  1. when i had questions that i couldn't find an answer to on visajourney, i contacted a few lawyers, and among the many i contacted this lawyer was the only one that gave me a comprehensive email response without trying to sell me her services nor try and scare me into hiring a lawyer at all. she was very nice and helpful.

  2. just so i don't create a new thread on a sorta related topic...

    I (petitioner) had to do community service for a misdemeanor marijuana possession charge (which was actually reduced to an infraction thanks to Arnauld Schwarzwhatever). do i need to take court documentation to my wife's AOS interview? the note they sent in the mail about bringing all arrest/police/court documentation...they said "if you" and i'm not certain if they are referring to the beneficiary to us.

  3. marijuana possession (caught for the first time) is a misdemeanor offense in Wisconsin...equivalent to ditching school for a day. though, this is irrelevant to the beneficiary. maybe the CO will consider that marijuana is decriminalized throughout most of the U.S.

    jamaica... currently in process to decriminalize, though I assume the beneficiary was cited while it was still illegal. however, possession (first time offense) is a misdemeanor in jamaica as well.

    C) Controlled Substance Violations .


    Per section 101(f)(3) of the Act and 8 CFR 316.10(b)(2)(iii) , an applicant who has violated any law of the United States, of any state within the United States, or of any foreign country relating to a controlled substance is precluded from establishing good moral character, unless the violation was for a single offense of simple possession of 30 grams or less of marijuana. See Chapter 74.2(g), question 12 parts (A) and (F ) for more details regarding these types of violations.

  4. so i filed for adjustment of status for my wife and received the NOA1 and appointment letter for biometrics, her I-94 expires today, and so does her learner's permit.

    she failed her first behind the wheel test for a license last week, and is scheduled to take it again December 2.

    what kind of problems will she face trying to get her learner's permit renewed? trying to retake behind the wheel test? receiving a CA driver's license?

    we have an official marriage cert. she has her ss card.

    i don't know why i am under the impression that I need to submit a police clearance certificate for the I-485, can someone clear this up for me?

    she came into the U.S. through a K-1 visa... apparently the originals for the police clearances that she received from Korea and Russia have NOT been returned by the U.S. embassy in Russia...

    we are not now in the process of filing for her adjustment of status, and wanted to make sure whether or not she needs to submit police certificates again.

    No police clearance needed for AOS.

  7. there's a lot of discrepant information floating around on this website, and even on the moscow embassy's website (their english versions and russian versions of the same page say two different things sometimes). i would suggest the best bet is to cover all grounds possible. the police record could be looked at by the customs agent at the port of entry...meaning they don't speak every language of the foreigners that are coming through their gate. the translations are useless at the embassy (they all work in Moscow for a reason), they're more for the custom & border protection agents here in the States.

    did i confuse you yet? get your papers translated. it doesn't have to be official or notarized. but it does have to be accurate.

  8. your fiancee can have the interview in Russian. she/he shouldn't be worried...the interviewing agents are nice. it's an interview, not an interrogation.

    any translations can be done yourself as long as you are fluent in both languages.

    my fiancee received her visa in 3-4 days, while some "friends" she made at the embassy (other K-1 ladies) received their visas the next week.

  9. Make sure not to leave a space between the "MOS" and the rest of the case number.

    i don't even know (i'm sure we don't have one) what her MOS number is. i tried the WAC number.

    in any case... she received her visa several hours ago today. biggrin.png

    Now I can finally finish worrying I hope? Got this email from the Consulate
