket and how to avoid open the sealed envelop to get the passport inside? Because i read some post here that when they got the passport inside the envelop they accidentally open the sealed...
