  2. Hi VJ Family,

    My USC husband petitioned my stepson who turned 21 (CSPA qualified) November of 2015. His visa interview has been scheduled on January 19,2016. Pretty much all his documents were all set. There are few concerns I have mentioned above:

    Does he need a Cenomar? ( certificate of no marriage) he is single and under child category.

    Does he need an affidavit to travel from his biological father, though I plan to go home and pick him up on his flying to the US.

    Kindly advise.

    Answers will be highly appreciated.

  3. You file i130 for your eldest son. He will be under the F2B category. Waiting time is 10 years and he must remain single. Marriage will void the F2B petition.

    Your USC husband can file i130 for the youngest. File it ASAP before his 21st birthday so his age will freeze at 20 and he will be under the CR2 category. Waiting time is more or less a year and he must remain single as well.

    Only you can file for the 24 years old. He must stay unmarried while you are an LPR. It will be about 7-8 years for a visa.

  4. Hi all!

    My USC husband and I are gathering the documents for my 2 boys, my eldest is 27 and my youngest will be 21 in November this year. We got married 2 months before my youngest turned 18, so he is eligible as child I supposed. The I-130 for him is ready having my husband as the petitioner. I am a lawful permanent resident right now, under conditional status, which will be lifted in November, 90 days before my 2nd year anniversary in Hawaii.

    The instructions for Form I-130 under who may not file this form states " A stepparent/stepchild, if the marriage that created the relationship took place after the child's 18th birthday." Obviously, my eldest was 24 when I got married with my USC husband. From this particular instruction, who can petition for my son and what kind of form shall we use?

    Hoping to get some clear answers to our concern.

  5. I know nothing of your trials nor the rating you comment on, but I wish you health and happiness in your future together:)

    It wasn't someone else' fault to be questioned when chest xray shows abnormal and later on found to be negative. VJ timeline asked for review on what really transpired during the interview and why there was denial on my case. Thus, I gladly shared one of my most terrifying experience that I went through, hoping others would pick up something helpful from it, but sad to say after I did blurted my story out, we noticed later on that we were rated "very poor" by VJ Mgt. or whoever is in charge of the rating system. Others may haven't notice but it didn't escaped my probing eyes while scrolling our Immigration timeline.

    Whatever be the struggle that every member went over this journey as long as it was successful and rewarding in the end, we should be somehow thankful and lift each other up and no one from amongst the member nor management should have the nerve to crush us down.

    Survived the struggles of getting out from a very dreadful experience only because one mere individual was quoted of having chest abnormality. Rated "very poor" by VJ Trustees. Had we known we'll gonna be rated here, we couldn't have joined. However, with due respect. We still wanna express our heartfelt gratitude and appreciation to the website that was there behind us through trials, NOT in our success, so to speak.

    Nevertheless, I am already in Hawaii a month ago to the arms of my dear husband.

    Thank you for rating us poorly.

    Our journey made us stronger and proud to have made it through.

    Sorry for throwing a question about CFO. I realized you're still waiting for your Case Number.

    As per VJ timeline, spousal visa approval's standard time is 8-14 mos. We're just on time, considering that a lot other members applied before us are still waiting for their NOA2's.

    I am a Filipina but our case had been processed here in Thailand, since I work here.

    You'll get there soon also.

    I went through this dreadful sputum test due to abnormality on my left upper lung. But God's been so faithful to us. Had my martoux test as negative, 3 sputum test - all negative. After 6 weeks of waiting for the culture test. I was cleared.

    Now, im headed back to The Phils.

    Kindly confirm if I need to attend the CFO Seminar as I'll be departing from home.

    Sorry if I am posting in the wrong forum, but I need some advice! After my husband's waiver was approved, he went to the Abu Dhabi embassy and was told to drop off his passport, medical and my travel docs to show proof that I have traveled to visit him overseas. He was asked to pick up is passport two weeks later which was yesterday. When he showed up for his appointment to pick up his passport, he was told it was not ready and to come back this Sunday. I am concerned because they never said his visa was approved, the sheet he received states this below:

    Name of Applicant: Beneficiary's Name

    Number of Passport: 1

    Category: Blank

    Pick up date: February 24th, 2014 at 2pm

    Thank you for submitting documents as requested during your previous interview. Your case will be reviewed by a Consular officer who will make the final determination on your case. Your passport(s) may be picked up at 2:00pm on date indicated above. Please bring this form at the time of pick up.

    If someone could shed some light, that would be great!

    Hi!

    Should there be other information that they need for you to send, for sure the Consulate will let you know. Thus, when they said, pick up your passport meant an affirmative sign of approval. I hope other members would join and share their thoughts if I'm right.

  10. Only accredited medical facilities by the US Department of State are allowed to decide whether we pass the medical exam or not.

    Even if you go to 10 other hospitals to have 10 different xrays, if they are not accredited by DOS, the US Embassy won't accept it.

    The US is very concerned when it comes to tuberculosis.

    Our concern was, is it possible to go to the OTHER US Em accredited hospital,since there are 2 facilities in Bangkok?

    Is doing so,wont it hurt our application?

    We need good advise,please..

  11. First let me ask you this, What hospital did you go to? We went to bumrungrad and the same sort of thing happened to us. They doctor had us come back the two following days for saliva and urine tests. And then we were told we can have the forms in two months after tests were done. Not for TB but HIV and now I come to find out HIV isn't even part of the medical exam anymore. I don't need the forms right away but now I'm starting to really wonder what is up with this place.

  12. Hello VJ members,

    Me and my wife was hoping we could get some feedback and your thoughts on what we have encountered during her medical exam. My wife went for her medical exam on Tuesday and was told that her x-rays showed some abnormalities in her chest. She was then told she would have to do a sputum test and come back and do it again for the next couple of days. She was then told that she'd have to wait out a two month period and hope that the results would come back negative. If it did come back positive, she'd then have to be treated for another six months. We are now feeling really bummed out after being excited over getting our interview after a year long process.

    Here is what we're suspicious of. My wife just had an x-ray done in August of this year. Her results were negative, and she has never been diagnosed with having tb. So now we're thinking of getting a second opinion and my wife goes and gets another chest x-ray done at another hospital last night. Everything checks out good and he reassures my wife that her results are not showing any abnormalities in her chest and lungs. He even blows up the results just to show my wife that there isn't anything there.

    So here's what we're thinking of doing. There are two medical facilities in Bangkok that are accredited by the U.S. Embassy in Thailand. We plan on going to the other medical center that is accredited by the U.S. Embassy and redoing her medical exam. If they come back and say that her chest x-rays are clear and there's nothing there, that'll make three chest x-rays within the last 4 months that showed nothing being there. If it does come back showing some kind of abnormalities, then we'll just go along with what they say.

    We believe that her first x-rays was misread by this doctor and really wanted a second opinion. The second opinion that we got and hopefully the third opinion this week by the other accredited medical facility will prove that my wifes chest x-ray was misread by the first doctor.

    We would greatly appreciate any input and thoughts you may have on this matter. Is what we're doing illegal? Can we actually get a second opinion on this issue. Should we just wait out the two months? We actually feel as if we're being cheated out of our time of finally being together!

    If my wife is cleared by the second accredited medical institution, we plan on letting the embassy know exactly what happened.

  13. Ok maybe I am confused, but we sent in the packet. Received the Form I-797 and email, which I think is NOA-1 if I'm not wrong.

    We havent heard anything more in 2 months and 21 days. I keep checking online and the case status says Initial Review.

    Are you saying it will be another 4 months before we hear anything and have to send in more papers? I hope not. I checked the processing times between National Benefits Center and Peru and minimum time is 5 months to Interview and Average time is 8 months.

    What do you guys think?

    I think that you're being really optimistic and it's a good thing. Continue being optimistic and you may be one of the lucky ones, but the majority of cases will usually take up to a year from start to ending. I filed our petition back in early January of this year and we finally got our interview date which is January 9, 2014. A whole year!! Hopefully yours wont take as long as ours, but you should be ready to sit in for the long run. There are still people who started this journey the same time as us and are still waiting for their NOA2.

    Anyways stay positive and stay optimistic. Best of luck to the both of you on this journey..

    My interview date will be on the 9th of January. CEAC website update showed "Ready" last 17 December. I haven't received the Packet 3 since then. I downloaded the Packets 3&4 and all my other documents are all ready except my medical exam which will be tomorrow. Shall i wait for the Packets 3&4, or shall i send them the required documents beforehand?

  15. Hey,

    Here are some tips that will hopefully help those who are going through the pre-interview phase:

    1. Arrange all your documents as properly as possible. When you receive your packet 3.5, make sure you send all the documents in an orderly manner. The more professional your work is, the better impression you'll leave on the consular officer. Also, I think it's a good idea to include a cover letter in the beginning, which states the complete list of documents you're mailing to the embassy. It'll help the embassy to go through your documents easily. I also submitted additional pictures of me and my fiance to the embassy along with other documents for packet 3.5.

    2. Before your interview, go through all the documents you've submitted throughout the visa process thoroughly.

    3. You should also ensure that you bring all the documents asked in the interview letter. I personally took the complete I-129F petition, all the forms submitted for packet 3.5, medical report, NIC, all passports, two photos, and evidence of our relationship with me. It's always better to be safe than sorry.

    4. Irrespective of what time your interview is, you should reach the embassy around 7:00 a.m. The earlier you reach the embassy, the sooner you get done with your interview.

    5. Dress nicely and professionally. It leaves a good impression on the consular officer.

    6. Prepare well and know as much about your fiance as possible. You should put in intense efforts on your part and leave the rest to God. If your case is genuine and you have done your work well, you have nothing to worry about.

    7. I came across a number of people who didn't read the instructions sent by the embassy properly, which delayed their cases. Read all the mails/emails sent by the embassy very carefully.

    8. During your interview, answer all the questions very genuinely and remain calm and focused. Also, make an eye contact with the consular officer and greet him/her in the beginning.

    Alhamdulillah, my interview went well and I got approved. Shukar Allah. I was asked only two questions: How did you meet and when is the wedding. Alhamdulillah.
