Really needing some advice out there. Just got an RFE for our AOS stating that my wife doesn't meet the requirements for the 125% poverty guidelines.

The thing is she does, easily. She has only been in her new position 2 months but supplied a letter from her employer stating she was full time and earned X amount and job was continuing.

We just called USCIS and were told there must be a problem then on their end and to resubmit the entire application marked FAO Supervisor. I am now unable to work for god knows how long, already been 3 months.

My question I guess is, after a very long preamble, Do we in fact qualify if she has only been in this position 2 months?

We supplied all the past tax returns etc and here is the thing that gets me. Her old earnings were enough on the initial affadavit of support for me to enter the U.S from Scotland and marry. Now that I am here they tell me," your wife now earns way more but thats not enough, get out"

Also, we do not have many assetts to speak of to assist this as basically have been surviving for the last few months on life savings. Very strange system am not allowed to work and contribute right away.

Have to say thanks very much for compiling all of this and sharing it. My fiance and I have been waiting 5 and a half months now for the csc with no end in sight. She is taking this data to her congressman, called their office today.

Ridiculous there should be such a wait.
