It might be useful for you to think about it as two separate but related issues.

1. How much income is required. The 2014 table is here: http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf . They might be using the 2013 which is going to be a little less. It is important to calculate the correct household size. This can be be complicated in some situations, but has been discussed here a number of times.

2. Proving the income. The tax return is the basis, but if they have doubts that the income is currently being received then the additional evidence is required.

You need to establish if the problem is 1 or 2 in order to proceed.

The joint sponsor is a single male .

We provided his tax return ,3 months of bank statements and social security award letter . They replied that his income is not high enough which is clearly not true . We wrote and asked them to take a second look and referenced 19,662$ which is 125% level for a family of 2 for 2014 . His income is just over 28,000 $ They replied that he is not qualified and to find another joint sponsor

The embassy has requested that I send form 1-864 for myself the petitioner as well and the joint sponsor . We already have the i-134 on file and I am confused why they are asking for the new form . I contacted and immigration lawyer who informed me that the i-864 is for marriage visas not for fiance visas yet the embassy will not respond to my emails .Has anyone who filed for a k1 visa been required to send the i-864 ? I am kinda confused because under petitioner information it asks if I am his relative , joint sponsor , or the original sponsor has died . No where does it say fiance . Any ideas ?

I wanted to ask has anyone experienced being placed in AP again after oath and fingerprints? My husband was called after 15 months of AP for oath and fingerprints, the officer told him everything looks good however case is still in AP. I wonder why would they bother to call us.

Btw when I made a senator’s inquiry they did reply that our case was going through final processing, before being called for oath and fingerprints. I hope they didn’t change their mind….

We were not called for fingerprints of oath but we had a similar run around from the embassy. We have been in AP for 16 months and the embassy called us on November 26th of 2013 to say our visa was approved and to send a new medical with passport photos so they could issue it . We sent the documents are heard nothing . Then we received a call on December 26th 2013 saying our financial paperwork had expired ( joint sponsor info ) so to send new info . We sent that . Then we received another call in February saying they had not received our information. We provided them with the tracking information on the package , and resent it because we did not want to waste time . It has been almost three 3 months since the embassy called and told us we were APPROVED , yet our case still reads administrative processing on the government website and we have no visa in hand .

Okay so I'm on a K1 visa, my fiancé and I decided to meet in South America, stay there for a week or two and then fly to the US together

I'm gonna be flying out from Pakistan so do you think that's gonna cause any trouble? Like do I have to fly from Pakistan straight to the US?

I don't know where to call and I'm kinda unsure US embassy will assist me over the phone

If you find a flight from Pakistan to South America please let me know . My fiance and I wanted to meet in South America for a short visit but we could not find any plane tickets from Pak to South America.

My husband had his inteview on Jan 17th 2014 in Islamabad...all went well but unfortunately the interviewer told him our case has to be put under Administrative Process....this is quite frustrating but not much can be done...

any idea how long it takes ???

I was in Sweden during 2009 to 2012 and today i got my police record certificate from Swedish National Broad.

Now i want to verify some things that :

This certificate does not shows my Swedish Person-number

Do not mention the time period like 2009 to 2012

Just mention my Name , DOB and a sentence that :

The register contains no information regarding the Above person

Please clear me that this information is enough ?

Specially those who is living in Sweden or was living there and got Police certificate for USA

My fiance was living in Sweden when we met . He is also Pakistani.

The police clearance he provided the embassy was also very basic like you mentioned above . There was no problem at all.

Ive been in AP 15 months now and recently received a call saying we were approved and asking for my fiances passport . passport photos , and a new medical . We sent those things , and heard nothing for 30 days .Then we received a 2nd phone call asking for a new affidavit of support , which we sent . Its now been 3 weeks since they received it , and they will not even confirm they received it . Our case has not updated at all.

I mean really. Approved at consulate. Why are we approved but yet not really approved. In most countries visa is issued the same day. For example Panama.

Ive been in AP for 15 months then received a call 2 months ago saying I was approved , yet no visa has been sent . The entire process is a nightmare .

Grace I understand how you feel. My husband is in AP for the second time. We were in AP 16 months and they denied our visa. We appealed and won. When our case was sent back to the embassy they put us in AP again. So far we have spent 17 months in AP this time. They work on our case for a week or 2 then they stop. They asked for new documents in March then when they got them they didn't work on our case for months. My husband went in for an interview in October. They have stopped working on our case again.

It's an emotional roller coaster ride. Thank God they told you guys they were going to issue the visa. I believe we are dealing with the worse embassy in the world. Try to calm yourself and just continue to wait and pray.

my case update this month 3, 9, and 10 and than stop, I am on AP more than a year now..i hope this month will be gud for us..but they didn't asked me for any fresh document or medical yet..

My husband is in the same situation. We got a call on Nov 24th and they said they were ready to make a decision they just needed 2 passport size photos and DS260 immediately ... our case updated on Dec 3,4,5 and then stopped on the ninth. Wish you best of luck I hope Dec marks the end of your Journey.

Grace Islamabad embassy is slow. They must have gotten your documents from the mail room and put them in the computer system on the 6th. Give it some more time.

My fiance received a call from the embassy on November 26th , the person who called said that our K1 visa had been approved . He asked my fiance to send a new medical , passport photos and also his passport ( which he had due to traveling for work ). My fiance was so excited . He said he asked the guy over and over if our visa was ready , and the guy said yes it is , please send the information by American express.

So on November 29th we sent all the requested things by mail. Our case updated on December 6th , then December 9th but still says Administrative Processing. We called Department of State and asked what is happening . The department of state said we received your information , you are still in AP .I told them about the phone calll , and they said there was no problem with the case. They would not say anything else .

Is this normal ? The case has not updated in a few days , it does not say ready or issued .... just AP

Guys i Still haven't gotten my Passport back from embassy and its been 7 days since my case status said ISSUED. I call American express (courier service) daily but they don't have my passport yet and every time i call DOS they congratulated me and said its been issued. i hope they really issued it.

it was issued on 20th nov.

I Don't know what else to do now. Any Input will be appreciated?

I wanted to ask or survey so to speak, how many of you,(K1) and me, deal with no seeing your fiancee for months at a time?

I met my fiancee Sept 2012 on Facebook, it didn't take us long yo fall in love, February 2013 was our first face to face meeting, it was like being with an old friend, I returned again in May and became engaged, (no Ring But tattoos of our names over our heart) I've gone to see him 2 other times, once with my son, so as you all may know this becomes very expensive.

The question here is phone calls and texting isn't always enough, or even possible, due to time difference, work schedule, and expenses, how do you keep from fighting or feeling completely miserable going through this?

My fiancee and I know we love each other, its the distance between us and this process that gets in our way, and causes us to just lose it!

Have anyone here experienced this too?

Yes it was the same with me and my fiance . We saw each other for one week in the last 18 months because of my hectic work schedule . It caused a lot of problems between us , but when there is love ..... there is a way . This process is only temporary , just remember what you are working towards

I'm need a some advice. We received our NOA2 and then embassy sent us the 3.5 package via email. We responded on September 8. After three weeks I emailed them that we haven't heard from them since we mailed the 3.5 package. Their respond came next day that they haven't received our package yet and if you sent it, please send us airway bill number. I traced it from courier to embassy, they received and signed it on the the 9th. I Sent them three emails with airway bill number/receiving number but they are not responding anymore.

What should I do, my petition will expire in January 2014.

The embassy in Islamabad has also stopped replying to my emails . I sent information about my new employment and new home address. They did not confirm receiving it, they did not reply , and the department of state says they have received nothing . I had to have my congressman write to get a response and then the only response I received was saying that , I was in administrative processing which I already knew .

They use to respond in 2-3 days , but now they have stopped responding to me at all. I don't understand the problem

My congressman is writing the embassy , but the embassy is saying the same old things . No way to tell when AP will be over. You cant rush it .

I was wondering if anyone would like to share their experiences of using a Lawyer and doing the process alone. I wanted to know if it is useful to use a lawyer and if it makes the process faster?

I have an immigration lawyer. My lawyer was very helpful in filling all paper work , and helping gather information for proof of relationship . However I have now been in Administrative Processing for one year . My lawyer can not speed the process.

So in my opinion , the lawyer was a waste of money.

It seems that you are finally out of the year long AP. If that's so, please accept my heartiest felicitations. You two have indeed been very patient. I hope and pray you are both united very soon.

As regards the question, I may not have the most useful information. However, I remember when we are filling in the forms, we are asked if any other names have been used by us. But I still don't know if it applies in this case as US immigration laws are very strict and having and not having a given name can change things. But, might I ask if the same was pointed out by the CO at the time of interview? He may have travelled to other countries though where the laws are not that strict or such mistakes can be neglected.

But, keep your fingers crossed and pray like you have been and you will find a solution.

I have a small issue and wanted to know if anyone here on the forum has had experience with a situation like this .

On my fiances passport from Pakistan , the passport office made a mistake when listing his name .

The way is should be ( correct )

Given Name: Irfan

Family Name : Ullah

The way they listed it ( incorrect )

Given Name :

Family Name : Irfan Ullah

His immigration forms are all correct and he has traveled many times using the incorrect passport.

My question is: Will this pose a problem when trying to enter the USA on a K1 visa ? Should he have his passport fixed immediately, or is it not a big deal ?

Does any one get approved after the government shut down

At this time the government is still issuing passports and visas .

10 months since your embassy interview? what are they waiting for?

They wont say why its taking so long. My fiance is from Pakistan - I am sure thats the reason. They are " checking" to make sure he is not a terrorist.

How much more vetting could they possibly need to do? The USCIS and State Dept. now know more about me and Michelle than our own mothers. First, the long wait for NOA2 (including an RFE), then the 8-month DOT saga, then we both show up for the interview ("you're approved"), but NOW they have us in the AP holding pattern. For what? What more could they possibly need to know about us? It has been 14 months since we sent in our I-129. Do I sound frustrated?

Its been 17 months since we filed ours , and 10 months in AP
